This bill amends the definition of "custody" in care and protection proceedings for children in Massachusetts. The new definition clarifies that custody includes the power to determine a child's place of abode, medical care, and education, control visits to the child, and consent to enlistments, marriages, and other contracts requiring parental consent. If a child, parent, or guardian objects to the exercise of these powers, they can apply to the court for a de novo determination. The court can also make such determinations sua sponte (on its own). Additionally, the bill allows the court to order the Department of Children and Families to move a child or place them in a specific foster home, residential program, or other placement, and to order the child's guardian or custodian, including the Department, to provide visits and other contact between the child and their sibling, half-sibling, parent, guardian, custodian, or other person, as the court deems in the child's best interests.
