LD1211 An Act Regarding Certain Definitions in the Sales and Use Tax Laws Affecting Rental Equipment This bill changes the definition of "automobile" in the sales and use tax laws to provide that a pickup truck or van with a gross vehicle weight rating of 10,000 pounds or less is included only if it is not used primarily to transport goods or freight. The bill also changes the definition of "lease or rental" to provide that it does not include a lease or rental of tangible personal property that is used only at the primary business location of the lessor. LD1232 An Act to Require Radon Testing for Certain Commercial and Residential Construction This bill requires a radon permit for new commercial and residential construction and for improvements or alterations to a commercial structure requiring a building permit. A person registered by the Department of Health and Human Services to test radon must apply for the permit and conduct testing, and if it is determined that radon mitigation measures are required, the person designing and installing the radon mitigation measures must be registered by the department. Residential construction in a municipality without a building code or performed by a homeowner acting as a general contractor and who performs more than 50% of the framing and finishing of the structure are exempt from the permit requirements. LD1505 An Act to Phase out the Sales and Use Tax This bill phases out the tax imposed on the sale of tangible personal property, products transferred electronically and taxable services by reducing the tax rate by 1/2 of a percentage point every 2 years, beginning January 1, 2026, until the rate is 0% for each category of tangible personal property, products transferred electronically or taxable service subject to sales tax. Since use taxes are based on the sales tax rate, use tax rates will also be decreased a commensurate amount. The bill also requires the State Tax Assessor, the month before a decrease is scheduled to take effect, to publish on the bureau's publicly accessible website the new rates and to submit a bill to the joint standing committee of the Legislature having jurisdiction over taxation matters making the statutory changes necessitated by the decreased rates. LD1707 An Act to Require a Person to Be a United States Citizen to Receive State or Local Financial Assistance and to Ensure Municipal Compliance with Federal Immigration Laws This bill requires an individual to be a citizen of the United States in order to receive any form of financial assistance from the State or a municipality, except for funding for general purpose aid for education. The bill also provides that a municipality is ineligible to receive municipal general assistance and state-municipal revenue sharing if that municipality prohibits or restricts, formally or informally, the exchange of information with federal immigration authorities or any other federal, state or local government entity regarding the citizenship or immigration status, lawful or unlawful, of any individual or the maintenance of such information. LD332 An Act to Establish Mandatory Minimum Sentences for Gross Sexual Assaults Against Children and Aggravated Sex Trafficking of Children This bill provides that if the State pleads and proves that a gross sexual assault was committed against an individual who had not yet attained 12 years of age, the court is required to impose a definite term of imprisonment of not less than 25 years, none of which may be suspended. It also provides that, in the case of a gross sexual assault committed against an individual who had not yet attained 12 years of age when the defendant had previously been convicted and sentenced for committing gross sexual assault, formerly denominated as gross sexual misconduct, or rape against an individual who had not yet attained 12 years of age or that the defendant had previously been convicted and sentenced for engaging in substantially similar conduct in another jurisdiction against an individual who had not yet attained 12 years of age, the court is required to instead impose a term of imprisonment for life. It also provides that, in the case of aggravated sex trafficking for which the State pleads and proves that the defendant knowingly promoted prostitution of a person who had not yet attained 12 years of age, the court is required to set a definite term of imprisonment of not less than 25 years, none of which may be suspended. LD1255 An Act to Ensure In-state Tuition for Postsecondary Students Who Are Registered to Vote in the State and to Amend Eligibility Requirements for the Free Community College Tuition Program This bill provides that a student who is registered to vote in this State is considered to be a resident of this State and is eligible for in-state tuition rates at any postsecondary educational institution in this State that offers an in-state tuition rate. It provides that such a student must meet the voting residency qualifications and that the student may be considered a permanent resident for homestead property tax exemption purposes and a resident for estate tax purposes, subject to resident income taxes and eligible to run for state office. A family member of the student may be eligible for in-state tuition rates at a postsecondary educational institution in the State. The bill also requires a person to be a graduate of a high school in the State or reside in the State for at least 2 years prior to enrollment in a Maine community college in order to be eligible for free tuition in the Maine Community College System. LD1333 An Act to Make Changes to the Paid Family and Medical Leave Benefits Program This bill makes the following changes to the paid family and medical leave benefits program. 1. It requires an employee to be employed with an employer for 120 days before being eligible to take leave. 2. It clarifies that the definition of "self-employed individual" applies only to employers with less than 15 employees. 3. It allows employers to have intermittent leave schedules reviewed by the program administrator. 