LD1927 An Act to Add Mold to the Implied Warranty and Covenant of Habitability This bill requires a landlord, upon receipt of a request from a tenant, to inspect a dwelling unit within 24 hours following a leaking event or for visible mold or dampness. The bill also requires a landlord to demonstrate reasonable effort to repair the source of the leak and restore the area within 5 days of inspection. The bill requires a tenant to, after reasonable notice, allow the landlord or the landlord's agent access to the dwelling unit for remediation purposes. Finally, the bill gives remedies and enforcement mechanisms to the landlord and the tenant for noncompliance with the duties given under these provisions. Passed

LD1177 Resolve, to Study the Public Health and Environmental Risks from Synthetic Turf This resolve puts a 3-year moratorium on the installation or reinstallation of synthetic turf in any park, outdoor playing field or athletic field, indoor athletic facility or similar venue. It directs the Department of Environmental Protection to examine whether synthetic turf is a risk to public health, the surrounding environment and the climate emissions goals of the State as compared to turf and, if it is a risk, the ways in which synthetic turf is a risk. It directs the department to submit, no later than November 4, 2026, a report that includes its findings and recommendations, including suggested legislation, for presentation to the 133rd Legislature in 2027. The department is also directed to conduct an outreach program to inform local governments, civic organizations, schools and the public regarding the findings of the report. Passed

LD1966 An Act to Improve Access to Community Solar Programs in the State This bill directs the Public Utilities Commission to conduct one or more proceedings beginning in 2025 and every 5 years thereafter to review and investigate administrative charges demanded or collected by a public utility with over 50,000 customers. If the commission finds that a utility has overcollected administrative charges from one or more customers or ratepayers, the commission may order the utility to refund to a customer any excess charges paid by the customer or, if paid by ratepayers, order the utility to refund excess charges in future rates. The commission is also directed to adopt rules requiring a utility to disclose all administrative charges on any proposal, estimate or invoice for work charged to a customer or to ratepayers. The commission must report to the joint standing committee of the Legislature having jurisdiction over utilities matters and to the Governor's Energy Office following each investigation. The bill requires the Electric Ratepayer Advisory Council, in developing recommendations to the Public Advocate regarding methods to ensure that ratepayers are able to afford electricity in the State, to identify methods to improve access to and use of community solar programs by low-income and moderate-income persons in the State. The bill requires the commission, by June 1, 2026, to require a transmission and distribution utility to offer consolidated billing to a distributed generation resource at its request. The bill requires the commission to establish customer bill information requirements that require a customer bill issued by an investor-owned transmission and distribution utility that includes public policy charges on customer bills to include an accurate and comprehensive description of all costs and benefits of public policy charges. The bill requires the commission to conduct, by December 31, 2025, a proceeding to examine and evaluate opt-in program designs to reduce net energy billing costs. The commission must report its findings and plans for future action to the Joint Standing Committee on Energy, Utilities and Technology no later than March 31, 2026. In Committee

Whereas, acts and resolves of the Legislature do not become effective until 90 days after adjournment unless enacted as emergencies; and Whereas, the City of South Portland is authorized pursuant to state law and its charter to borrow money and to issue its general obligation bonds and notes in furtherance of its municipal purposes; and Whereas, at a city referendum held November 5, 2024, the voters of the city ratified and approved 2 bond ordinances, the first for $1,000,000 for school maintenance and improvements and the second for $3,000,000 for school safety improvements, all as described in the bond ordinances submitted to a referendum vote; and Whereas, at the same city referendum held November 5, 2024, the voters of the city ratified and approved a charter amendment regarding the disposition of certain city-owned property; and Whereas, each bond ordinance was approved by the voters of the city as follows: Question 1, school maintenance and improvements: 11,165 in favor and 3,431 against, with 608 blank ballots; and Question 2, school safety improvements: 10,584 in favor and 4,002 against, with 624 blank ballots; and Whereas, the charter amendment was approved by the voters of the city as follows: 11,807 in favor and 2,370 against, with 801 blank ballots; and Whereas, the Maine Revised Statutes, Title 30-A, section 5772, subsection 2-A requires that any question submitted to the electors for ratification of a general obligation bond be accompanied by a statement signed by the treasurer of the municipality setting forth certain information about the municipality's outstanding and unpaid bonds, its authorized and unissued bonds and the total principal amount and the interest cost of the proposed bonds that are the subject of the referendum vote; and Whereas, Title 21-A, section 622-A requires that the notice of election contain the referendum questions for that election; and Whereas, due to inadvertent oversight, although the 2 bond ordinances submitted to the voters were accompanied by a statement setting forth the required information about the city's bonded debt, the statement was not signed by the treasurer of the city as required by Title 30-A, section 5772, subsection 2-A; and Whereas, prior to the referendum, the South Portland city council held a first reading, a public hearing and a second reading on the 2 bond ordinances, a summary of the 2 bond ordinances was posted in the city hall 7 days prior to the public hearing, the South Portland school department held a public hearing on the 2 bond ordinances, the municipal clerk posted the bond ordinances and the specimen ballots setting forth the referendum questions on the bond ordinances in public and conspicuous places in each voting district in the city at least 7 days prior to the referendum, and posted this information at each voting place on election day, and the municipal clerk published a summary of the 2 bond ordinances in the Portland Press Herald not less than 10 days nor more than 15 days prior to the referendum; and Whereas, the failure to include the signed statement required by Title 30-A, section 5772, subsection 2-A and the failure to include the 2 bond ordinance questions in the notice of election create a legal technicality that could affect the marketability of the bonds or notes to be issued by the city in connection with the projects; and Whereas, in the judgment of the Legislature, these facts create an emergency within the meaning of the Constitution of Maine and require the following legislation as immediately necessary for the preservation of the public peace, health and safety; now, therefore, Signed/Enacted/Adopted

LD1272 An Act to Address the Housing Crisis by Reducing Barriers to Building More Accessory Dwelling Units This bill allows up to 4 either single-family, duplex, triplex or accessory dwelling units on a single lot. The bill exempts only the first accessory dwelling unit on a lot from municipal housing density requirements. It prohibits a municipality from adopting an ordinance or other restriction that requires the owner of the lot to reside in one of the units on the lot. It prohibits a municipality from adopting an ordinance or other restriction that requires a fire sprinkler system to be installed in certain accessory dwelling units. It amends the definition of "subdivision" from a division of a tract or parcel of land into 3 or more lots to a division of a tract or parcel of land into 5 or more lots. It clarifies that an accessory dwelling unit that otherwise complies with applicable state and local zoning requirements must be allowed on a nonconforming lot as long as the accessory dwelling unit does not further increase the nonconformity.
