LD1261 Resolve, to Establish the Community Navigator Pilot Program to Support At-risk Families This bill establishes a 2-year pilot program in the Department of Health and Human Services to award contracts to 4 child abuse and neglect prevention councils in this State for a community navigator position within each council. The bill requires community navigators to work with families who have been reported to the department for suspected child abuse or neglect but have been determined by the department to not meet the criteria for a child protective services investigation. Community navigators are required to help connect these families with community services as needed. Under the bill, community navigators are required to provide outreach and education to mandated reporters of suspected child abuse or neglect to enhance their knowledge of available community services for families and how to connect families with those services. The educational outreach must also provide mandated reporters with guidelines for working directly with families in need to help shift the role of mandated reporters from just reporting suspected child abuse or neglect to actively supporting families in need. The bill requires the department to provide funding for the community navigators in the amount of $90,000 per position, per year, for both year one and year 2 of the pilot program. The department must determine to which child abuse and neglect councils the contracts are awarded based on which child abuse and neglect prevention councils are most prepared to participate in the pilot program. LD1544 An Act to Support Families by Improving the Court Process for Child Protection Cases This bill amends the court process in child protection cases by eliminating as an aggravating factor consideration of whether a parent's rights to another child were previously involuntarily terminated; requiring the court to consider the trauma to the child of removal from the child's home and whether the Department of Health and Human Services exhausted its options to mitigate that harm before removing the child; and at a contested termination of parental rights hearing, requiring the court to explicitly make findings that the department met its statutory obligations to provide reasonable efforts to reunify the child and parent before ordering a termination of the parent's rights. LD1746 An Act to Reduce Dental Disease and Ensure Access to Essential Preventive Dental Care Among Maine Children This bill does the following. 1. It delays the requirement for oral health services to be available in all schools from January 1, 2025 to January 1, 2027 and clarifies that the requirement applies only to public schools. 2. It requires the Department of Health and Human Services to develop public-private partnerships to establish a model to provide for mobile dental services providers to provide additional preventive oral health and disease intervention services in schools based on the model in the Cumberland County School Oral Health Project. It requires the department to provide for at least one mobile dental services provider in each public health district per school year. 3. It requires the Department of Health and Human Services to provide training and education to primary care providers on minimally invasive dental disease treatment for infants and small children using guidance from the From the First Tooth program or its successor program and the American Academy of Pediatrics. Pediatricians are encouraged to use silver diamine fluoride in primary care settings to reduce dental disease and prevent cavities. 4. It makes permanent 2 previously established limited positions related to provided oral health services in public schools within the Department of Health and Human Services, Maine Center for Disease Control and Prevention. LD1866 An Act to Amend the Laws Regarding the State-designated Agency Advocating for Individuals with Serious Mental Illness This bill requires in statute that the Department of Health and Human Services contract with an independent agency to provide advocacy services on a statewide basis to individuals with serious mental illness who are residing in those individuals' communities or who are hospitalized. LD1937 An Act to Require Hospitals and Hospital-affiliated Providers to Provide Financial Assistance Programs for Medical Care The bill eliminates the existing law that requires the Department of Health and Human Services to adopt guidelines governing charity care and replaces it with a more comprehensive law governing charity care and other financial assistance programs provided by hospitals to patients to cover charges for services provided by that hospital. The bill does the following. 1. It requires that hospitals provide charity care or free health care services to patients who are state residents and whose family income is equal to or less than 200% of the federal poverty level. 2. It establishes requirements with respect to hospital-provided financial assistance programs and specific requirements applying only to charity care that hospitals must follow in accordance with rules adopted by the department concerning the application process, language interpretation, eligibility determinations, notification of eligibility determinations and, in the case of charity care, rights to a hearing following a denial. 3. It requires that hospitals widely publicize their financial assistance programs within the community served by the hospital, including by publishing a summary of the programs written in plain language; by providing physical copies of the summary, application and application instructions in conspicuous locations within the hospital; and by posting a full, accessible and downloadable version of the application on the hospital's publicly accessible website. 4. It requires that a hospital provide individual written notice of the availability of charity care to each patient. For inpatient services, the notice must be provided upon admission, or in the case of emergency admission before discharge. For outpatient services, individual notice must be included with the patient's bill or at the time service is provided. 