4. It applies the same delay of implementation to private employers with collective bargaining agreements as currently applies to public employers. 5. It prohibits the taking of paid leave unless the employee simultaneously takes any available unpaid leave. 6. It reduces the retroactive application deadline from 90 days to 30 days. 7. It requires the paid family and medical leave benefits program administrator to give employers 5 days' notice of leave being approved for an employee. 8. It requires the Department of Labor to post on its publicly accessible website no later than February 1st of each year the dates by which contribution reports and premiums must be remitted. 9. It relieves employers with collective bargaining agreements of the obligation to bargain over the employee's share of the premium. 10. It allows employers to correct mistakes in the employee share of taxes for up to 3 months. 11. It establishes a 52-week formula for calculating the 15-employee threshold. 12. It changes the applications of penalties against employers from mandatory to discretionary. 13. It requires self-employed individuals who elect coverage to pay 1/4 of a year's worth of premiums upon first applying for coverage. 14. It places limits on the fees charged for private plan substitutions. 15. It requires the Department of Labor to post on its publicly accessible website the appropriate tax forms, based on guidance from the United States Internal Revenue Service and the Department of Administrative and Financial Services, Maine Revenue Services, that employers with approved private plans must provide to employees taking leave. 16. It clarifies that the provision that provides that an employee who takes leave is entitled to be restored to the employee's former position does not apply to an employee who is taking retroactive paid leave and who did not notify the employer for more than 5 days of the employee's absence. 17. It changes rules from routine technical to major substantive. 18. It clarifies that at no time may an employee receive benefits of over 100% of the employee's wages. 19. LD1210 An Act to Regarding Renewable Electricity Generation by Hydropower Projects This bill amends the laws regulating the Department of Environmental Protection's process for approving or disapproving a permit for a hydropower project and for issuing or denying a water quality certification for a hydropower project as required under the Federal Water Pollution Control Act. It requires the department, in determining whether to approve or deny a permit, or issue or deny a water quality certification, to consider the effect of that approval, disapproval, issuance or denial on the State's renewable energy, decarbonization and economic development policies and goals; the environmental and economic benefits to the State of the hydroelectric generation provided by the project; and, taking those factors into consideration, whether approval of the permit or issuance of the certification for the project is permissible notwithstanding the project's effect on wildlife habitat and aquatic life within the waters affected by the project, including affected waters downstream of the project. LD928 An Act to Maintain Public Access to Town Ways in Maine This bill provides that if the municipal officers or county commissioners have declared a town way discontinued by abandonment and have retained a public easement in the abandoned town way under this section for at least 15 years, the municipality, county commissioners or an abutter on the way may not gate, bar or otherwise obstruct the town way. The bill also provides that if the municipal officers or county commissioners have declared a town way discontinued by abandonment and have retained a public easement in the abandoned town way under this section for less than 15 years, the municipality, county commissioners or an abutter on the way, acting with the written permission of the municipal officers or county commissioners, may remove any gates, bars or other obstructions in the town way. LD1096 An Act to Allow Municipalities That Have Financed Fiber-optic Broadband Infrastructure to Use Loans or Grants to Repay Associated Debt This bill authorizes the Municipal Gigabit Broadband Network Access Fund to provide funding to municipal entities applying for project grants to repay debt that was incurred by a municipal entity for the construction of a municipally owned gigabit fiber-optic broadband network project. It specifies that the Maine Connectivity Authority may make direct loans or grants to municipal entities for the repayment of debt incurred by a municipal entity for the construction of municipally owned broadband infrastructure. The bill also requires the authority, in administering a grant or award for the development or construction of municipally owned broadband infrastructure, to permit the use of grant or award funds for the repayment of debt incurred by a municipal entity related to the development or construction of the broadband infrastructure unless such use is prohibited by the source of the grant or award. LD1627 An Act Regarding Workforce Development, Education Reform and Talent Retention This bill requires that students complete an internship prior to graduating from high school beginning January 1, 2027. The bill also requires the Department of Education to: 1. Develop and implement a career exploration module for middle school and high school students; 2. Require school administrative units to track and report post-graduation outcomes and examine metrics that incentivize school administrative units to guide students toward 4-year degree programs; 3. Provide training on career counseling standards, including professional development for school counselors regarding career pathways in high-demand fields; 4. Mandate that all high school students receive information on a variety of post-graduation options, including apprenticeships, certification programs and local employment opportunities in high demand; 5. Redirect infrastructure funds to upgrade career and technical education facilities and equipment to meet industry standards; 6. Expand access to extended learning opportunity program