This bill establishes a 2.75% assessment in calendar year 2019 on certain health insurance providers, including insurers, nonprofit health service plans, and health maintenance organizations, in order to recoup the aggregate amount of the health insurance provider fee that would have been assessed under the Affordable Care Act for that year. The revenue from this assessment will be distributed to the Maryland Health Benefit Exchange Fund to fund the operation and administration of a new Health Care Access Program that will provide reinsurance to carriers in the individual market and premium subsidies to low- and moderate-income individuals, subject to the approval of a waiver under the Affordable Care Act. The bill also requires individuals to maintain minimum essential health coverage or face a penalty, and authorizes the Maryland Health Benefit Exchange to apply for and implement a waiver under the Affordable Care Act to stabilize the individual and group health insurance markets in the state.
