LD259 An Act to Establish the Criminal Records Review Commission in Statute This bill implements a recommendation of the Criminal Records Review Committee established pursuant to Resolve 2023, chapter 103. The bill establishes the Criminal Records Review Commission. The commission members include Legislators, Executive Department commissioners or their designees and leaders and representatives from various organizations. The commission's duties include reviewing laws, rules and procedures pertaining to criminal history record information in this State. The commission may submit legislation to the Legislature at the start of each regular session and may also make recommendations to the Department of Public Safety, the Chief Justice of the Supreme Judicial Court, the judicial branch's advisory committee on the Maine Rules of Unified Criminal Procedure and any other organization or committee whose affairs pertain to the use, maintenance or dissemination of criminal history record information. The commission may consult with outside experts in fields related to its duties and may seek funding to partially or fully fund its costs. Members who are Legislators are entitled to receive a legislative per diem and reimbursement of expenses. Passed

LD697 An Act to Direct the Maine Prescription Drug Affordability Board to Assess Strategies to Reduce Prescription Drug Costs and to Take Steps to Implement Reference-based Pricing This bill makes the following changes to the laws governing the Maine Prescription Drug Affordability Board. 1. It adds to the board the executive director of the Maine Health Data Organization, or the executive director's designee, as an ex officio, nonvoting member. 2. It removes the authority of the board to recommend that public payors pay an annual assessment to support the administration of the board. 3. It changes the scope of the duties of the board from determining prescription drug spending targets to focusing on an assessment of strategies to reduce prescription drug costs, reduce the rate of growth in prescription drug spending and reduce cost barriers for consumers. 4. It requires the board to review how states with authority to establish upper payment limits have implemented that authority and their regulation of pharmacy benefits managers, to recommend whether the board should have comparable authority and to assess implementing reference-based pricing for the first 10 prescription drugs for which the Medicare program has negotiated maximum fair prices through the Medicare drug price negotiation program. 5. It requires the board to recommend annual spending targets for prescription drugs for public payors and implementing complementary purchasing strategies; annual spending targets and strategies for the commercial insurance market; transparency requirements and supply chain regulation; strategies to reduce out-of-pocket costs through insurance regulation; and aligning prescription drug payment with acquisition costs. The bill also directs the board to recommend a program to reduce the impact of prescription drug costs on the State's health care system, stem the rate of growth in prescription drug spending and reduce cost barriers for consumers based on data the board has collected. The board is directed to submit in reports to the joint standing committee of the Legislature having jurisdiction over health coverage, insurance and financial services matters a preliminary plan to implement the program by January 30, 2026 and a final plan by October 1, 2027. The joint standing committee is authorized to report out legislation based on the reports. Passed
LD784 An Act to Create a Rebuttable Presumption Related to Specialized Risk Screening for First Responders For policies issued or renewed on or after January 1, 2027, this bill prohibits a health insurance carrier from denying coverage to an enrollee who is a first responder for specialized risk screening recommended by a health care provider. It limits the ability of a health insurance carrier to require prior authorization for specialized risk screening. It also prohibits a carrier from imposing any out-of-pocket costs for specialized risk screening except for high deductible health plans offered for use in connection with a health savings account to the extent required under federal regulations. LD1871 An Act to Permit Sealing Criminal History Record Information of Victims of Sex Trafficking or Sexual Exploitation This bill amends provisions of the law governing post-judgment motions to seal criminal history record information by creating a new category of criminal conviction for which a person may file a motion to seal the related criminal history record information. Under the bill, a person may file a motion to seal criminal history record information for a criminal conviction for any current or former crime if the person shows by a preponderance of the evidence that the person has been a victim of sex trafficking or sexual exploitation, as defined by the bill, and the commission of the crime for which the person was convicted was a substantial result of sex trafficking or sexual exploitation. The bill also provides that a person who is regularly engaged in the business of collecting, assembling, evaluating or disseminating criminal history record information related to specific individuals for a fee, also called a business screening service, is required to disseminate only complete and accurate records; investigate disputed records; correct or delete records found to be inaccurate or reflecting a criminal conviction that was sealed or pardoned; and provide a notice with disseminated records including the date the record was collected and a notice that information may include criminal records that have been sealed or otherwise have become inaccessible to the public. A person is considered in violation of these provisions only if the person's conduct violates these provisions and also violates relevant provisions of the federal Fair Credit Reporting Act. A person found in violation of both the state and federal law is liable to the subject of the record for a penalty of $1,000 and additional remedies. Passed

