It prohibits a health care plan from requiring the renewal of a prior authorization more frequently than once every 5 years for treatment that is necessary for more than one year. It also prohibits a health care plan from restricting coverage for a health care service or a prescription that was approved under a previous health care plan within 90 days of enrollment in the new health care plan and requires a health care plan to provide at least 90 days' notice to an enrollee prior to restricting coverage of a previously approved health care service. LD1640 An Act to Implement the Recommendations of the Gagetown Harmful Chemical Study Commission and to Reestablish the Gagetown Harmful Chemical Study Commission This bill establishes the Base Gagetown Training Registry within the Department of Defense, Veterans and Emergency Management, Maine Bureau of Veterans' Services to collect and maintain data related to military service and health conditions from individuals who voluntarily provide such data and who have trained at the Canadian military support base in Gagetown, New Brunswick. The bill also reestablishes the Gagetown Harmful Chemical Study Commission and requires the study commission to request certain information it determines necessary from the United States Department of Defense and other federal agencies to provide medical testing for individuals identified through information received pursuant to the requests as necessary to complete its study. LD1263 An Act Regarding Penalties for Fentanyl Trafficking When That Trafficking Results in an Overdose Causing Serious Bodily Injury of a Person This bill creates a Class A crime of aggravated trafficking in a scheduled drug for when serious bodily injury of another person resulting from an overdose is caused by the use of fentanyl powder and the fentanyl powder trafficked by the defendant is a contributing factor of the serious bodily injury resulting from the overdose. LD1838 An Act to Provide Opportunities and Sustainable Revenue for Maine Farms, Agricultural Fairs, Wabanaki Tribes and Veterans' Homes This bill authorizes the licensed operation of electronic wagering terminals to place wagers on historical horse races, purchase virtual sealed tickets and to conduct electronic beano by federally recognized Indian tribes, certain off-track betting facilities and commercial tracks and organizations eligible to conduct certain games of chance. Licenses are issued by the director of the Gambling Control Unit within the Department of Public Safety. The bill also requires distributors of electronic wagering terminals to be licensed with the Gambling Control Unit. The bill establishes limits on the number and location of terminals based upon the type of licensee. The bill requires an operator of an electronic wagering terminal to collect 25% of net terminal income for distribution among the General Fund for administrative expenses of the Gambling Control Unit; gambling addiction prevention and treatment services; the Maine Milk Pool until January 1, 2035 and, on or after January 1, 2035, to the Agricultural Development Fund; agricultural fairs; funds dedicated to supporting and promoting harness racing; career and technical education; the Maine Veterans' Homes Stabilization Fund; and municipalities in which terminals are located. LD913 An Act to Prohibit Ticket Sellers from Prohibiting the Transfer of Tickets to Third Parties This bill prohibits a seller of a ticket to an entertainment event from prohibiting the purchaser from transferring the ticket with or without consideration to a 3rd party, requires the seller to offer the option of a transferable ticket if the ticketing system does not allow for a ticket to be transferred and prohibits a person from denying a ticket holder admission to an entertainment event solely because the ticket has been resold. This bill does not apply to tickets sold to students for events at public institutions of higher education or to places of entertainment with a seating capacity of 3,500 or less if the place of entertainment provides written notice to the Commissioner of Administrative and Financial Services. LD1012 An Act to Fund the Operations of the University of Maine Cooperative Extension Tick Laboratory This bill establishes the University of Maine Cooperative Extension Tick Laboratory Operations Fund and directs the State Liquor and Lottery Commission to develop and initiate a $4 instant lottery game to raise funds for the fund. The commission is required to submit a report by December 15, 2028 detailing the status of the instant lottery game to the joint standing committee of the Legislature having jurisdiction over lottery matters, which may report out legislation related to the report to the 134th Legislature in 2029. LD38 An Act Requiring Photographic Identification for Voting This bill requires the presentation of proof of identity in the form of a photograph identification document when voting in person. Acceptable forms of photograph identification are a current and valid driver's license or nondriver identification card issued in this State, a United States passport, a military identification or a permit to carry a concealed handgun issued in this State if that permit includes a photograph. An identification issued by a college or university may not be accepted for voter identification. The bill also allows a person who does not possess a photograph identification document to request a free special voter photograph identification card from the Secretary of State. Dead
