This bill amends existing laws to require schools to maintain a stock supply of non-patient-specific epinephrine (also known as EpiPens) to be used in the event of an anaphylactic emergency. The bill directs the Department of Public Health to establish regulations for how this stock supply must be stored, the required quantity based on school population, training requirements for those authorized to administer the epinephrine, and procedures for regularly checking the inventory. The bill also provides liability protections for school staff who administer the epinephrine in good faith. Additionally, the cost of supplying the epinephrine will be assessed on surcharge payers as defined by the state's Medicaid program.