coordinators, prioritizing underserved and rural areas; 7. Establish a competitive grant program for employers to partner with schools, career and technical education centers and the Maine Community College System to create new training opportunities to address workforce gaps; 8. Fund innovative pilot programs, such as mobile training units; 9. Develop, in consultation with the Department of Administrative and Financial Services, Bureau of Revenue Services, employer tax incentives for workforce investments; 10. Coordinate with the Department of Labor to address labor shortages in underserved regions by offering temporary housing and commuting or relocation stipends; 11. Conduct audits of workforce education to identify inefficient programs and, upon discovery, reallocate the funds to initiatives with measurable outcomes; and 12. Submit a report no later than December 3, 2025 to the Joint Standing Committee on Education and Cultural Affairs with suggested legislation. Dead
LD1709 An Act Regarding Antique Automobiles This bill reduces the age that an automobile or truck must be to be considered an antique auto in the motor vehicle laws from 35 years old to 25 years old. This age requirement was increased from 25 years old to 35 years old in Public Law 2023, chapter 634. The bill requires a person registering an antique auto to show proof of registration and insurance for the motor vehicle used as that person's primary mode of transportation of passengers or goods and maintain the registration and insurance for that motor vehicle or a replacement motor vehicle during the term of registration of the antique auto. A person may not operate an antique auto when a motor vehicle used as that person's primary mode of transportation of passengers or goods is not registered and insured. A person who violates this provision commits a civil violation for which a fine of not more than $2,500 may be adjudged and for which the Secretary of State may immediately revoke the registration for the antique auto. LD1675 An Act to Provide Just Compensation in Cases of Taking by Eminent Domain by Transmission and Distribution Utilities This bill updates the laws regarding damages paid to owners of property taken by eminent domain by a transmission and distribution utility for the construction, rebuilding or relocation of a transmission line. The bill requires a transmission and distribution utility to set aside 1% of the total revenue generated from the construction, rebuilding or relocation of a transmission line annually to be paid as damages to the owner of a property taken by eminent domain for the construction, rebuilding or relocation of that transmission line. The 1% of the revenue set aside for damages must be distributed to property owners based on the acres of property taken from that owner for the construction, rebuilding or relocation of the transmission line in the form of an annual installment over the course of 20 years from the operation date of the transmission line. LD539 An Act to Repeal the Paid Family and Medical Leave Benefits Program This bill repeals the provisions of law related to the paid family and medical leave benefits program. The bill requires the Department of Labor to refund contributions made by employers and self-employed individuals to the Department of Labor under the paid family and medical leave benefits program. The bill requires an employer that deducted a portion of the premium required for an employee from that employee's wages to remit that portion of the premium to the employee as part of the employee's wages. The bill requires the State Controller to transfer unappropriated funds from the Department of Labor, Paid Family and Medical Leave Insurance Fund, Other Special Revenue Funds account to the unappropriated surplus of the General Fund. LD1633 An Act to Promote the Recycling and Reuse of Construction Materials This bill directs the Department of Environmental Protection to establish by rule a streamlined process for the certification of construction materials reclamation facilities. Under the bill, a construction materials reclamation facility is defined as a facility that exclusively accepts construction and demolition debris and sorts, refurbishes and sells construction materials reclaimed from the debris for reuse in construction. A construction materials reclamation facility that receives a certification from the department is not required to obtain a solid waste facility license. The bill also establishes the nonlapsing Construction Materials Reclamation Fund within the department to provide grants, loans or other funding to any public or private entity to support the development and certification of construction materials reclamation facilities, training programs for individuals operating and employed at those facilities and public outreach and education initiatives regarding those facilities. Beginning January 1, 2026, this fund will receive a new $10 per ton fee imposed on the landfill disposal of construction and demolition debris and residue from the processing of the debris. The bill also capitalizes this fund with General Fund appropriations of $1 million in fiscal years 2025-26 and 2026-27. The bill establishes a new state goal that, by January 1, 2036, the total tonnage of construction and demolition debris annually disposed of at solid waste landfills in the State will be reduced by 25%. The baseline for calculating this reduction is the 2024 solid waste generation and disposal capacity data gathered by the Department of Environmental Protection. The bill also directs the Department of Administrative and Financial Services, Bureau of Revenue Services to develop a proposal for implementation of a refundable tax credit for housing developers that purchase for use in the construction of affordable housing in the State reclaimed construction materials from a certified construction materials reclamation facility. The credit must be equal to 100% of the documented cost of the reclaimed construction materials purchased by the developer from a construction materials reclamation facility. The bureau is also required to develop a proposal for implementation of a charitable deduction from individual income tax for individuals or businesses who donate construction materials to a certified construction materials reclamation facility. The bureau must submit by January 1, 2026 a report setting forth the tax credit and deduction proposals, including necessary implementing legislation along with any related recommendations, to the Joint Standing Committee on Taxation. After reviewing the report, the committee may report out related legislation to the Second Regular Session of the 132nd Legislature. Dead
