LD1669 An Act to Establish the Cannabis Advisory Council This bill establishes the Cannabis Advisory Council to make recommendations to the Director of the Office of Cannabis Policy within the Department of Administrative and Financial Services and the joint standing committee of the Legislature having jurisdiction over cannabis matters concerning how best to work with state agencies, municipal governments, the medical use cannabis industry and adult use cannabis industry and citizen groups to make improvements to and maintain the quality of the State's medical use cannabis industry and adult use cannabis industry concerning matters of interest to the State's medical use cannabis industry and adult use cannabis industry, including, but not limited to, changes to the tracking system contract, public health protection and federal legalization. LD1840 An Act to Amend the Maine Medical Use of Cannabis Act This bill makes the following changes to the Maine Medical Use of Cannabis Act. 1. It amends the definition of "caregiver retail store" to clarify that it is a retail store with regular business hours at a location accessible to the general public where a registered caregiver sells cannabis paraphernalia, cannabis plants, harvested cannabis, related supplies or educational materials to qualifying patients without an appointment and other items to the general public. It provides that a caregiver retail store does not include an office at a location not accessible to the general public where a registered caregiver provides consultation services, cannabis paraphernalia, cannabis plants, harvested cannabis, related supplies or educational materials to qualifying patients by appointment. 2. It prohibits the Department of Administrative and Financial Services, except where explicitly authorized or directed by law, from requiring a registered caregiver, registered dispensary, cannabis testing facility or manufacturing facility to use a form issued by the department in complying with the requirements of the Act or of adopted rules and from issuing a guidance document or memorandum to such persons regarding compliance by those persons with the requirements of the Act or of adopted rules. The bill directs the department’s Office of Cannabis Policy to, as expeditiously as possible, rescind and remove from public availability any noncompliant forms and guidance documents or memoranda. 3. It repeals the provision of law that authorizes a caregiver to receive reasonable monetary compensation for costs associated with cultivating cannabis plants or assisting a qualifying patient with that patient's medical use of cannabis. 4. It provides that a caregiver is authorized to transport, sell, offer to sell or furnish cannabis plants or harvested cannabis on the property or premises owned, leased or rented by the caregiver; at trade shows, festivals or other cannabis industry-related events; or through delivery to or private arrangement with a qualifying patient, caregiver or registered dispensary. 5. It removes the process under the Act by which a person that is not a qualifying patient, registered caregiver, registered dispensary or manufacturing facility may receive authorization from the department to engage in cannabis extraction using an inherently hazardous substance and prohibits such cannabis extraction other than by qualifying patients, registered caregivers, registered dispensaries or manufacturing facilities. A qualifying patient, registered caregiver, registered dispensary or manufacturing facility that engages in cannabis extraction using an inherently hazardous substance must comply with any rules regarding that activity adopted by the department by rule but is not required to obtain additional approvals or authorizations from the department to do so. 6. It prohibits the department from posting on its publicly accessible website or otherwise making publicly available, except upon request, applications, supporting information and other nonconfidential information regarding a registered caregiver, including any address where the registered caregiver cultivates, manufactures, tests, packages, stores or sells cannabis plants or harvested cannabis under this chapter. The bill directs the office to, as expeditiously as possible, remove from the office's website and otherwise from public availability, except upon request, any such nonconfidential information regarding registered caregivers. 7. It prohibits the department from requiring a caregiver retail store, registered dispensary, cannabis testing facility or manufacturing facility to use a form provided by the department to demonstrate municipal approval or other local authorization, if such approval or authorization is required by the municipality in which the store, dispensary or facility is seeking to operate. 8. It provides that a caregiver retail store, registered dispensary, cannabis testing facility or manufacturing facility that was previously issued by the department a registration or other authorization to operate and was subsequently denied such registration or other authorization based solely on the failure of the store, dispensary or facility to obtain a completed form provided by the department to demonstrate municipal approval or other local authorization, or based solely on the failure of the municipality to adopt or amend an ordinance or approve a warrant article as required by law, is deemed in compliance with applicable municipal approval or local authorization requirements under the Act. A caregiver retail store, registered dispensary, cannabis testing facility or manufacturing facility deemed in compliance with applicable municipal approval or local authorization requirements pursuant to this provision may request and the department shall issue a registration or other authorization to renew operations, provided that: the store, dispensary or facility is to be located in the same municipality in which it was located when last issued a registration or other authorization to operate by the department; and the store, dispensary or facility satisfies all other applicable registration or authorization requirements pursuant to the Act and adopted rules, excluding any such requirements relating to municipal approval or local authorization and any such requirements that the store, dispensary or facility maintain continuous operation since it was last issued a registration or other authorization to operate by the department. 