LD1141 An Act to Increase the Procurement of Maine Foods by Certain State Institutions This bill clarifies existing state policy governing food procurement by state institutions to require rather than encourage the procurement of Maine foods and food products by state institutions. The bill requires the Commissioner of Agriculture, Conservation and Forestry to implement and promote a Maine foods and food products procurement program that consolidates food commodity purchases by centralizing the control and purchase of food to stabilize state institution food budgets. The program must allow state institutions to take advantage of opportunity buying, coordinate dietary requirements and establish healthy menus consistently throughout state institutions. The bill creates a definition for "opportunity buying," which is defined as the purchasing of food and food products from vendors at a significant discount that is only available for a short period of time before the food or food products become unavailable for purchase. The bill also requires that the program measurably improve the quality and reduce the cost of food and food products for state institutions. Current law requires the Commissioner of Agriculture, Conservation and Forestry to establish a Maine foods and food products procurement program with the goal that 20% of food procured by state institutions is Maine food and food products. The bill adjusts the program goal with a requirement that, by 2030, that percentage must be 30%. The bill also requires the commissioner to designate an employee of the department as an institutional food procurement coordinator to coordinate food procurement for all state institutions and to implement and oversee a strategy to strengthen connections between Maine food producers, distributors and other institutional stakeholders outside of State Government to achieve the procurement goal established. The bill gives permission for the State to engage in off-contract purchasing, outlines requirements for the convening of an annual meeting and an advisory committee to assist the coordinator in advancing strategies for increasing purchases of Maine foods and food products by state institutions and requires the inclusion of the progress toward the procurement goal in the commissioner's biennial report. LD1134 An Act to Prohibit Males from Participating in Female Sports or Using Female Facilities This bill prohibits a school administrative unit or an elementary school, secondary school or postsecondary educational institution in the State that receives any state funding from allowing a person whose biological sex assigned at birth is male to participate in a competitive athletic program or activity that is designated for females or to use a facility that has been designated for use solely by females. LD1934 An Act to Promote Responsible Outdoor Lighting This bill requires that outdoor lighting installed or replaced after October 1, 2026 comply with certain standards, including standards established by the American National Standards Institute and the Illuminating Engineering Society, intended to reduce the amount of unnecessary light emitted. The bill includes exemptions for certain types of lighting such as outdoor sports lighting, temporary lighting and required and emergency lighting. The bill directs certain departments to adopt rules to implement the requirements of this bill. The bill also directs each municipality in the State to adopt a local ordinance to promote compliance with the provisions of this bill and allows a municipality to adopt ordinances that are more strict than those required by this bill. LD1154 An Act to Require That Informed Consent for Abortion Include Information on Perinatal Hospice This bill requires a health care professional, as part of ensuring informed consent for an abortion of a pregnant woman whose fetus has received a diagnosis of a lethal fetal anomaly, to inform the woman of perinatal hospice services and provide the woman with a list of available perinatal hospice services providers. If the woman declines receiving perinatal hospice services and elects to proceed with the abortion, the woman must certify that decision in writing and that the woman received the list of perinatal hospice services providers. LD253 An Act to Prevent the MaineCare Program from Covering Abortion Services Public Law 2019, chapter 274 enacted the Maine Revised Statutes, Title 22, section 3196, which requires the Department of Health and Human Services to provide coverage to a MaineCare member for abortion services. Abortion services that are not federally approved Medicaid services must be funded by the State. This bill repeals Title 22, section 3196, removing the requirement that the department fund abortion services for MaineCare members and removing the requirement that the State pay when the abortion services are not covered by Medicaid. LD682 An Act to Amend Certain Laws Regarding Abortions This bill amends the law regarding abortions by: 1. Specifying that the report of abortions made to the Department of Health and Human Services must include the race, marital status and level of education of the person on whom the abortion is performed and any other information as prescribed by the National Association for Public Health Statistics and Information Systems, Technical Resource for Reporting Induced Termination of Pregnancy; 2. Changing the standard for when