This bill amends the Surrogate's Court Procedure Act to allow for the appointment of a standby guardian due to "administrative separation" of a parent, legal guardian, or primary caretaker from a child. The bill defines "administrative separation" as a parent, guardian, or caretaker's arrest, detention, incarceration, removal, or deportation related to federal immigration matters, or the receipt of official communication from authorities regarding immigration enforcement that may interrupt the care and supervision of the child. The bill establishes the process for a parent, guardian, or caretaker to judicially appoint or designate a standby guardian whose authority would become effective upon the administrative separation of the parent, guardian, or caretaker, in addition to their incapacity, debilitation, or death.
