This bill provides that a defendant who commits an offense against a victim who at the time was rescuing, assisting or rendering care to another person in need would constitute an aggravating factor to be considered by the court in imposing a sentence. Aggravated circumstances under current law include, but are not limited to: the risk that the defendant will commit another offense; the extent of the defendant's prior criminal record and the seriousness of his prior convictions; and if the defendant committed the offense against a police or other law enforcement officer, correctional employee or fireman, acting in the performance of his duties while in uniform or exhibiting evidence of his authority. Under the Criminal Code, the court must weigh the aggravating factors of the particular case against the mitigating factors before pronouncing a sentence. This bill is in response to the incident at the Edison train station in New Jersey in which an individual stole the backpack of a man who went to rescue a woman who had fallen onto train tracks.