LD924 Resolve, Directing the Judicial Branch to Authorize the Lease of a Courthouse That Meets Accessibility and Functional Needs in the Town of Newport This resolve directs the judicial branch to enter into a long-term lease agreement for a new courthouse facility in Newport. The leased facility must comply with the federal Americans with Disabilities Act of 1990 and the public accommodations provisions of the Maine Human Rights Act and include adequate space for courtroom operations. The resolve requires the judicial branch to dedicate up to $200,000 from the judicial branch's existing resources for maintenance and repair. Finally, the resolve directs the judicial branch to report to the Joint Standing Committee on Judiciary no later than December 31, 2025 with information on the judicial branch's progress in securing the lease agreement. LD921 An Act to Expand Use of Electronic Proceedings in the Judicial Branch This bill requires that certain categories of hearings and other judicial proceedings in the District Court, Superior Court and Supreme Judicial Court be conducted by electronic means absent a finding that conducting the proceeding by electronic means is inappropriate because it would result in a deprivation of due process, fairness or justice. This requirement does not apply to criminal trials or to civil jury trials requiring the presentation of evidence absent the approval of the court and consent of each party to the proceeding. The bill also requires the court to provide reasonable accommodations to individuals with limited access to the technology required to participate by electronic means as well as individuals with disabilities that limit the individuals' ability to fully participate by electronic means. The bill recognizes the authority of the Supreme Judicial Court to adopt rules and issue orders to implement the provisions of this legislation. It further directs the Supreme Judicial Court to submit an annual report to the joint standing committee of the Legislature having jurisdiction over judiciary matters regarding the conduct of hearings and other judicial proceedings by electronic means in state courts. The bill also requires the Supreme Judicial Court to submit a report by December 3, 2025 to the Joint Standing Committee on Judiciary detailing the provisions rendered of no effect due to the bill's provisions. LD1549 RESOLUTION, Proposing an Amendment to the Constitution of Maine Regarding the Use and Oversight of Transportation-related Revenues This resolution proposes to amend the Constitution of Maine to provide that, beginning July 1, 2027, at least 60% of automobile-related sales and use tax revenue must be transferred to the Highway Fund and must be expended solely for costs of all modes of transportation, including public highways, bridges, aviation, transit, railroads, ferries, ports and other marine infrastructure, trails, pedestrian infrastructure and bicycle facilities and related appurtenances. The resolution also provides that, beginning July 1, 2027, the joint standing committee of the Legislature having jurisdiction over transportation matters has jurisdiction over all financial matters related to the Highway Fund. LD1359 Resolve, to Direct the Department of Transportation to Report Progress Made Toward Implementing Recommendations Based on the 2025 Public Transit Advisory Council Report This resolve directs the Department of Transportation to develop practices regarding public transit, including: 1. Increasing transparency in the allocation and distribution of funding for public transit operators by publishing annual transit distributions in print form and on a publicly accessible website, including the total amount made available for operations and the amounts allocated to each recipient; 2. Reducing the local match requirement for funding rural public transit operators; and 3. Increasing collaboration and coordination with the Department of Health and Human Services to improve public transit services between health care providers and consumers of the health care providers' services. The resolve directs the Department of Transportation, by December 3, 2025, to report on its progress in carrying out this resolve and resulting practices to the Joint Standing Committee on Transportation. LD1903 An Act to Conform the State's Perfluoroalkyl and Polyfluoroalkyl Substances Laws to Federal Standards This bill conforms state standards for certain perfluoroalkyl and polyfluoroalkyl substances, or PFAS, to federal standards in the following ways. 1. It establishes soil concentration levels for PFAS for the purposes of determining when land is contaminated by PFAS under the Fund To Address PFAS Contamination. 2. It amends the law authorizing the adoption of state drinking water rules by the Commissioner of Health and Human Services to require that those rules establish a maximum contaminant level equivalent to the standards of the United States Environmental Protection Agency's national primary drinking water regulations adopted in April 2024 for certain perfluoroalkyl and polyfluoroalkyl substances. 3. It provides that federal law or regulation regulating the sale of a food package to which PFAS have been intentionally added preempts state authority to prohibit the sale of such food packaging. 4. It provides that if surface water quality standards for PFAS are established pursuant to federal law, the Department of Environmental Protection must adopt rules for surface water quality standards to match the federal water quality standards. 5. It provides that if the United States Environmental Protection Agency adopts emissions standards for PFAS, emissions standards for PFAS adopted by the Department of Environmental Protection, Board of Environmental Protection must be the same as the emissions standards established by the United States Environmental Protection Agency. LD868 An Act to Ensure Equity and Safety in Athletics, Restrooms, Changing Rooms and Housing at Elementary, Secondary and Postsecondary Schools This bill requires that interscholastic and intramural athletic teams or sports that are sponsored by public schools, public charter schools, public postsecondary education institutions or schools they compete against be designated as male, female or coed. The bill also prohibits students who are male from participating in an athletic team or sport designated as a female team or sport. The bill requires public schools, public charter schools and public postsecondary education institutions to designate restrooms, changing rooms and sleeping quarters as for use by either