LD1957 An Act to Promote Film Production in Maine This bill repeals the law governing the certified visual media production tax credit. It increases reimbursements under the laws governing the visual media production reimbursement and places limits on those reimbursements. It changes the definition of "visual media production expense" and requires an applicant for a visual media production certificate to agree to withhold a percentage of payments made to an entity created to hire out the services of one individual. LD1908 An Act to Require the Cooperation of Original Manufacturers of Electronic Devices to Facilitate the Repair of Those Devices by Device Owners and Independent Repair Providers This bill requires that, beginning January 1, 2026, an original equipment manufacturer of digital electronic equipment sold or in use in the State on or after July 1, 2021 is required to make available on fair and reasonable terms to any independent repair provider or owner of the digital electronic equipment any documentation, parts or tools required for the diagnosis, maintenance or repair of the equipment. Under the bill, an independent repair provider is a business engaged in diagnosing, maintaining and repairing digital electronic equipment but is not the original equipment manufacturer or a business licensed by the original equipment manufacturer. The bill also prohibits original equipment manufacturers, beginning January 1, 2026, from using software to identify component parts through a unique identifier, also called "parts pairing," to prevent or inhibit an owner or independent repair facility from installing or enabling functional replacement parts or components; intentionally reduce the functionality of the electronic equipment; or cause the electronic equipment to display misleading alerts about unidentified parts that the user cannot immediately dismiss. This provision applies to consumer electronic equipment that is manufactured for the first time, and first sold or used in this State, after January 1, 2026. The bill includes several exceptions that limit an original equipment manufacturer's obligations under the bill. The bill provides that an original equipment manufacturer is not liable for damages resulting from improper use of personal data or a data security breach in connection with repair, diagnosis, maintenance or modification of digital electronic equipment by an independent repair provider or owner. The bill requires that independent repair providers must provide a customer with a written notice explaining that the independent repair provider is not an authorized repair provider for the digital electronic equipment and disclose whether the independent repair provider uses any used parts in performing repair work. LD1734 An Act to Exempt Over-the-counter Medicines from the Sales and Use Tax This bill adds over-the-counter medicines and drugs to the sales tax exemption for medicines sold for humans on a doctor's prescription as long as the over-the-counter medicine or drug is labelled according to the requirements of the United States Food and Drug Administration. Medicines or drugs included in the new exemption include anesthetics; antacids; contraceptive supplies, drugs, devices and products approved by the United States Food and Drug Administration to prevent pregnancy; medication prepared for use in the eyes, ears or nose; opioid antagonists; products intended to be taken for coughs, colds, asthma or allergies; and steroidal medicines. LD1810 Resolve, to Establish the Commission to Study the Judicial Disciplinary Process This bill establishes the Commission on Judicial Conduct, comprised of 3 judicial officers appointed by the Chief Justice of the Supreme Judicial Court, one each from the Superior Court, the District Court and the Probate Court; 3 licensed attorneys appointed by the Chief Justice; and 3 members of the public appointed by the Governor. The bill charges the commission with receiving and investigating complaints, conducting hearings and making findings and recommendations to the Supreme Judicial Court concerning allegations that an Active or Active Retired Judge or Justice of the Supreme Judicial Court, the Superior Court, the District Court or a county Probate Court has either engaged in actions or omissions that constitute grounds for discipline or has a mental or physical disability affecting the judge's or justice's judicial performance. The bill also directs the commission to hire an executive director to assist the commission in performing its duties, including by screening complaints and recommending dispositions to the commission; employing counsel, private investigators, hearing officers and other staff; administering the commission's budget; and preparing an annual report to the Chief Justice of the Supreme Judicial Court and the joint standing committee of the Legislature with jurisdiction over judiciary matters. Finally, the bill authorizes the Supreme Judicial Court to establish an advisory committee with the authority to issue advisory opinions interpreting the Maine Code of Judicial Conduct. Passed

