LD1282 An Act Regarding Eligibility for Historic Preservation Bond Proceeds This bill amends the eligibility requirements for grants through the Maine Historic Preservation Commission for the preservation and restoration of historic properties to allow eligibility for properties that have been designated as historic properties by municipal historic preservation ordinances. The bill also directs the Maine Historic Preservation Commission to adopt rules regarding the disbursement of bond proceeds authorized by Public Law 2023, chapter 653 to establish a process for properties in the State that are not on the National Register of Historic Places but have been designated as historic properties by municipal historic preservation ordinances to receive funding through the bond proceeds. LD1485 An Act to Create a Minimum Standard of Pathology for Children Under 3 Years of Age Who Die of Sudden Infant Death Syndrome or an Unknown Cause This bill provides that if a medical examiner has determined that a child under 3 years of age has died as a result of sudden infant death syndrome or if the medical examiner is unable to determine the cause of death for a child under 3 years of age, the Chief Medical Examiner must, at the request of the child's parent or legal guardian, preserve and retain sufficient tissue samples and other evidence necessary to make a subsequent determination of the cause of death for one year following the date of death of the child. Such evidence must be made accessible to the parent or guardian of the child. Dead
LD1707 An Act to Require a Person to Be a United States Citizen to Receive State or Local Financial Assistance and to Ensure Municipal Compliance with Federal Immigration Laws This bill requires an individual to be a citizen of the United States in order to receive any form of financial assistance from the State or a municipality, except for funding for general purpose aid for education. The bill also provides that a municipality is ineligible to receive municipal general assistance and state-municipal revenue sharing if that municipality prohibits or restricts, formally or informally, the exchange of information with federal immigration authorities or any other federal, state or local government entity regarding the citizenship or immigration status, lawful or unlawful, of any individual or the maintenance of such information. LD1169 An Act Regarding Employer Payments for the Paid Family and Medical Leave Benefits Program Current law allows an employer that has a private plan substantially equivalent to the paid family and medical leave plan established in the Maine Revised Statutes, Title 26, chapter 7, subchapter 6-C and administered by the Department of Labor to apply for and receive approval to not participate in the department's plan. Until approval is given, the employer is responsible for the premiums of 1% of each employee's wages, 50% of which may be paid by the employee. This bill allows an employer whose private plan is approved by the department to request a refund of the premiums paid if that employer had a substantially equivalent private plan in place on or before January 1, 2025, the date that premiums started to be due. The department or administrator, after verifying the amount paid by the employer, is required, within 90 days of receipt of the refund request, to refund the employer the premiums paid, plus interest that accrues to the date the refund payment is issued. The bill also requires the department to make available information regarding the availability of a refund. Dead
LD332 An Act to Establish Mandatory Minimum Sentences for Gross Sexual Assaults Against Children and Aggravated Sex Trafficking of Children This bill provides that if the State pleads and proves that a gross sexual assault was committed against an individual who had not yet attained 12 years of age, the court is required to impose a definite term of imprisonment of not less than 25 years, none of which may be suspended. It also provides that, in the case of a gross sexual assault committed against an individual who had not yet attained 12 years of age when the defendant had previously been convicted and sentenced for committing gross sexual assault, formerly denominated as gross sexual misconduct, or rape against an individual who had not yet attained 12 years of age or that the defendant had previously been convicted and sentenced for engaging in substantially similar conduct in another jurisdiction against an individual who had not yet attained 12 years of age, the court is required to instead impose a term of imprisonment for life. It also provides that, in the case of aggravated sex trafficking for which the State pleads and proves that the defendant knowingly promoted prostitution of a person who had not yet attained 12 years of age, the court is required to set a definite term of imprisonment of not less than 25 years, none of which may be suspended. LD1709 An Act Regarding Antique Automobiles This bill reduces the age that an automobile or truck must be to be considered an antique auto in the motor vehicle laws from 35 years old to 25 years old. This age requirement was increased from 25 years old to 35 years old in Public Law 2023, chapter 634. The bill requires a person registering an antique auto to show proof of registration and insurance for the motor vehicle used as that person's primary mode of transportation of passengers or goods and maintain the registration and insurance for that motor vehicle or a replacement motor vehicle during the term of registration of the antique auto. A person may not operate an antique auto when a motor vehicle used as that person's primary mode of transportation of passengers or goods is not registered and insured. A person who violates this provision commits a civil violation for which a fine of not more than $2,500 may be adjudged and for which the Secretary of State may immediately revoke the registration for the antique auto. LD825 An Act to Prohibit Geoengineering, Including the Use of Cloud Seeding, Weather Modification, Excessive Radio Waves and Microwave Radiation This bill prohibits a person from engaging in any activity that constitutes or involves geoengineering. "Geoengineering" is defined in the bill as any intentional, large-scale intervention in Earth's natural systems and includes stratospheric aerosol injection; weather modification techniques; excessive electromagnetic, radio frequency or microwave radiation emissions; harmful nuclear, biological or chemical emissions; or other polluting atmospheric activity. The Department of Environmental Protection is charged with enforcing the prohibition, and a person that violates the prohibition commits a Class C crime and is subject to a fine of $500,000 for each day the violation continues and any other applicable penalties under the Maine Revised Statutes, Title 38 or other provision of law or rule.