only females or only males with limited exceptions. The bill provides that an individual may have a private cause of action against a public school, public charter school, public postsecondary education institution, private school, private postsecondary education institution or athletic association or organization under certain circumstances as a result of a knowing violation of these provisions. LD1737 An Act to Ensure the Future of Maine's Sporting Camp Heritage This bill establishes a separate license for a commercial sporting camp that is different than the existing license for a recreational camp or sporting camp. The bill defines "commercial sporting camp." Under the provisions of the bill, the Department of Health and Human Services may not require a commercial sporting camp located in an area without a municipal water supply to install sprinkler systems or to make upgrades or improvements to existing plumbing systems or septic systems as long as those plumbing and septic systems are operational. The department may not require an applicant for a license to demonstrate compliance with any other state laws except for compliance with the licensing requirements. The bill provides that a commercial sporting camp must qualify to serve meals and may not be prohibited from serving or catering meals to the general public if the camp meets the requirements of a Class A restaurant. The bill also makes a commercial sporting camp eligible for a separate moose permit drawing. In Committee
LD1840 An Act to Amend the Maine Medical Use of Cannabis Act This bill makes the following changes to the Maine Medical Use of Cannabis Act. 1. It amends the definition of "caregiver retail store" to clarify that it is a retail store with regular business hours at a location accessible to the general public where a registered caregiver sells cannabis paraphernalia, cannabis plants, harvested cannabis, related supplies or educational materials to qualifying patients without an appointment and other items to the general public. It provides that a caregiver retail store does not include an office at a location not accessible to the general public where a registered caregiver provides consultation services, cannabis paraphernalia, cannabis plants, harvested cannabis, related supplies or educational materials to qualifying patients by appointment. 2. It prohibits the Department of Administrative and Financial Services, except where explicitly authorized or directed by law, from requiring a registered caregiver, registered dispensary, cannabis testing facility or manufacturing facility to use a form issued by the department in complying with the requirements of the Act or of adopted rules and from issuing a guidance document or memorandum to such persons regarding compliance by those persons with the requirements of the Act or of adopted rules. The bill directs the department’s Office of Cannabis Policy to, as expeditiously as possible, rescind and remove from public availability any noncompliant forms and guidance documents or memoranda. 3. It repeals the provision of law that authorizes a caregiver to receive reasonable monetary compensation for costs associated with cultivating cannabis plants or assisting a qualifying patient with that patient's medical use of cannabis. 4. It provides that a caregiver is authorized to transport, sell, offer to sell or furnish cannabis plants or harvested cannabis on the property or premises owned, leased or rented by the caregiver; at trade shows, festivals or other cannabis industry-related events; or through delivery to or private arrangement with a qualifying patient, caregiver or registered dispensary. 5. It removes the process under the Act by which a person that is not a qualifying patient, registered caregiver, registered dispensary or manufacturing facility may receive authorization from the department to engage in cannabis extraction using an inherently hazardous substance and prohibits such cannabis extraction other than by qualifying patients, registered caregivers, registered dispensaries or manufacturing facilities. A qualifying patient, registered caregiver, registered dispensary or manufacturing facility that engages in cannabis extraction using an inherently hazardous substance must comply with any rules regarding that activity adopted by the department by rule but is not required to obtain additional approvals or authorizations from the department to do so. 6. It prohibits the department from posting on its publicly accessible website or otherwise making publicly available, except upon request, applications, supporting information and other nonconfidential information regarding a registered caregiver, including any address where the registered caregiver cultivates, manufactures, tests, packages, stores or sells cannabis plants or harvested cannabis under this chapter. The bill directs the office to, as expeditiously as possible, remove from the office's website and otherwise from public availability, except upon request, any such nonconfidential information regarding registered caregivers. 7. It prohibits the department from requiring a caregiver retail store, registered dispensary, cannabis testing facility or manufacturing facility to use a form provided by the department to demonstrate municipal approval or other local authorization, if such approval or authorization is required by the municipality in which the store, dispensary or facility is seeking to operate. 