9. It provides that the Department of Administrative and Financial Services, in its annual report to the Legislature regarding the medical cannabis program, must include information regarding the gross sales of cannabis for medical use for the current and prior fiscal years. 10. It directs the Department of Administrative and Financial Services, Office of Cannabis Policy, on or before January 9, 2026, to provisionally adopt and submit for legislative review major substantive rules necessary to implement the medical cannabis research grant program in accordance with the Maine Revised Statutes, Title 22, section 2430, subsection 5. LD1897 An Act Regarding Outdoor Cultivation in the Medical Use Cannabis and Adult Use Cannabis Industries This bill amends the Maine Medical Use of Cannabis Act and the Cannabis Legalization Act by: 1. Defining "sun-grown cultivators" under the medical use cannabis provisions and "sun-grown cultivation" under the adult use cannabis provisions; 2. Increasing the number of cannabis plants and expanding the area of canopy of cannabis plants that a medical use caregiver who is a sun-grown cultivator and who registers based on annual plant count or canopy may cultivate. The bill establishes a registration fee for such caregivers; 3. Creating requirements for the outdoor cultivation of cannabis for medical use; 4. Allowing medical use caregiver assistants and contractors, employees and other support staff of adult use cannabis licensees a 30-day grace period to assist, work or perform services after submitting an application for an individual identification card; 5. Repealing the prohibition on cannabis collectives under the medical use of cannabis provisions; and 6. Repealing the mandatory testing requirement for yeast and mold for adult use cannabis and cannabis products. Passed
LD1141 An Act to Increase the Procurement of Maine Foods by Certain State Institutions This bill clarifies existing state policy governing food procurement by state institutions to require rather than encourage the procurement of Maine foods and food products by state institutions. The bill requires the Commissioner of Agriculture, Conservation and Forestry to implement and promote a Maine foods and food products procurement program that consolidates food commodity purchases by centralizing the control and purchase of food to stabilize state institution food budgets. The program must allow state institutions to take advantage of opportunity buying, coordinate dietary requirements and establish healthy menus consistently throughout state institutions. The bill creates a definition for "opportunity buying," which is defined as the purchasing of food and food products from vendors at a significant discount that is only available for a short period of time before the food or food products become unavailable for purchase. The bill also requires that the program measurably improve the quality and reduce the cost of food and food products for state institutions. Current law requires the Commissioner of Agriculture, Conservation and Forestry to establish a Maine foods and food products procurement program with the goal that 20% of food procured by state institutions is Maine food and food products. The bill adjusts the program goal with a requirement that, by 2030, that percentage must be 30%. The bill also requires the commissioner to designate an employee of the department as an institutional food procurement coordinator to coordinate food procurement for all state institutions and to implement and oversee a strategy to strengthen connections between Maine food producers, distributors and other institutional stakeholders outside of State Government to achieve the procurement goal established. The bill gives permission for the State to engage in off-contract purchasing, outlines requirements for the convening of an annual meeting and an advisory committee to assist the coordinator in advancing strategies for increasing purchases of Maine foods and food products by state institutions and requires the inclusion of the progress toward the procurement goal in the commissioner's biennial report. LD948 An Act to Reduce Administrative Burdens and Expand Access in the Laws Governing Cannabis This bill increases the current limit under the medical cannabis laws to allow a caregiver to cultivate up to 60 mature cannabis plants, up to 120 immature cannabis plants, up to 1,000 square feet of mature plant canopy and up to 2,000 square feet of immature plant canopy. The bill also amends the medical cannabis and adult use cannabis laws to extend registration and license periods from one year to 2 and updates the license renewal process for registrants and licensees without any violations of those laws in the previous year to require only the payment of the license fee or registration fee to the Department of Administrative and Financial Services, Office of Cannabis Policy for a new active license to be issued. LD1009 An Act to Restore Full Civil Rights to Possess Firearms to Persons Previously Convicted of Certain Nonviolent Felony Crimes Currently, persons who have been convicted of committing or found not criminally responsible by reason of insanity of committing a crime in this State, a crime under the laws of the United States and certain crimes in other jurisdictions that are punishable by a term of imprisonment of one year or more are prohibited from owning, possessing or having under their control a firearm. This bill restores the right for some of these convicted persons to own, possess and have a firearm under their control, setting certain eligibility requirements a person must meet to have their civil rights relating to firearms restored, including a requirement that 10 years have passed since the completion of any sentence