This bill authorizes the commissioner of the capital asset management and maintenance, in consultation with the executive director of the Massachusetts Water Resources Authority, to release a 30-foot wide metropolitan district commission high service water line easement in the cities of Revere and Malden for the benefit of Wesley Squire, LLC, the owner of the premises located at 649 to 655 Squire Road in Revere and 1 Wesley Street in Malden. The easement is no longer needed for the construction, maintenance, or operation of the Massachusetts Water Resources Authority's water system. The bill requires an independent appraisal of the easement and the difference in value of the property with and without the easement, and any difference in value exceeding the appraised value of the easement must be paid by Wesley Squire, LLC to the Commonwealth. The bill also allows the commissioner to release the easement for less than the consideration if it is determined that consideration has already been provided through a previous grant of an easement to the Massachusetts Water Resources Authority.
