This bill amends the United States Code to provide courts in the United States and its states with jurisdiction over certain foreign entities. Specifically, the bill states that an entity is not immune from the jurisdiction of U.S. courts if it is incorporated in a foreign state where state-owned or state-controlled entities commonly engage in commercial activity, and if the entity conducts commercial activity in the United States. The bill also clarifies that the commercial activity of an agency, instrumentality, or entity described in the new Section 1605(e) shall be attributable to any corporate affiliate that directly or indirectly owns a majority of its shares and is also an agency or instrumentality of a foreign state, or an entity described in Section 1605(e).