8. It provides that a caregiver retail store, registered dispensary, cannabis testing facility or manufacturing facility that was previously issued by the department a registration or other authorization to operate and was subsequently denied such registration or other authorization based solely on the failure of the store, dispensary or facility to obtain a completed form provided by the department to demonstrate municipal approval or other local authorization, or based solely on the failure of the municipality to adopt or amend an ordinance or approve a warrant article as required by law, is deemed in compliance with applicable municipal approval or local authorization requirements under the Act. A caregiver retail store, registered dispensary, cannabis testing facility or manufacturing facility deemed in compliance with applicable municipal approval or local authorization requirements pursuant to this provision may request and the department shall issue a registration or other authorization to renew operations, provided that: the store, dispensary or facility is to be located in the same municipality in which it was located when last issued a registration or other authorization to operate by the department; and the store, dispensary or facility satisfies all other applicable registration or authorization requirements pursuant to the Act and adopted rules, excluding any such requirements relating to municipal approval or local authorization and any such requirements that the store, dispensary or facility maintain continuous operation since it was last issued a registration or other authorization to operate by the department. 9. It provides that the Department of Administrative and Financial Services, in its annual report to the Legislature regarding the medical cannabis program, must include information regarding the gross sales of cannabis for medical use for the current and prior fiscal years. 10. It directs the Department of Administrative and Financial Services, Office of Cannabis Policy, on or before January 9, 2026, to provisionally adopt and submit for legislative review major substantive rules necessary to implement the medical cannabis research grant program in accordance with the Maine Revised Statutes, Title 22, section 2430, subsection 5. LD1210 An Act to Regarding Renewable Electricity Generation by Hydropower Projects This bill amends the laws regulating the Department of Environmental Protection's process for approving or disapproving a permit for a hydropower project and for issuing or denying a water quality certification for a hydropower project as required under the Federal Water Pollution Control Act. It requires the department, in determining whether to approve or deny a permit, or issue or deny a water quality certification, to consider the effect of that approval, disapproval, issuance or denial on the State's renewable energy, decarbonization and economic development policies and goals; the environmental and economic benefits to the State of the hydroelectric generation provided by the project; and, taking those factors into consideration, whether approval of the permit or issuance of the certification for the project is permissible notwithstanding the project's effect on wildlife habitat and aquatic life within the waters affected by the project, including affected waters downstream of the project. LD888 An Act to Expand Property Tax Relief for Veterans and Survivors of Veterans This bill changes the property tax benefits for veterans of the Armed Forces of the United States for property tax years beginning on or after April 1, 2026. The bill provides that veterans are no longer required to have served during a federally recognized war period and receive an exemption of up to $5,000 of the just value of the property. It provides that veterans who are 62 years of age or older receive an exemption of up to $6,000 of the just value of the property. It also provides that veterans receive an exemption of between $10,000 and $50,000 based on their United States Department of Veterans Affairs service- connected disability rating. The bill provides that a veteran's unremarried surviving spouse, minor child or parent remains eligible for the benefit that the veteran would be eligible for if the veteran was living. Passed
LD890 An Act to Permit the Dispensing of Ivermectin Pursuant to a Standing Order upon Request for COVID-19, Flu and Cancer Patients This bill authorizes a pharmacist to dispense ivermectin upon request of a patient pursuant to a standing order from a practitioner acting within the lawful scope of the practitioner's license. The standing order must meet certain conditions, including authorization to dispense ivermectin to a patient for the treatment of COVID-19, influenza or cancer. A pharmacist who acts under a standing order is deemed to be dispensing ivermectin for a legitimate medical purpose in the usual course of the practice of pharmacy. Dead
LD1709 An Act Regarding Antique Automobiles This bill reduces the age that an automobile or truck must be to be considered an antique auto in the motor vehicle laws from 35 years old to 25 years old. This age requirement was increased from 25 years old to 35 years old in Public Law 2023, chapter 634. The bill requires a person registering an antique auto to show proof of registration and insurance for the motor vehicle used as that person's primary mode of transportation of passengers or goods and maintain the registration and insurance for that motor vehicle or a replacement motor vehicle during the term of registration of the antique auto. A person may not operate an antique auto when a motor vehicle used as that person's primary mode of transportation of passengers or goods is not registered and insured. A person who violates this provision commits a civil violation for which a fine of not more than $2,500 may be adjudged and for which the Secretary of State may immediately revoke the registration for the antique auto. LD1804 An Act Concerning Funding and Oversight of Transportation Matters This bill amends the laws related to legislative oversight of transportation funding and use of the funds from the Highway Fund. The bill: 1. Codifies the joint standing committee of the Legislature having jurisdiction over transportation matters as having jurisdiction over the Highway Fund. It updates references to the Highway Fund; 2. Establishes a minimum level of funding for transportation infrastructure programs related to bridges, highway lights and multimodal transportation, and requires the State Budget Officer to adjust the minimum level of funding by the percentage change in the Consumer Price Index