LD504 An Act to Improve Family Court Procedure Beginning January 1, 2026, this bill authorizes a party to a divorce, legal separation, parentage or parental rights and responsibilities proceeding or a post-judgment motion arising out of one of these actions to file a motion requesting that the court issue an ex parte emergency parental rights and responsibilities order on the basis that there is an immediate and present risk of substantial harm to the physical or emotional health or safety of a child. The order may be issued by a District Court Judge or a family law magistrate and may include a temporary allocation of parental rights and responsibilities between the parties in the underlying action, conditions of parent-child contact and directives regarding the residence of the child. If a judge or magistrate issues an emergency parental rights and responsibilities order ex parte, the court must hold a hearing within 21 days to determine the need for continuation of the temporary relief granted in the order. A party affected by the emergency parental rights and responsibilities order, other than the party that requested the order, may file a motion to modify or to dissolve the order, which the court must hear as expeditiously as the interests of justice require. The bill also directs the Maine Commission on Domestic and Sexual Abuse to convene a working group of stakeholders, similar to the working group established by Resolve 2021, chapter 99, to review data from the judicial branch gathered for at least 2 years following implementation of the emergency parental rights and responsibilities order process established in this legislation to evaluate the efficacy of the process. The bill directs the commission to submit a report regarding the working group's findings to the joint standing committee of the Legislature having jurisdiction over judiciary matters by November 1, 2028. The committee may report out legislation to the 134th Legislature in 2029 in response to the report. Passed

LD355 An Act to Advance the Maine Retirement Savings Program This bill makes the following changes to the Maine Retirement Savings Program. 1. It changes the definition of "covered employer" so that it includes all employers who hire employees. 2. It allows covered employers who may have offered a workplace retirement plan within the past 2 years to participate in the program. 3. It allows the Maine Retirement Savings Board to phase in the program based on the number of employees rather than based on the size of employers as provided in current law. 4. For employers who become required to participate in the program after the start date of the program, it clarifies that the employer is required to participate in the program within a time frame established by the board. 5. It clarifies that covered employers that fail to enroll are subject to an annually increasing penalty. 6. It changes when the Maine Retirement Savings Board is required to submit an audited financial report to the Governor, the Treasurer of State and the Legislature from beginning February 1, 2026 and annually thereafter to beginning July 1, 2026 and annually thereafter. 7. It allocates funds to the Maine Retirement Savings Program Enterprise Fund. Passed
LD582 An Act to Require Health Insurance Carriers to Provide Coverage for Blood Testing for Perfluoroalkyl and Polyfluoroalkyl Substances This bill requires carriers offering health plans in this State to provide coverage for blood testing for perfluoroalkyl and polyfluoroalkyl substances, or PFAS, recommended by a provider as medically necessary health care in accordance with clinical guidelines established by the National Academies of Sciences, Engineering, and Medicine. The requirements of the bill apply to health plans issued or renewed on or after January 1, 2026. The bill also includes language stating the Legislature's finding that the requirement for coverage for blood testing for perfluoroalkyl and polyfluoroalkyl substances are not an expansion of the State's essential health benefits and do not require the State to defray costs pursuant to the federal Patient Protection and Affordable Care Act. LD1018 An Act to Protect Health Care for Rural and Underserved Areas by Prohibiting Discrimination by Participants in a Federal Drug Discount Program This bill prevents discrimination by pharmaceutical manufacturers, health insurance carriers, pharmacy benefits managers and their agents against pharmacies and health care providers that participate in the federal prescription drug discount program, known as the 340B drug discount program. LD910 An Act to Collect Data to Better Understand the Consumer's Health Insurance Experience This bill requires a health insurance carrier, beginning in 2026, to provide a quarterly report to the Superintendent of Insurance that identifies the number of claims for that quarter that were denied, the number of claims for that quarter for which prior authorization was denied, the 5 most common reasons for a claim denial and the 5 most common reasons for a prior authorization denial. The superintendent is required to submit an annual report on that information as well as information provided to the superintendent by the United States Department of Health and Human Services regarding claim and prior authorization denials under the federal Affordable Care Act to the joint standing committee of the Legislature having jurisdiction over health coverage, insurance and financial services matters. LD1502 An Act to Update the Requirements for Health Insurance Coverage of Prostate Cancer Screening Under current law, health insurance coverage must be provided for annual prostate cancer screening, if recommended by a physician, to men 50 years of age or older until attaining 72 years of age. This bill updates the required coverage by doing the following. 