This bill aims to strengthen consumer protection from security breaches by requiring users, with a few exceptions, to obtain the prior written, verbal, or electronic consent of the consumer before accessing their consumer report. It also prohibits users from requiring or requesting that consumers waive these consent requirements, and failure to comply would constitute an unfair practice under the state's consumer protection laws. The bill also allows the Department of Children and Families to obtain consumer reports for children in its custody without obtaining the child's consent, in order to fulfill its federal obligations. Finally, the bill authorizes the Department of Consumer Affairs and Business Regulation to promulgate regulations to interpret and apply these new consumer protection provisions.
