This bill seeks to repeal Section 2 of Chapter 652 of the Acts of 1981, which imposed an agricultural use restriction on land in the town of Westborough held by the Commonwealth. The bill authorizes the Commissioner of the Division of Capital Asset Management and Maintenance to release this agricultural use restriction and right of reverter upon payment of the difference between the fair market unrestricted value or the value in proposed use (whichever is greater) and the agricultural fair market value, as determined by an independent appraisal. The current owner must pay this difference to the Department of Agricultural Resources, which will use the funds to acquire new agricultural preservation restrictions. The bill also requires the Commissioner to submit the appraisal and review by the Inspector General to the legislative committees on Ways and Means and State Administration and Regulatory Oversight before executing the release.