1. It expands the scope of the required screening services to include medically necessary follow-up testing as directed by a physician, including, but not limited to, urinary analysis; serum biomarker testing; and medical imaging. It retains the provision in current law that requires coverage of a digital rectal examination and a prostate-specific antigen test and provides that associated laboratory fees for those tests are also covered. 2. It requires the coverage of services for the early detection of prostate cancer, if recommended by a physician, when supported by medical and scientific evidence according to the most recently published nationally recognized clinical practice guideline. 3. It prohibits the use of any deductible, copayment, coinsurance or other cost-sharing requirement for the costs of services for the early detection of prostate cancer. The requirements of the bill apply to health plans issued or renewed on or after January 1, 2026. In Committee
LD1496 An Act to Ensure Ongoing Access to Medications and Care for Chronic Conditions by Changing Requirements for Prior Authorizations This bill requires that a prior authorization for health care services remain valid for the duration of the treatment or one year, whichever is longer. It prohibits a health care plan from requiring the renewal of a prior authorization more frequently than once every 5 years for treatment that is necessary for more than one year. It also prohibits a health care plan from restricting coverage for a health care service or a prescription that was approved under a previous health care plan within 90 days of enrollment in the new health care plan and requires a health care plan to provide at least 90 days' notice to an enrollee prior to restricting coverage of a previously approved health care service. LD738 An Act to Remove Barriers to Becoming a Lawyer by Establishing a Law Office Study Program This bill creates additional opportunities for individuals to qualify to take the examination for admission to the bar. Under the bill, an applicant for admission to the bar who has studied law for 4 years in a law office study program under the supervision of a judge or attorney who is a member of the bar in good standing need not attend law school prior to taking the bar examination. During the 4-year period, the applicant must pursue a systematic course of legal study designed to prepare the applicant for the general practice of law that must include, at a minimum, each of the subjects tested on the bar examination. An applicant may receive credit for up to 2 of the 4 required years of legal study based on the applicant's study of law at an accredited law school in this country, study of law at an equivalent foreign law school, legal study in a foreign jurisdiction that led to the admission of the applicant to practice law before a court of general jurisdiction within that jurisdiction or legal study in compliance with the requirements of a law office study program in another state. The bill requires that an applicant who is determined by the board of bar examiners to be otherwise eligible through a law office study program to take the examination for admission to the bar must pay a fee fixed by the Supreme Judicial Court before the applicant is determined eligible to take the examination. The bill requires the board, by January 1, 2026, to create and make available forms for applicants to submit required reports and notices to the board to be eligible to take the examination for admission to the bar through a law office study program. If the board fails to make these forms available by the deadline, then applicants may submit those reports and notices in any reasonable form or format as long as the reports and notices otherwise conform with the law. It requires an operator of a motor vehicle to submit to a blood test for drugs when the operator is involved in an accident where there is probable cause to believe that death or serious bodily injury has occurred or will occur as a result of the accident. 2. It allows the blood test to be admissible at trial if the court reviews all available evidence, with the exception of the blood test, and the court determines that probable cause exists to believe that the operator was under the influence of THC at the time of the accident. 3. It requires that the Secretary of State suspend an operator's license for one year if the operator fails to submit to a blood test that is required under this bill. However, the bill requires that the suspension be removed if the person can show that the person was not under the influence of THC or that the person did not negligently cause the accident. Dead

LD559 An Act to Provide Property Tax Stabilization for Older Maine Residents This bill allows a municipality to adopt by ordinance a property tax stabilization program for senior residents of that municipality. A municipality adopting such an ordinance sets a minimum age for participation by residents of the municipality of not less than 62 years of age. The person must also be a permanent resident of the State and have owned a homestead in the State for at least 10 years. A municipality may adopt stricter eligibility requirements. The bill also allows a municipality, by referendum, to adopt a local option sales tax of 1% on the value of prepared food and rental of living quarters in any hotel, rooming house or tourist or trailer camp. The revenue generated by the local option sales tax may only be used to offset the loss of revenue from the property tax stabilization program for senior residents of that municipality. Dead