an abortion may be performed after viability by allowing an abortion to be performed after viability only when it is medically necessary to preserve the life or health of the mother, rather than when a licensed physician determines it is necessary, or when the fetus is diagnosed with a fetal anomaly that will, with a reasonable certainty, result in the death of the child within 3 months after birth; and 3. LD406 An Act to Repeal the Laws Providing for Paid Family and Medical Leave and to Reimburse Taxpayers This bill repeals the provisions of law related to the paid family and medical leave benefits program. The bill requires the Department of Labor to refund contributions made by employers and self-employed individuals to the Department of Labor under the paid family and medical leave benefits program. The bill requires an employer that deducted a portion of the premium required for an employee from that employee's wages to remit that portion of the premium to the employee as part of the employee's wages. The bill requires the State Controller to transfer unappropriated funds from the Department of Labor, Paid Family and Medical Leave Insurance Fund, Other Special Revenue Funds account to the unappropriated surplus of the General Fund. LD1516 An Act to Strengthen the Maine Development Foundation This bill revises the term limits of the Board of Directors of the Maine Development Foundation. The bill also authorizes the Director of the Bureau of General Services within the Department of Administrative and Financial Services to waive the competitive bidding requirement if the procurement of goods or services is consistent with the purposes and duties of the Maine Development Foundation and procuring those goods or services from the Maine Development Foundation is the most economical, effective and appropriate means of fulfilling a demonstrated need. LD1881 An Act to Ensure the Rights of Parents of Minor Children in Education This bill provides that a parent is entitled to access all information regarding the school activities of the parent's minor child; review all information regarding mental, emotional and physical health care services available at the school the parent's minor child attends as well as teaching and instructional materials for the parent's minor child; receive a well- being questionnaire or health screening form before that questionnaire or form is administered to the minor child; access health care and educational records of the parent's minor child; and refuse the parent's minor child's participation in a noneducational or core assignment, activity or service or assignment of material and request an alternative assignment, activity or service or material. The bill prohibits the governing body of a school administrative unit from adopting procedures or student support forms that prohibit school administrative unit personnel from notifying a parent of a student about the student's mental, emotional or physical health or well-being or that encourage or have the effect of encouraging a student to withhold this information from the student's parent. It also prohibits school administrative unit personnel from discouraging or prohibiting parental notification of and involvement in critical decisions affecting a student's educational learning or mental, emotional or physical health or well-being. It provides an exception for a school administrative unit to adopt procedures that permit school administrative unit personnel to withhold information from a parent if a reasonably prudent person would believe that disclosure would result in child abuse or neglect or child abandonment. LD868 An Act to Ensure Equity and Safety in Athletics, Restrooms, Changing Rooms and Housing at Elementary, Secondary and Postsecondary Schools This bill requires that interscholastic and intramural athletic teams or sports that are sponsored by public schools, public charter schools, public postsecondary education institutions or schools they compete against be designated as male, female or coed. The bill also prohibits students who are male from participating in an athletic team or sport designated as a female team or sport. The bill requires public schools, public charter schools and public postsecondary education institutions to designate restrooms, changing rooms and sleeping quarters as for use by either only females or only males with limited exceptions. The bill provides that an individual may have a private cause of action against a public school, public charter school, public postsecondary education institution, private school, private postsecondary education institution or athletic association or organization under certain circumstances as a result of a knowing violation of these provisions. LD1763 An Act to Regulate Nonwater-dependent Floating Structures on Maine's Waters This bill implements a prohibition on the placement or use of a nonwater-dependent floating structure in, on or over inland waters or coastal waters. As defined in the bill, a "nonwater-dependent floating structure" is a waterborne structure that is supported wholly or partially by the structure's own buoyancy and that supports a nonwater-dependent use. "Nonwater-dependent uses" is defined as those uses that can function in a location other than the surface waters of the State and that do not require, for their primary purpose, location on submerged lands or direct access to inland waters or coastal waters. The prohibition includes exceptions for functionally water-dependent uses, swimming structures, water toys, ice fishing shacks and aquaculture facilities. The bill also clarifies the regulation of houseboats and homemade watercraft under the laws regulating watercraft. In Committee
