HB1007 Energy generation resources. Energy generation resources. Provides a credit against state tax liability for expenses incurred in the manufacture of a small modular nuclear reactor (SMR) in Indiana. Establishes procedures under which certain energy utilities may request approval for one or more of the following from the Indiana utility regulatory commission (IURC): (1) An expedited generation resource plan (EGR plan) to meet customer load growth that exceeds a specified threshold. (2) A generation resource submittal for the acquisition of a specific generation resource in accordance with an approved EGR plan. (3) A project to serve one or more large load customers. Sets forth: (1) the requirements for approval of each of these types of requests; (2) standards for financial assurances by large load customers; and (3) cost recovery mechanisms for certain acquisition costs or project costs incurred by energy utilities. Amends the statute concerning public utilities' annual electric resource planning reports to the IURC to provide that for an annual report submitted after December 31, 2025, a public utility must include information as to the amount of generating resource capacity or energy that the public utility plans to retire or refuel with respect to any electric generation resource of at least 125 megawatts. Provides that for any planned retirement or refueling, the public utility must include, along with other specified information, information as to the public utility's plans with respect to the following: (1) For a retirement, the amount of replacement capacity identified to provide approximately the same accredited capacity within the appropriate regional transmission organization (RTO) as the capacity of the facility to be retired. (2) For a refueling, the extent to which the refueling will maintain or increase the current generating resource accredited capacity or energy that the electric generating facility provides, so as to provide approximately the same accredited capacity within the appropriate RTO. Requires IURC staff to prepare a staff report for each public utility report that includes a planned electric generation resource retirement. Provides that if, after reviewing a public utility's report and any related staff report, the IURC is not satisfied that the public utility can satisfy both its planning reserve margin requirement and the statute's prescribed reliability adequacy metrics, the IURC shall conduct an investigation into the reasons for the public utility's inability to meet these requirements. Provides that if the public utility's report indicates that the public utility plans to retire an electric generating facility within one year of the date of the report, the IURC must conduct such an investigation. Provides that: (1) a public utility may request, not earlier than three years before the planned retirement date of an electric generation facility, that the IURC conduct an investigation into the planned retirement; and (2) if the IURC conducts an investigation at the request of the public utility within that three year period, the IURC may not conduct a subsequent investigation that would otherwise be required under the bill's provisions unless the IURC is not satisfied that the public utility can satisfy both its planning reserve margin requirement and the statutory reliability adequacy metrics as of the time the investigation would otherwise be required. Provides that if a CPCN is granted by the IURC for a facility intended to repower or replace a generation unit that is planned for retirement, and the CPCN includes findings that the project will result in at least equivalent accredited capacity and will provide economic benefit to ratepayers as compared to the continued operation of the generating unit to be retired, the CPCN constitutes approval by the IURC for purposes of an investigation that would otherwise be required. Provides that if, after an investigation, the IURC determines that the capacity resources available to the public utility will not be adequate to allow the public utility to satisfy both its planning reserve margin requirements and the statute's prescribed reliability adequacy metrics, the IURC shall issue an order: (1) directing the public utility to acquire or construct; or (2) prohibiting the retirement or refueling of; such capacity resources that are reasonable and necessary to enable the public utility to meet these requirements. Provides that if the IURC does not issue an order in an investigation within 120 days after the initiation of the investigation, the public utility is considered to be able to satisfy both its planning reserve margin requirement and the statutory reliability adequacy metrics with respect to the retirement of the facility under investigation. Provides that if the IURC issues an order to prohibit the retirement or refueling of an electric generation resource, the IURC shall create a sub-docket to authorize the public utility to recover in rates the costs of the continued operation of the electric generation resource proposed to be retired or refueled, subject to a finding by the IURC that the continued costs of operation are just and reasonable. Provides the fee for a cigar certificate is $1,000 and has a term of three years. Requires the holder to give written notice to the alcohol and tobacco commission (commission) of the date and location of the function or event where the holder proposes to sell cigars. Provides that the commission's approval of the location does not authorize smoking in violation of: (1) state laws prohibiting smoking in public places; or (2) any county, city, or town smoking ordinance. Provides that for a supervised loan that is made under the Uniform Consumer Credit Code (UCCC) and that: (1) is entered into after June 30, 2025; (2) is not secured by an interest in land or by personal property used or expected to be used as the debtor's principal dwelling; and (3) has a principal amount that does not exceed $5,000; a lender may contract for and receive, in addition to the loan finance charge and any other permitted charges and fees, a monthly service fee that is based on the amount of principal originally contracted for, and must report the borrower's payments on the supervised loan to at least one consumer reporting agency that compiles and maintains files on consumers on a nationwide basis (as defined in 15 U.S.C. 1681a(p)) in accordance with the federal Fair Credit Reporting Act (15 U.S.C. 1681 et seq.). Provides that for a supervised loan that: (1) is entered into after June 30, 2025; (2) is not secured by an interest in land or by personal property used or expected to be used as the debtor's principal dwelling; (3) has a principal amount that is more than $5,000 but does not