LD1927 An Act to Add Mold to the Implied Warranty and Covenant of Habitability This bill requires a landlord, upon receipt of a request from a tenant, to inspect a dwelling unit within 24 hours following a leaking event or for visible mold or dampness. The bill also requires a landlord to demonstrate reasonable effort to repair the source of the leak and restore the area within 5 days of inspection. The bill requires a tenant to, after reasonable notice, allow the landlord or the landlord's agent access to the dwelling unit for remediation purposes. Finally, the bill gives remedies and enforcement mechanisms to the landlord and the tenant for noncompliance with the duties given under these provisions. Passed
LD1934 An Act to Promote Responsible Outdoor Lighting This bill requires that outdoor lighting installed or replaced after October 1, 2026 comply with certain standards, including standards established by the American National Standards Institute and the Illuminating Engineering Society, intended to reduce the amount of unnecessary light emitted. The bill includes exemptions for certain types of lighting such as outdoor sports lighting, temporary lighting and required and emergency lighting. The bill directs certain departments to adopt rules to implement the requirements of this bill. The bill also directs each municipality in the State to adopt a local ordinance to promote compliance with the provisions of this bill and allows a municipality to adopt ordinances that are more strict than those required by this bill. LD1764 An Act to Ensure Equitable Staffing Ratios Across the State for Career and Technical Education Programs in Areas with Smaller Student Populations This bill requires a career and technical education center or region to maintain a certain staffing ratio based on the number of students enrolled at the center or region. The bill allows a center or region to adopt a staffing ratio appropriate to the industry standard applicable to the program offered by the center or region, subject to the approval of the Commissioner of Education. The bill also requires a center or region to submit to the Department of Education an annual calculation of the difference between the funding needed to meet the staffing ratio requirements and the funding the center or region received for the previous fiscal year. The bill requires the department to distribute additional available funds to a center or region by November 30th annually to meet the staffing requirements based on the annual calculation submitted by that center or region, giving preference for funding distribution to a center or region with fewer than 1,000 students. LD1365 An Act to Allow Consumption of Adult Use Cannabis in Locally Approved Hospitality Lounges This bill amends the Cannabis Legalization Act to authorize a municipality or other local government entity within the unorganized and deorganized areas of the State to adopt an ordinance providing licensing or other approval requirements applicable to cannabis hospitality lounges within the municipality or unorganized and deorganized area. The bill defines "cannabis hospitality lounge" as a location that is open to members of the public who are 21 years of age or older and is licensed or approved by a municipality or other local government entity within the unorganized and deorganized areas of the State where persons 21 years of age or older may consume adult use cannabis, adult use cannabis products and edible products that do not contain cannabis. A cannabis hospitality lounge is not a cannabis establishment, may operate as a cannabis hospitality lounge without the need for additional state licensing or approvals and is not subject to the oversight of the Department of Administrative and Financial Services, Office of Cannabis Policy. The bill also amends the law prohibiting smoking in public places to allow the smoking of adult use cannabis or adult use cannabis products at a locally licensed or approved cannabis hospitality lounge. LD634 Resolve, to Establish the Commission to Study the Reduction of Unfunded and Outdated Municipal and County Mandates This resolve establishes the Commission to Study the Reduction of Unfunded and Outdated Municipal and County Mandates. The commission is required to meet at least twice a year and may meet up to 4 times a year for 2 years to review unfunded and outdated municipal and county mandates in order to provide recommendations and to report out by December 1, 2027 a list of mandates for the Legislature to consider eliminating or revising. LD755 An Act to Prevent Opioid Overdose Deaths by Allowing Municipalities to Approve the Establishment of Overdose Prevention Centers This bill authorizes municipalities to approve overdose prevention centers at which clients may receive health screening, disease prevention and recovery support services and may self-administer previously obtained controlled substances on the premises. The bill also provides immunity from arrest, prosecution, revocation proceedings or termination proceedings for persons using, employed by or otherwise associated with an overdose prevention center when acting in accordance with the provisions of the bill. It also provides additional protections to such persons for actions in accordance with those provisions. In Committee