each biennium beginning July 1, 2027; 3. Increases, from 40% to 60%, the percentage of automobile-related sales and use taxes transferred to the Highway Fund and adds automobile-related sales and use taxes to the list of revenue that is allocated to and becomes part of the Highway Fund beginning July 1, 2027; 4. Provides for the net revenue from liquor operations to be deposited as undedicated revenue to the General Fund, rather than being split between undedicated revenue to the General Fund and undedicated revenue to the Highway Fund; 5. Provides for state funding for the Department of Public Safety, Bureau of State Police to come solely from the General Fund, rather than being split between the General Fund and the Highway Fund, beginning in fiscal year 2027-28; 6. Removes the Department of Public Safety, Bureau of State Police from the list of allowable uses of the Highway Fund; 7. Adds multimodal transportation to the list of allowable uses of the Highway Fund; 8. Redefines “transportation infrastructure” to mean the infrastructure, assets, facilities and systems related to all modes of transportation, including highways, bridges, aviation, transit, railroads, ferries, ports and other marine infrastructure, trails and bicycle and pedestrian facilities, as well as all buildings, utilities and other appurtenances related to those modes; 9. Removes the designation of project-specific and nonproject-specific procurement and retains the provision that the Department of Transportation has full power to purchase all supplies, materials and equipment that are incidental to, or necessary for, construction, improvement or maintenance of transportation infrastructure; and 10. Requires, beginning March 1, 2026, the Department of Transportation and the Maine Turnpike Authority to submit biennial reports in each even-numbered year, summarizing the procurement activities over the preceding 2 calendar years. LD1814 An Act to Increase Transparency in State Government by Amending Laws Regarding Persons Attempting to Influence the Competitive Bidding Process and Lobbyist Reporting During Rule-making Processes This bill requires any person who is specifically employed by another person for the purpose of attempting to influence the competitive bidding process to register with the Commission on Governmental Ethics and Election Practices for each employer and to submit monthly reports regarding activity, expenditures and compensation associated with attempting to influence any order, grant or contract on behalf of that employer. The bill requires the commission to create and maintain a publicly accessible website that displays this information to the public. It also expands the definition of "lobbying" and "grassroots lobbying" to include communicating directly with any official in the executive branch for the purpose of influencing any rulemaking. It requires a lobbyist or lobbyist associate who provides public comment on a proposed agency rule to disclose to the agency the name of the person or organization that lobbyist or lobbyist associate is representing in the same manner as when testifying before a joint select or joint standing committee of the Legislature. LD1803 An Act to Amend the Laws Governing Optometric Practice This bill amends provisions of the law governing optometrists. The bill provides a more detailed explanation of what constitutes the practice of optometry. The definition of "practice of optometry" in current law does not include surgical procedures. Under the bill, certain types of ophthalmic surgeries are included in the practice of optometry and certain procedures are specifically excluded. An optometrist may only perform ophthalmic surgery if the optometrist meets credentialing requirements established by the State Board of Optometry. The bill also broadens the authority of an optometrist to dispense drugs by expanding the types of drugs an optometrist may dispense to include schedule II narcotics limited to pharmaceuticals containing specified doses of hydrocodone combined with doses of another drug and by removing language that prohibits an optometrist from administering drugs by injection or intravenously. The bill directs the board to adopt rules to further define the scope of practice of optometry and establish credentialing requirements for surgical procedures. The bill clarifies that the board, and no other board or commission in the State, has the authority to define the scope of practice of optometry and to exercise the powers of the board. The bill authorizes the board to issue advisory opinions and declaratory rulings. LD1457 Resolve, to Allow the Maine Turnpike Authority to Conduct a Pilot Program to Implement Automated Speed Control Systems in Highway Work Zones This resolve authorizes the Maine Turnpike Authority to conduct a pilot program to implement up to 3 automated speed control systems at a time in highway work zones on limited access highways in the State for 3 years. The system produces an image of a motor vehicle exceeding the posted speed limit by 11 miles an hour or more in the highway work zone, including the motor vehicle's license plate number, and a notice of violation is sent to the owner of the motor vehicle, who is subject to a warning for a first offense and a fine for a 2nd or subsequent offense. The system is maintained by an operator who is responsible for calibrating the system and certifying that the system is in proper working order. Personally identifiable information of motor vehicle owners and motor vehicles captured by the system is confidential and not a public record under the Freedom of Access Act. In Committee

This bill provides 100% of the exemption amount, regardless of the assessment ratio of the municipality, to an individual who qualifies for the Maine resident homestead property tax exemption and is either at least 65 years of age or a veteran who served in the Armed Forces of the United States. This bill also requires the State to reimburse a municipality for 100% of the revenue lost as a result of this full exemption.