exceed $25,000; and (4) is for a term of at least six months; a lender may contract for and receive a loan finance charge not exceeding 36% per year on the unpaid balances of the principal. For a supervised loan that qualifies for the flat 36% annual finance charge (instead of the blended loan finance charge that applies to all other supervised loans), requires the lender to: (1) report the borrower's payments on the loan to at least one nationwide consumer reporting agency; and (2) offer to the borrower, at or before the consummation of the loan and at no cost to the borrower, a consumer credit education program provided by the lender or a third party provider. Provides that, based on information contained in annual composite reports filed with the department of financial institutions (department) by creditors required to be licensed under the UCCC, the department shall publish annually on the department's website a report that contains specified information concerning supervised loans made after June 30, 2025, by nondepository licensees during the reporting period covered by the composite reports. Provides that the expenditure allowance does not apply to any transfer of property tax proceeds to a school corporation, an accredited or nonaccredited public or private school, or a charter school. Prohibits a redevelopment commission from adopting an amendment to a declaratory resolution that contains an allocation area provision that extends the expiration date of the allocation area provision. Provides that after the expiration of a previous allocation area provision, a redevelopment commission may adopt a declaratory resolution, or an amendment to a declaratory resolution, that contains a new allocation area provision with a new expiration date, and for which the county auditor in which the unit is located shall compute the base assessed value for the allocation area using the assessment date immediately preceding the effective date of the new allocation provision of the declaratory resolution or amendment. Allows a redevelopment commission to, pursuant to the approval of the local legislative body, create an account for a specific infrastructure purpose. Requires a redevelopment commission to provide to the unit's executive and fiscal body an analysis of revenues and expenditures on a per allocation basis and correlate the analysis with the required spending plan. Provides that in jurisdictions where a redevelopment commission has not returned any amount of assessed value in the preceding three years, the redevelopment commission must identify relief measures that could be implemented to alleviate taxpayer burdens. Exempts jurisdictions where the excess assessed value determined by a redevelopment commission is expected to generate less than 200% of the amount of allocated tax proceeds necessary to make, when due, principal and interest payments on certain bonds plus the amount for certain other purposes. Requires a redevelopment commission to report its findings in its annual report. Requires a redevelopment commission to include an invitation to overlapping taxing units to participate in the hearing regarding the redevelopment project. Requires the redevelopment commission to include a record of overlapping taxing unit attendance in its annual report to the department of local government finance. Provides that the adoption of a declaratory resolution and subsequent legislative body approval are not required if the expenditures for purposes related to a redevelopment project that is located outside the boundaries of the allocation area are for: (1) infrastructure; (2) utilities; (3) drainage; or (4) environmental remediation. Enumerates permissible infrastructure maintenance expenditures. Provides that a redevelopment commission may use its discretion, where excess assessed value amounts are not already explicitly set aside for use within the current calendar year for a purpose under a current development plan, to allocate excess assessed value amounts to the respective taxing units rather than reserving those excess assessed value amounts for future or indefinite purposes. Provides that, with regard to the prohibition of a redevelopment commission adopting an amendment to a declaratory judgment that contains an allocation area provision that extends the expiration date of the allocation area provision, a redevelopment commission is not prevented from removing parcels from an existing allocation area before its expiration date or adding parcels to a new allocation area. Prohibits a financial services provider from discriminating in providing financial services to a consumer by using a social credit score as a basis for directly or indirectly: (1) declining to provide to the consumer full and equal access to one or more financial services; or (2) providing the consumer with one or more financial services on less favorable terms and conditions than would otherwise apply to the consumer if a social credit score were not used. Defines "social credit score" for purposes of these provisions. Specifies that the term does not include an analysis that involves a financial services provider's evaluation of any quantifiable risks of a consumer's participation in certain business activities or business associations, if the analysis is based on impartial, financial risk based standards that are: (1) established in advance; and (2) publicly disclosed to customers and potential customers; by the financial services provider. Provides that if a financial services provider refuses to provide, terminates, or restricts one or more financial services with respect to a consumer, the consumer may request from the financial services provider a statement of the specific reasons constituting the basis for the refusal, termination, or restriction. Provides that a financial services provider that receives such a request shall transmit to the consumer a written statement setting forth the specific reasons constituting the basis for the refusal, termination, or restriction. Sets forth requirements regarding the: (1) content of; and (2) means and time frame for submitting; a request or statement under these provisions. Provides that a violation of these provisions constitutes a deceptive act that is actionable under the deceptive consumer sales act only by the attorney general. Provides that the work product of a civilian cyber corps volunteer or advisor, including any information voluntarily submitted to the volunteer or advisor, is exempt from disclosure. Provides that a civilian cyber corps volunteer or advisor is immune from tort liability for an injury to a person or damage to property that occurs while the volunteer or advisor is deployed and acting on behalf of the adjutant general if certain conditions are met.
