This bill requires a criminal background check through the National Instant Criminal Background Check System (NICS) before a person can sell or transfer a firearm to another person, with some exceptions. It creates an aggravated misdemeanor penalty for violating this requirement, except for sales or transfers to law enforcement buyback programs or during acts of justified self-defense. The bill also allows licensed firearms dealers to charge and collect fees for conducting these background checks on behalf of sellers or transferors, and requires the Department of Public Safety to adopt rules to implement the provisions. The bill applies to the sale or transfer of firearms on or after July 1, 2018.
