This bill aims to address the issue of secondhand smoke in condominium buildings. It proposes to amend the Massachusetts General Laws to provide that the presence of secondhand smoke or fumes in a condominium, emanating from a unit where a resident or guest is smoking, shall be considered a condition that endangers or materially impairs the health or safety of surrounding unit owners. The bill grants local boards of health the authority to issue fines to the offending unit owner and order the unit to be sealed or the owner to refrain from smoking if the smoke or fumes cannot be contained. Additionally, the bill requires condominium associations to include a prohibition on smoking tobacco, marijuana, or any other combusted or heated substance in common areas or units, except for units that are sealed to prevent the smoke or fumes from entering other areas.