LD1441 Resolve, to Establish the Commission to Study the Future of Recreational Access in Maine This resolve establishes the Commission to Study the Future of Recreational Access in Maine, which is directed to assess current and future public access to public and private lands in the unorganized territory as well as other areas of high interest in the State. The commission is required to submit a report and suggested legislation by December 3, 2025 to the Joint Standing Committee on Agriculture, Conservation and Forestry, which is authorized to report out legislation based on the report to the Second Regular Session of the 132nd Legislature. LD1532 An Act to Expand the Department of Inland Fisheries and Wildlife Outdoor Education Programs to Schools and Communities This bill allows the Department of Inland Fisheries and Wildlife to conduct the department's educational programs at locations owned by 3rd parties through leases or partnerships with the 3rd parties. The bill allows the Department of Inland Fisheries and Wildlife to collaborate with the Department of Education to develop a curriculum for a program to allow the program to count as secondary school instruction. A secondary school may elect to participate in the program, which may be held in whole or in part at the 3rd- party location or the secondary school or a school administrative unit facility. Members of the public and homeschoolers may attend the programs. The bill directs the Department of Inland Fisheries and Wildlife to secure at least 3 locations in geographically diverse areas of the State by January 1, 2026 and to develop a curriculum for one or more programs to be conducted at the locations as soon as practicable in 2026. LD1547 An Act to Use a Portion of the Sales Tax on Snowmobiles to Fund Maine's Snowmobile Trail Programs This bill provides that 40% of the sales and use taxes collected with respect to snowmobiles must be credited to the Snowmobile Trail Fund of the Department of Agriculture, Conservation and Forestry, Bureau of Parks and Lands. LD32 An Act to Repeal the Laws Regarding Net Energy Billing This bill repeals the laws that authorize the Public Utilities Commission to adopt rules governing net energy billing and that direct the commission to establish a net energy billing program for commercial and institutional customers of investor-owned transmission and distribution utilities. It prohibits the commission from adopting rules that require a transmission and distribution utility to allow a customer to participate in net energy billing. The bill also amends the laws that reference the net energy billing programs repealed by this bill, including repealing the provisions of law that provide for real estate and personal property tax exemptions for solar energy equipment used in connection with net energy billing customers. LD1224 An Act to Comprehensively Protect Consumer Privacy This bill enacts the Maine Consumer Privacy Act, which takes effect July 1, 2026. The Act regulates the collection, use, processing, disclosure, sale and deletion of nonpublicly available personal data that is linked or reasonably linkable to an individual who is a resident of the State, referred to in the Act as a "consumer," by a person that conducts business in this State or that produces products or services targeted to residents of this State, referred to in the Act as a "controller." Under the Act, a controller must limit the collection of personal data to what is adequate, relevant and reasonably necessary in relation to the purposes for which the controller processes that data, as disclosed in a privacy notice specifying the categories of personal data processed by the controller, the purposes for processing the personal data, the categories of personal data transferred to 3rd parties and the categories of 3rd parties to whom personal data is shared. A consumer has the right, under the Act, to confirm whether a controller is processing the consumer's personal data; to require the controller to correct inaccuracies in or delete the consumer's personal data; to obtain a copy of the consumer's personal data; and to opt out of the processing of the consumer's personal data for purposes of targeted advertising, sale or profiling in furtherance of decisions about the consumer's access to financial or lending services, housing, insurance, education, criminal justice, employment opportunities, health care services and essential goods and services. The privacy notice must describe how a consumer may exercise these rights. The controller must obtain the affirmative, informed consent of a consumer before processing the consumer's sensitive data, including data revealing the consumer's race or ethnic origins, religious beliefs, medical history or mental or physical health conditions or diagnoses, sexual orientation or citizenship or immigration status; genetic or biometric data used to uniquely identify an individual; precise geolocation data; data of a known child who has not attained 13 years of age; or data concerning the consumer's status as the victim of a crime. If the controller knows that the consumer