Bill Summary
Music Modernization Act of 2018
AI Summary
This bill:
Establishes a blanket license for digital music providers to make and distribute digital phonorecord deliveries of musical works, to be administered by a new mechanical licensing collective. It requires digital music providers and significant non-blanket licensees to pay an administrative assessment to fund the collective, and sets forth procedures for the collective to identify copyright owners, collect and distribute royalties, and resolve disputes. The bill also repeals section 114(i) of the Copyright Act, which prohibited the Copyright Royalty Judges from considering certain types of evidence in setting royalty rates, and amends the procedures for random assignment of rate court proceedings under the consent decrees governing performing rights societies.
