This bill is based on the New Jersey Law Revision Commission's Final Report Relating to the Uniform Common Interest Ownership Act, issued in October of 2016. The bill seeks to initiate a process to consolidate the laws applicable to all types of common interest communities, a term defined to encompass homeowners associations, condominiums, and cooperatives. The bill consists of portions of the Uniform Common Interest Ownership Act ("UCIOA"), a publication of the National Conference of Commissioners on Uniform State Laws. The Law Revision Commission ("LRC") report recommended the Legislature codify the less controversial aspects of UCIOA, such as community creation and termination, the content of governing documents, unit boundaries and common elements, taxation, the effect of local ordinances, and lender rights. This bill follows that recommendation. The LRC intends to address more controversial issues, such as elections, the conduct of meetings, and alternative dispute resolution, in the future. The bill establishes a new chapter within Title 46 of the Revised Statutes, chapter 46:8E, in order to address the applicability of the bill in general, taxation of common property, local ordinance applicability, the effects of eminent domain, and the coordination between the bill and other statutes. The bill also addresses the creation, alteration, and termination of common interest communities, delineation of unit boundaries and common elements, the content of the declaration and bylaws, lender rights, and the consolidation and termination of common interest communities.