has not attained 13 years of age, the controller may not process the consumer's data for any purpose without parental consent. If the controller knows or willfully disregards that the consumer is at least 13 years of age but has not attained 16 years of age, the controller may not process the consumer's data for targeted advertising and must obtain the consumer's consent before processing the consumer's data for sale. The Act prohibits a controller from processing data in a manner that discriminates against a person in violation of state or federal law. A controller is also prohibited from retaliating against a consumer for exercising the consumer's rights under the Act, except that a controller may offer different prices or selection of goods in connection with a consumer's voluntary participation in a bona fide loyalty or discount program. A controller must establish, implement and maintain reasonable data security practices. Beginning July 1, 2026, if a controller engages in a data processing activity that presents a heightened risk of harm to a consumer, including processing any data for targeted advertising, sale or profiling or any processing of sensitive data, the controller must conduct and document a data protection assessment to identify and weigh the benefits and potential risks of the processing activity. The controller may be required to disclose the data protection assessment to the Attorney General, who must keep it confidential, when the assessment is relevant to an investigation conducted by the Attorney General. The provisions of the Act do not apply to specifically enumerated persons, including the State, political subdivisions of the State and federally recognized Indian tribes in the State; financial institutions or their affiliates subject to the federal Gramm-Leach-Bliley Act that are directly and solely engaged in financial activities; state-licensed and authorized insurers that are in compliance with applicable Maine laws governing insurer data security and data privacy; and persons that both processed the personal data of fewer than 25,000 consumers in the preceding calendar year and derived no more than 25% of gross revenue from the sale of personal data. The Act also does not apply to persons that controlled or processed the personal data for purposes other than completing payment transactions of fewer than 100,000 consumers in the preceding calendar year, except that, beginning January 1, 2028, this exception applies only to persons that controlled or processed the personal data for purposes other than completing payment transactions of fewer than 50,000 consumers in the preceding calendar year. In addition, the provisions of the Act do not apply to specifically enumerated types of data, including: nonpublic personal information regulated under the federal Gramm-Leach- Bliley Act; health care information protected under the Maine Revised Statutes, Title 22, section 1711-C; protected health information under the federal Health Insurance Portability and Accountability Act of 1996; personal data regulated by the Family Educational Rights and Privacy Act of 1974; data processed and maintained by the controller regarding an applicant for employment or employee to the extent the data is collected and used within the context of that role; and data necessary for the controller to administer benefits. The Maine Consumer Privacy Act also does not prohibit controllers from engaging in specifically enumerated activities, including complying with state or federal law; complying with investigations or subpoenas from governmental authorities including the Federal Government and the government of a state or a federally recognized Indian tribe in the State; cooperating with federal, state or tribal law enforcement agencies; providing a product or service specifically requested by the consumer; protecting life and physical safety of consumers and preventing or responding to security incidents; and conducting internal product research, effectuating a product recall or performing other internal operations aligned with the expectations of a consumer. Violations of the Act may be enforced exclusively by the Attorney General under the Maine Unfair Trade Practices Act. Absent a showing of immediate irreparable harm, the Attorney General is required to provide a potential defendant with at least 30 days' notice prior to initiating an enforcement action, during which time the potential defendant may cure any violation alleged in the notice. Any civil penalties, attorney's fees or costs awarded to the State for a violation of the Act must be deposited in the Maine Privacy Fund, which is established to provide funding for the enforcement staff and activities of the Department of the Attorney General. The Act further requires the Attorney General to submit a report by February 1, 2027 to the joint standing committee of the Legislature having jurisdiction over judiciary matters regarding the operation and implementation of the Act. The committee may report out legislation related to the report to the 133rd Legislature in 2027. In Committee

