Protect Interstate Commerce Act of 2018 This bill prohibits a state or local government from imposing a standard or condition on the production or manufacture of agricultural products sold or offered for sale in interstate commerce if: (1) the production or manufacture occurs in another state, and (2) the standard or condition adds to standards or conditions applicable under federal law and the laws of the state or locality in which the production or manufacture occurs. The bill also allows private rights of action to challenge state or local regulations relating to agricultural goods sold in interstate commerce.

AI Summary

This bill prohibits state or local governments from imposing any standards or conditions on the production or manufacture of agricultural products sold in interstate commerce, if the production or manufacture occurs in another state and the standards or conditions are in addition to those required under federal law and the laws of the state/locality where the production or manufacture occurs. The bill also allows private parties affected by state or local regulations of agricultural goods sold in interstate commerce to file a lawsuit to invalidate such regulations and seek damages. A preliminary injunction can be issued to prevent the state/local government from enforcing the regulation until a final judgment is reached, unless the government can prove it is likely to prevail on the merits and the injunction would cause irreparable harm.