5. It requires that a hospital notify a patient who is determined to be eligible for financial assistance if any part of the services provided are not covered by the hospital's financial assistance program. A hospital that fails to provide this notice is prohibited from charging the patient for those services, but is permitted to charge the patient's health insurance carrier for those services. 6. It provides that a hospital must offer, for patients with family incomes that do not exceed 400% of the federal poverty level, a payment plan that requires monthly out-of- pocket payments that do not exceed 3% of the patient's monthly family income that is not exempt from attachment or garnishment under Maine law. 7. It requires hospitals to include on a patient's bill information concerning the process for disputing charges. 8. It requires that hospitals provide an online option for applying for charity care. 9. It requires the department to enforce the provisions of this bill. The department must establish a process to receive patient complaints for hospital noncompliance, conduct reviews of those complaints and require a corrective action when a hospital is found to be noncompliant. 10. It establishes a civil penalty not to exceed $1,000 for hospitals that knowingly or willfully violate the provisions of this bill or engage in a pattern of noncompliance with these provisions. 11. It requires the department to adopt rules by June 30, 2026 to carry out the purposes of this bill. In Committee
LD1955 An Act to Increase Child Care Affordability and Early Childhood Educator Stability This bill does the following. 1. It replaces the early childhood educator workforce salary supplement system with the Salary Sustainability Program for Child Care Professionals. It establishes requirements for the program, requires 5-year assessments and provides funding for the program. 2. It enacts the child care staff scholarship program established as a pilot program in Public Law 2023, chapter 643, Part TT as a permanent program in the Maine Revised Statutes known as the Maine Child Care Affordability Program Child Care Award. 3. It establishes a program of child care provider scholarships for early childhood education or related fields to eligible individuals pursuing associate, bachelor's or graduate degrees or certificates in those fields. 4. It establishes a program of apprenticeships for individuals employed or seeking employment at a licensed child care facility or licensed family child care provider. 5. It requires the State Board of Education to update its plan for career and technical education centers to include opportunities for early childhood education and child care education at career and technical education centers around the State. 6. It requires the Department of Health and Human Services to develop a long-term plan for financial sustainability of the Maine Child Care Affordability Program and submit a report to the Joint Standing Committee on Health and Human Services no later than January 2, 2026. 7. It requires an appropriation of $3,800,000 to the Maine Child Care Affordability Program and a yearly appropriation of $500,000 for wage supplement awards and $1,000,000 to support child care needs. LD896 An Act to Provide Young Children Stable Access to Health Care This bill requires the Department of Health and Human Services to apply, by December 31, 2025, to the federal Department of Health and Human Services, Centers for Medicare and Medicaid Services for a waiver or demonstration project or to amend a pending or current waiver or demonstration project to provide continuous eligibility to a child from birth through 5 years of age who is eligible for and enrolls in the Medicaid program. Upon the approval of such a waiver or demonstration project, it requires the department to adopt rules to establish the continuous eligibility of a child from birth through 5 years of age who is eligible for and enrolls in the Medicaid program, regardless of the child's family's change in income. Continuous eligibility must be maintained through the end of the month in which the child attains 6 years of age, but a child's eligibility to receive continuous coverage must be redetermined or terminated if the child is no longer a resident of the State, the child's parent or legal guardian requests termination of the child's eligibility, the child dies or the department determines that the child's eligibility was erroneously granted at the most recent determination, redetermination or renewal of eligibility because of agency error, fraud, abuse or perjury. LD211 Resolve, Directing the Department of Education to Communicate to School Administrative Units and Private Schools the Importance of Adopting Seizure Action Plans This bill requires school administrative units and approved private schools to employ at least one individual who has met the training requirements necessary to administer or assist in the self-administration of a seizure rescue medication or a medication prescribed to treat seizure disorder symptoms beginning July 1, 2026. The bill also requires that, beginning in the 2026-2027 school year, all school employees subject to professional development must, for a minimum of one hour of self-directed study, review seizure disorder materials. The bill also requires that a student's parent or guardian must provide written authorization for a seizure medication to be administered at school by a school employee or self-administered at school with a school employee's assistance, a written statement from a physician licensed in this State and the prescribed medication in its unopened, sealed package with the label affixed by the dispensing pharmacy intact. A student's parent or guardian must also collaborate with the school to develop a seizure action plan, which must be kept on file in the office of the school nurse or a school administrator and be distributed to a school employee responsible for the supervision or care of the student. The bill also requires a school administrative unit and approved private school to provide age-appropriate seizure education programming to all students beginning in the 2026-2027 school year. Passed