imposed on them. Eligibility for restoration of firearm rights is excluded for certain enumerated categories of crimes, including murder; any Class A crime; any Class B or C crime in violation of the Maine Revised Statutes, Title 17-A, chapter 9, 11, 12, 13, 33 or 45; robbery; assault on an officer; assault on an emergency medical services person; assault on a firefighter; aggravated sex trafficking; and sex trafficking. The bill also outlines the procedure for applying for a restoration of civil rights. A person meeting the eligibility requirements may submit a request to the Department of Public Safety to have that person's firearm rights restored. Upon receipt of a request, the department must conduct a review of the person's criminal history to ensure the person is eligible. Upon a determination that the person is eligible, the department must notify the court having jurisdiction over the crime on which the person's firearm prohibition is based, and that court must issue an order restoring the person's rights. The bill also stipulates that, in the event a person who has had the person's civil rights restored is subsequently convicted of any felony crime, defined as a crime punishable by a sentence of imprisonment of one year or more in Maine or any other jurisdiction, that person's restored rights are revoked and the person is ineligible from qualifying for a restoration of that person's rights in the future. In this occurrence, the court that issued the order restoring the person's civil rights to own, possess and have under the person's control a firearm must revoke that order. In Committee

The bill also directs the commissioner to require, rather than authorize as in current law, inspection to continue at such an establishment on state holidays or beyond the regular work shift or workweek for state inspectors as long as the necessary inspectors are available and the establishment pays all overtime salaries for inspections necessary to keep the plant open and other expenses caused by the overtime employment. LD195 An Act to Create the Small Business Capital Savings Account Program This bill establishes the Small Business Capital Savings Account Program in the Department of Economic and Community Development to certify small businesses engaged in commercial agricultural production, commercial fishing or commercial wood harvesting eligible to claim a tax deduction for contributions made to qualifying small business capital savings accounts to be used for capital expenditures. The bill creates the tax deduction and establishes that withdrawals from the savings accounts are taxable income if not used for capital expenditures. Contributions may be made beginning January 1, 2026 but may not be made after December 31, 2029. Passed
LD191 An Act to Support Maine Businesses by Establishing a Pass-through Entity Tax and Tax Credit This bill establishes, for tax years beginning on or after January 1, 2025, a pass-through entity tax on the income of partners and shareholders of S corporations to permit certain entities to elect to pay Maine income tax at the entity level. The effect of this is to allow a member of a pass-through entity a credit of 90% of the member's share of Maine income taxes paid as a pass-through entity. In Committee

LD137 An Act to Expand the 1998 Special Retirement Plan to Include Employees Who Work for the Office of Chief Medical Examiner This bill provides that the 1998 Special Retirement Plan of the Maine Public Employees Retirement System applies to employees in the employment of the Office of Chief Medical Examiner within the Department of the Attorney General. Under that plan, a person may retire at 55 years of age with 10 years of creditable service or may retire before 55 years of age with 25 years of creditable service. It also provides that the service retirement benefit for an employee in the office must be computed on the basis of all of the member's creditable service, regardless of when that service was earned. LD169 Resolve, Establishing the Commission to Study MaineCare Estate Recovery This bill requires the Department of Health and Human Services to return the state portion of estate recovery under the MaineCare program to the estate. This requirement does not impact the portion that is required to be paid to the Federal Government for estate recovery for Medicaid. The bill requires the department to amend its rules in Chapter 332: MaineCare Eligibility Manual, Part 15, Transfer of Assets, to change the standard for transfer of assets from "clear and convincing evidence" to a "preponderance of evidence." The rule is a major substantive rule. The bill also requires the department to develop educational materials to assist individuals with accessing programs that allow family members or legal guardians to be reimbursed for providing personal care services to a family member who is eligible to receive home and community-based services under the MaineCare program or a state-funded program. LD13 An Act to Provide Funds Necessary for the Production and Delivery of Election Materials by the Secretary of State This bill establishes the Production and Delivery of Election Materials Fund as a nonlapsing, interest-bearing Other Special Revenue Funds account within the Department of the Secretary of State for the purpose of receiving funds from the State to support the costs associated with the production and delivery of election materials. The use of funds from the fund is in addition to any other funds received by the department from the State for that purpose. It also provides for an ongoing transfer to the Production and Delivery of Election Materials Fund from the unappropriated surplus of the General Fund. In 2025 the transfer is $266,000, and the amount must be adjusted for the cost of living every 2 years. Additionally, it provides for any remaining balances in the Department of Secretary of State, Bureau of Corporations, Elections and Commissions program, General Fund account at the end of each fiscal year to be transferred to the Production and Delivery of Election Materials Fund. The bill also reconvenes a working