Whereas, acts and resolves of the Legislature do not become effective until 90 days after adjournment unless enacted as emergencies; and Whereas, this legislation establishes an immersive outdoor education program that provides interdisciplinary and experiential education in an outdoor setting, and this legislation creates equitable opportunities for students across this State to have outdoor experiences; and Whereas, many children in this State lack opportunities to enjoy and learn about the outdoors because of home circumstances, lack of access or transportation or a deficiency of suitable school or community-based programs; and Whereas, the Outdoor School for All Maine Students Program will prepare children in this State for future success, will build self-awareness and confidence and will be an opportunity to instill the importance of the State's natural resources industries by encouraging future generations of farmers, foresters, persons who fish commercially and others working outdoors or as stewards of the State's natural resources; and Whereas, the Outdoor School for All Maine Students Program will begin in school year 2025-2026; and Whereas, in the judgment of the Legislature, these facts create an emergency within the meaning of the Constitution of Maine and require the following legislation as immediately necessary for the preservation of the public peace, health and safety; now, therefore, Signed/Enacted/Adopted
LD789 RESOLUTION, Proposing an Amendment to the Constitution of Maine to Require Legislative Approval of Any State of Emergency Lasting Longer than 60 Days This resolution proposes a constitutional amendment that provides that a state of emergency proclaimed by the Governor may not continue for longer than 60 days and that each subsequent state of emergency must be approved by the Legislature. LD220 An Act to Establish the Hope and Inclusion Scholarship Program in Order to Provide Funding for Students Attending Certain Private Schools and Students Receiving Home Instruction This bill establishes the Hope and Inclusion Scholarship Program administered by the Hope and Inclusion Scholarship Board. The board is directed to establish hope accounts that may be used by the parents or legal guardians of qualified students to pay for the education of those students enrolled in certain private schools and students receiving home instruction. The funding for these hope accounts comes from shifting 90% of the essential programs and services funding that would otherwise be provided by the State and by the school administrative unit for each qualified student into a hope account. The bill specifies which educational expenditures are permitted and provides for review of spending from the accounts. Dead
LD433 An Act Relating to Requirements for School Bus Drivers This bill clarifies the law governing school bus operator endorsements. It provides that the endorsement is contingent on the applicant meeting certain federal requirements only if there is no waiver of those requirements in place. It also clarifies that the requirement that the applicant pass an examination of the person's ability to operate a vehicle of comparable type to a school bus does not include an ability to operate a combination vehicle consisting of a truck tractor and semitrailer. The bill also directs the Secretary of State to seek from the United States Department of Transportation, Federal Motor Carrier Safety Administration a waiver of the engine compartment component of the pre-trip vehicle inspection skills testing requirement in 49 Code of Federal Regulations, Section 383.113(a)(1)(i), known as "the under-the-hood" component, for commercial driver's license applicants seeking the school bus and passenger endorsements, as well as a waiver of the requirement in 49 Code of Federal Regulations, Section 383.133(c)(1) that the State administer this portion of the pre-trip vehicle inspection skills test in accordance with a Federal Motor Carrier Safety Administration pre-approved examiner manual. The Secretary of State may seek additional waivers of requirements that the Secretary of State determines are unnecessary for operation of a school bus in this State. The Secretary of State is directed to report to the Joint Standing Committee on Transportation by December 3, 2025 on the progress in obtaining the waivers, as well as any related changes in federal law or regulations that may be pending or have taken place. LD1603 An Act to Eliminate the Property Tax on Business Equipment With a Value of No More Than $50,000 This bill exempts all business equipment with a value of no more than $50,000 from the personal property tax and prohibits a political subdivision of the State from imposing a tax on such business equipment. The bill applies to property tax years beginning on or after April 1, 2026. LD1228 An Act to Clarify Certain Terms in the Automotive Right to Repair Laws This bill adds and clarifies definitions for terms contained within the automotive right to repair laws enacted by Initiated Bill 2023, chapter 3. The bill reduces the applicability of the automotive right to repair laws to a narrower class of vehicles. Under the bill, motor vehicles subject to the right to repair provisions enacted by Initiated Bill 2023, chapter 3 are self-propelled vehicles, not exclusively operated on railroad tracks, that have a seating capacity of not more than 15 persons, including the operator. The bill specifies that the following types of vehicles are not subject to the provisions enacted by Initiated Bill 2023, chapter 3: vehicles used primarily for commercial purposes; motorcycles; snowmobiles; all-terrain vehicles and motorized wheelchairs, electric personal assistive mobility devices or electric bicycles.