LD754 An Act to Ban the Sale, Use and Possession of Single-use Electronic Cigarettes and to Review Extended Producer Responsibility Options for All Batteries This bill prohibits the sale, use and possession of single-use electronic nicotine delivery devices, which include electronic cigarettes, electronic cigars, electronic pipes, electronic hookahs and so-called vape pens. The bill establishes penalties for such sale, use and possession that are similar to the penalties for the sale of nicotine liquid containers that are not child resistant. The bill also directs the Department of Environmental Protection to convene a stakeholder group of interested parties to review the feasibility and viability of establishing an extended producer responsibility approach to all batteries not currently covered by an extended producer responsibility requirement, including, but not limited to, batteries used in electronic cigarettes, electronic cigars, electronic pipes, electronic hookahs and so-called vape pens. LD515 An Act to Reverse Recent Changes Made to the Law Governing Net Energy Billing and Distributed Generation This bill repeals the provisions of law enacted by Public Law 2019, chapter 478 related to net energy billing and distributed generation. It directs the Public Utilities Commission to initiate rulemaking to amend its rule regarding net energy billing to be substantially similar to that in effect on March 29, 2017. The bill also repeals or amends provisions of law in the Maine Revised Statutes, Title 35-A that rely on provisions that were enacted by Public Law 2019, chapter 478 and are repealed by this bill. LD1344 An Act to Improve the Response Time to Tenant Mold Complaints This bill requires that a complaint for nonsurface mold in a tenant-occupied dwelling unit be investigated within 90 days of the complaint. The bill requires that if the investigation finds an unhealthy level of nonsurface mold, remediation efforts must be initiated by the landlord within 5 business days of the investigation. The bill requires a local health officer to investigate a dwelling unit to determine if all surface mold has been remediated. Finally, the bill provides that a tenant may file a complaint under the implied warranty and covenant of habitability laws if the landlord fails to remediate the nonsurface mold within 60 days of the report. LD1532 An Act to Expand the Department of Inland Fisheries and Wildlife Outdoor Education Programs to Schools and Communities This bill allows the Department of Inland Fisheries and Wildlife to conduct the department's educational programs at locations owned by 3rd parties through leases or partnerships with the 3rd parties. The bill allows the Department of Inland Fisheries and Wildlife to collaborate with the Department of Education to develop a curriculum for a program to allow the program to count as secondary school instruction. A secondary school may elect to participate in the program, which may be held in whole or in part at the 3rd- party location or the secondary school or a school administrative unit facility. Members of the public and homeschoolers may attend the programs. The bill directs the Department of Inland Fisheries and Wildlife to secure at least 3 locations in geographically diverse areas of the State by January 1, 2026 and to develop a curriculum for one or more programs to be conducted at the locations as soon as practicable in 2026. LD1721 An Act to Amend the Laws Governing Commingling of Beverage Containers This bill amends the laws governing the commingling of beverage containers in several ways. 1. It amends the list of materials that are considered of like materials for the purposes of beverage container commingling. 2. It makes changes to the provision of law regarding the obligation of dealers and redemption centers to preserve the value of beverage containers. The changes include providing that a commingling group may refuse to accept, or pay the refund value and handling costs for, a beverage container that has been sorted in a manner that is inconsistent with an approved commingling agreement or an approved cooperative plan; and removing the authority for a commingling group to refuse beverage containers that have been processed by a reverse vending machine or account-based bulk processing program. 3. It prohibits initiators of deposit from requiring dealers or redemption centers from sorting containers that belong to the commingling group beyond that required in current law. Dead

LD1050 An Act to Allow an Adult Hunter to Transfer That Hunter's Antlerless Deer Permit to a Junior Hunter This bill allows a person who is 18 years of age or older and in possession of a valid antlerless deer permit to transfer that permit to a person with a valid junior hunting license. The bill establishes a process for this transfer: the permit holder must identify the name and address of the junior hunter on the permit and any additional information, if requested by the Commissioner of Inland Fisheries and Wildlife and return the permit to the Department of Inland Fisheries and Wildlife within 48 hours after the transfer of the permit. The transferor may not hunt antlerless deer but must provide supervision of the junior hunter while hunting. Dead