group to study polling places at schools in order to protect the security of school students and staff, election staff and voters and to consider polling place accessibility. LD1814 An Act to Increase Transparency in State Government by Amending Laws Regarding Persons Attempting to Influence the Competitive Bidding Process and Lobbyist Reporting During Rule-making Processes This bill requires any person who is specifically employed by another person for the purpose of attempting to influence the competitive bidding process to register with the Commission on Governmental Ethics and Election Practices for each employer and to submit monthly reports regarding activity, expenditures and compensation associated with attempting to influence any order, grant or contract on behalf of that employer. The bill requires the commission to create and maintain a publicly accessible website that displays this information to the public. It also expands the definition of "lobbying" and "grassroots lobbying" to include communicating directly with any official in the executive branch for the purpose of influencing any rulemaking. It requires a lobbyist or lobbyist associate who provides public comment on a proposed agency rule to disclose to the agency the name of the person or organization that lobbyist or lobbyist associate is representing in the same manner as when testifying before a joint select or joint standing committee of the Legislature. LD1737 An Act to Ensure the Future of Maine's Sporting Camp Heritage This bill establishes a separate license for a commercial sporting camp that is different than the existing license for a recreational camp or sporting camp. The bill defines "commercial sporting camp." Under the provisions of the bill, the Department of Health and Human Services may not require a commercial sporting camp located in an area without a municipal water supply to install sprinkler systems or to make upgrades or improvements to existing plumbing systems or septic systems as long as those plumbing and septic systems are operational. The department may not require an applicant for a license to demonstrate compliance with any other state laws except for compliance with the licensing requirements. The bill provides that a commercial sporting camp must qualify to serve meals and may not be prohibited from serving or catering meals to the general public if the camp meets the requirements of a Class A restaurant. LD1649 Resolve, to Establish the Commission to Study and Recommend Solutions for Modernizing and Improving the Effectiveness of the Legislature This resolve establishes the Blue Ribbon Commission to Study the Operations of the Legislature. The commission consists of 12 members, including 4 Legislators and 8 members of the public who have expertise in public policy, government relations, private business and organized labor. It establishes the African American Studies Advisory Council to serve as a resource to educators, schools and the Department of Education to ensure the implementation of African American studies in accordance with the Maine Revised Statutes, Title 20-A, section 4706. Appointments to the advisory council must be made within 30 days of the effective date of the legislation by the appointing authorities. The duties of the advisory council include: A. Assisting school administrative units and educators in the exploration of a wide range of educational materials and resources relating to African American studies; B. Identifying materials and resources for implementing African American studies; C. Making recommendations to the Department of Education regarding African American studies curricula, revisions to the system of learning results, funding and opportunities for professional development, training and technical assistance; and D. Using data gathered pursuant to the representative statewide sampling conducted by the Department of Education of African American studies curricula in school administrative units to establish a baseline measure of the implementation of African American studies in school administrative units. The advisory council is directed to submit an annual report to the joint standing committee of the Legislature having jurisdiction over education matters beginning January 15, 2027. 2. It directs the Department of Education to develop professional development opportunities for educators in African American studies. 3. It directs the State Board of Education to convene a stakeholder group to study the development of an endorsement in African American studies on an educator credential or the inclusion of a requirement for an African American studies course as a requirement for an educator credential in this State and report to the Joint Standing Committee on Education and Cultural Affairs no later than January 15, 2026. 4. It provides an appropriations and allocations section to: A. Establish in the Department of Education a content specialist position in African American studies and to provide outreach to school administrative units with support and technical assistance in curriculum development and implementation of African American studies; and B. Provide $1,000,000 in one-time, nonlapsing funds in fiscal year 2025-26 to the Department of Education to support the work of the African American Studies Advisory Council and administer and provide grants to school administrative units to expand or implement African American studies curricula. Funds must be used to augment the salaries of state employees to provide parity between the salaries of state employees and the salaries of comparable positions in the public and private sectors as determined by a market pay study. Unexpended balances in the fund at the end of the fiscal year do not lapse and are carried forward to the next fiscal year. "State employees," as used in the bill, refers to employees of the executive branch. LD1672 An Act to Allow Participation in the Adult Use Cannabis Tracking System to Be Voluntary This bill amends the Cannabis Legalization Act to provide that a cannabis establishment licensee may voluntarily elect, but is not required, to