LD812 An Act to Provide State Recognition of the Kineo St. John Tribe This bill provides for state recognition of the Kineo St. John Tribe as a Native American tribe. Recognition does not create, extend or form the basis of any right or claim to land or real estate in the State or any right to conduct gambling activities prohibited by law. LD813 An Act Regarding State Recognition of Native American Tribes This bill establishes a process for state recognition of Native American Indian tribes, which is designed to recognize the historical and cultural contributions of Native Americans to the State, to protect and strengthen the heritage of Native Americans in the State and to provide technical assistance to state-recognized Native American Indian tribes and their members related to state and federal programs and activities. It establishes the Maine Commission on Native American Indian Affairs, a 5-member panel of experts appointed by the Governor to review and to make recommendations on applications for state recognition of Native American Indian tribes in the State and to provide specific assistance to state-recognized Native American Indian tribes and their members. The ultimate decision whether to confer state recognition lies with the Legislature. State-recognized Native American Indian tribes and their members remain subject to all of the laws of the State, and recognition may not be construed to grant the state- recognized Native American Indian tribe or its members any right or claim to land or real estate in the State or the right to conduct any gambling activities otherwise prohibited by law. LD430 An Act to Impose Moratoria on Hydropower Dam Removal and on Water Release from Nonhydropower Dams and to Make Other Changes to the Laws Regulating Such Dams This bill amends the laws governing hydropower and nonhydropower dams as follows. 1. It amends the laws governing hydropower projects to prohibit the Department of Environmental Protection from approving an application for a permit to remove a dam that is part of a hydropower project. This prohibition is repealed January 1, 2027. 2. It amends the laws governing release from ownership and water level maintenance for nonhydropower dams to prohibit the department from issuing an order to a dam owner to release water from the dam or, at the request of the dam owner, otherwise authorize or approve the removal of a nonhydropower dam. This prohibition is repealed January 1, 2027. 3. It also amends the laws governing release from ownership and water level maintenance for nonhydropower dams to extend by 30 days certain statutory deadlines under those laws relating to the required consultation process to determine whether a change in dam ownership is available and relating to the assessment of certain public values associated with the dam by certain state agencies. The bill also directs the department to evaluate options for implementation of processes, programs or initiatives to address negative outcomes that may be experienced by municipalities, businesses and property owners upon the removal of, or significant change in, water flows from a hydropower or nonhydropower dam, including, but not limited to, interruptions in or loss of water supply for adjacent municipalities and businesses and damage to or impairment of public and private property and infrastructure resulting from dam removal or change in water flows. On or before January 1, 2026, the department is required to submit to the Joint Standing Committee on Environment and Natural Resources a report outlining its evaluation and including its recommendations along with draft legislation as necessary. After reviewing the report, the committee may report out related legislation. Dead
LD908 An Act to Eliminate the Sales Tax on Prepared Foods and Support the State's Hospitality Industry This bill is a concept draft pursuant to Joint Rule 208. This bill proposes to eliminate the 8% sales tax on all prepared foods, including meals served in restaurants, for the purpose of boosting economic activity by making dining out more affordable. The Department of Economic and Community Development would be required to initiate an advertising campaign to encourage tourism in Maine and promote dining establishments as tax-free, with the exception of alcoholic beverages. The loss of revenue from the repeal of the sales tax on prepared foods would be offset in a number of ways, including: 1. LD934 An Act to Provide 100 Percent of the Maine Resident Homestead Property Tax Exemption Amount to Seniors and Veterans Under the Maine resident homestead property tax exemption, an eligible homestead is entitled to an exemption of $25,000 of the just value of the homestead. The actual amount of the exemption is based on the certified assessment ratio provided by a municipality to the Department of Administrative and Financial Services, Bureau of Revenue Services. Unless the municipality has a certified assessment ratio of 100%, the exemption amount is less than $25,000. This bill provides 100% of the exemption amount, regardless of the assessment ratio of the municipality, to an individual who qualifies for the Maine resident homestead property tax exemption and is either at least 65 years of age or a veteran who served in the Armed Forces of the United States. This bill also requires the State to reimburse a municipality for 100% of the revenue lost as a result of this full exemption. Currently, the State reimburses municipalities 76% of the revenue lost due to the Maine resident homestead property tax exemption. Dead
