Bill Summary

This Act establishes that a contract between a pharmacy benefits manager and a pharmacy may not prohibit a pharmacy or pharmacist from doing any of the following:

This bill establishes that a contract between a pharmacy benefits manager (PBM) and a pharmacy cannot prohibit the pharmacy or pharmacist from: 1) providing an insured patient with information about the retail price of a prescription drug or the amount of the patient's cost share; 2) discussing this price and cost share information with the patient; and 3) selling the patient a more affordable substitute drug, if one is available. The bill applies to PBM-pharmacy contracts entered into, renewed, or extended on or after the effective date of the Act.