use the tracking system for adult use cannabis and adult use cannabis products implemented and administered by the Department of Administrative and Financial Services, Office of Cannabis Policy. The office is directed to adopt major substantive rules regarding minimum inventory control system and other requirements that must be satisfied by a licensee that does not voluntarily elect to use that tracking system implemented and administered by the office. The bill also prohibits the office from renewing, extending, negotiating or entering into any contract or other agreement with a 3rd-party entity for the administration of, or otherwise relating to, the tracking system for adult use cannabis and adult use cannabis products. The office is directed to, as expeditiously as possible, take all reasonable steps to cancel or terminate any such existing contracts or agreements with 3rd-party entities, subject to the terms, conditions and other limitations of those contracts or agreements. By June 30, 2026, the Department of Administrative and Financial Services is required to transfer to the Department of Defense, Veterans and Emergency Management, Bureau of Veterans' Services, Maine Veterans' Homes Stabilization Fund, established in the Maine Revised Statutes, Title 37-B, section 613, all funds in its possession allocated or otherwise dedicated to the administration of, or otherwise relating to, the tracking system for adult use cannabis and adult use cannabis products. LD738 An Act to Remove Barriers to Becoming a Lawyer by Establishing a Law Office Study Program This bill creates additional opportunities for individuals to qualify to take the examination for admission to the bar. Under the bill, an applicant for admission to the bar who has studied law for 4 years in a law office study program under the supervision of a judge or attorney who is a member of the bar in good standing need not attend law school prior to taking the bar examination. During the 4-year period, the applicant must pursue a systematic course of legal study designed to prepare the applicant for the general practice of law that must include, at a minimum, each of the subjects tested on the bar examination. An applicant may receive credit for up to 2 of the 4 required years of legal study based on the applicant's study of law at an accredited law school in this country, study of law at an equivalent foreign law school, legal study in a foreign jurisdiction that led to the admission of the applicant to practice law before a court of general jurisdiction within that jurisdiction or legal study in compliance with the requirements of a law office study program in another state. The bill requires that an applicant who is determined by the board of bar examiners to be otherwise eligible through a law office study program to take the examination for admission to the bar must pay a fee fixed by the Supreme Judicial Court before the applicant is determined eligible to take the examination. The bill requires the board, by January 1, 2026, to create and make available forms for applicants to submit required reports and notices to the board to be eligible to take the examination for admission to the bar through a law office study program. If the board fails to make these forms available by the deadline, then applicants may submit those reports and notices in any reasonable form or format as long as the reports and notices otherwise conform with the law. The bill establishes reporting and record retention requirements for direct shippers, fulfillment providers and common carriers. The bill establishes shipment restrictions and limitations for direct shippers of spirits and procedures for establishing spirits pricing and for payments to the bureau for spirits shipped directly to recipients in the State, rather than going through the State's warehouse. This bill removes the requirement that the department establish the criteria for compensation and instead requires a compensation fee equal to the average value of the undeveloped land occupied by the renewable energy development project, with certain exceptions. The bill also specifies which wildlife habitats the department may consider for purposes of determining an adverse effect. The bill would ensure due process for a recipient of a no trespass order from a State Government entity that prohibits the recipient of the order from accessing certain state properties. 1. The legislation is limited to state properties where the public accesses state services and where the public has a reasonable expectation of entry. 2. The no trespass order must include a reason for the order that is available to the recipient of the order upon request of the recipient of the order. 3. The allowable reasons to serve such a no trespass order are harassment of the State Government entity as defined in the Maine Revised Statutes, Title 5, section 4651, subsection 2 or a refusal to leave the state property upon request 3 or more times in a one- month period. 4. The recipient of the no trespass order may contest the order within 14 days of the receipt of the order. 5. The court must set a date for return within 7 days of the recipient's contesting the order. 6. In a court proceeding on the issuance of such a no trespass order, the court must use the procedure as described for the issuance of a protection from abuse order under Title 19-A, chapter 103 and ensure that a defendant in a proceeding on the issuance of a no trespass order receives the same due process protections as a defendant in a proceeding on the issuance of a protection from abuse order. The bill requires that an acquisition or grant made pursuant to the program is subject to the requirement that the recreational trail on the property may not be altered or developed in a manner that precludes its existing use, including use by a snowmobile or by an ATV, if applicable. The bill also requires that any change to the access or layout of a recreational trail protected pursuant to the program must be approved by the snowmobile club, ATV club or another club or group that maintains the recreational trail.