LD1938 An Act Regarding the Regulation of Tobacco This bill modifies provisions of law governing the regulation of cigarettes and other tobacco products as follows. 1. It modifies the provision of law that prohibits smoking in all enclosed areas of public places by eliminating the exception that allows smoking in motel or hotel rooms that are rented to members of the public. 2. It prohibits the sale of tobacco products in vending machines. 3. It increases the penalties for licensing violations for cigarette distributors. 4. It modifies the provisions of law governing the tax on tobacco products by replacing the definition of "electronic smoking device" under current law. The bill clarifies that while components, parts and accessories of the device, including substances intended to be aerosolized or vaporized by using the device, are included in the definition of "electronic smoking device," any separately sold batteries or chargers, or drugs, devices or combination products authorized for sale by the federal Food and Drug Administration, are not included in that definition. The bill provides an effective date of January 5, 2026 for these changes. In Committee

LD82 An Act to Amend the Workers' Compensation Laws by Extending Indefinitely the Presumption Applying to Law Enforcement Officers, Corrections Officers, E-9-1-1 Dispatchers, Firefighters and Emergency Medical Services Persons Diagnosed with Post-traumatic Stress Disorder Under current law, within the provisions governing entitlement to receive compensation and services under the Maine Workers' Compensation Act of 1992, there is a rebuttable presumption that the condition of post-traumatic stress disorder arose out of and in the course of a worker's employment if that worker is a law enforcement officer, corrections officer, E-9-1-1 dispatcher, firefighter or emergency medical services person diagnosed as having post-traumatic stress disorder that resulted from work stress, as long as certain specified conditions are met. This rebuttable presumption is scheduled to be repealed on October 1, 2025. This bill repeals that repeal, continuing the rebuttable presumption indefinitely. Passed

LD1658 An Act to Preserve and Strengthen the Fund for a Healthy Maine This bill, beginning January 5, 2026, increases the cigarette excise tax rate by 50 mills, changing the rate per pack of 20 cigarettes from $2 to $3, and the rate per cigarette from 10¢ to 15¢. Under current law, when the cigarette tax increases, the tax on tobacco products also increases by an equivalent amount. The bill includes in the excise tax on tobacco products that equivalent increase and specifies that the definition of "tobacco products" includes products with synthetic nicotine. The bill also, beginning in fiscal year 2027-28, requires the State Tax Assessor and the State Controller to annually determine the amount of revenue from the taxes on cigarettes and tobacco products that is needed to ensure the Fund for a Healthy Maine receives at least $65,000,000 annually from all sources of revenue, including from the so-called tobacco settlement and from certain slot machine income. LD1572 An Act Regarding Prosecution Standards for Nonfatal Strangulation or Suffocation in Domestic Violence Cases This bill establishes prosecution standards for nonfatal strangulation or suffocation in domestic assault criminal matters. It: 1. Prohibits the victim, victim's family or victim's dating partner from being able to post bail for the defendant; 2. Allows statements made by the victim during the investigation or preparation for prosecution to be admitted in court without the presence of the victim being required; 3. Prohibits the court from dismissing or allowing unnecessary delay of the disposition of the matter; 4. Prohibits the prosecutor from dismissing, allowing unnecessary delay, deferring or agreeing to a plea of a lesser assault charge; 5. Prohibits a defendant previously convicted of a domestic violence assault charge from entering into a plea agreement; 6. Requires prosecutors, judges, justices, law enforcement officers, defense attorneys and dispatchers to receive training on nonfatal strangulation or suffocation prevention; and 7. Makes domestic violence aggravated assault by means of nonfatal strangulation or suffocation a Class A crime. In Committee

That edible adult use cannabis products that are gummies must be blister packaged; and 4. For the establishment of a study group to examine youth consumption of medical use and adult use cannabis, including a study of data related to cannabis use of people under 21 years of age in the State, science concerning the effects of the use of cannabis on youth development and overall health, strategies to improve the quality, availability and transparency of data concerning cannabis use by people under 21 years of age in the State and an approach to regularly report to the Legislature on youth consumption of cannabis. LD1379 An Act to Require Public Health Warnings to Be Posted and Provided by Firearm Dealers and Gunsmiths This bill requires firearm dealers and gunsmiths to post public health warning signs on their business premises and provide public health warning brochures to purchasers and transferees of firearms stating the significant risk of firearms to public health and safety and that access to firearms increases the risk of suicide, domestic violence fatalities and unintentional deaths, particularly among children. The bill authorizes the Department of Health and Human Services to enforce these provisions and to develop standardized public health warning signs and brochures. In Committee
LD808 An Act to Require School Boards and Governing Bodies of Approved Private Schools to Implement Wearable Panic Alert Systems This bill requires, beginning with the 2026-2027 school year, a school board or a governing body of an approved private school to implement at each school building a wearable panic alert system that is capable of integrating with local public safety answering point infrastructure to transmit a 9-1-1 call and initiating a campuswide lockdown notification. It directs a school board or a governing body of an approved private school to provide each staff person in a school building with a wearable panic alert device and training on the use of the device. It requires each school board and approved private school governing body to ensure that all security data within a school building are accessible by a local law enforcement agency.
