LD470 Resolve, Directing the Department of Education to Review Teacher Mentoring Programs in Maine Public Schools This bill requires the Department of Education to develop peer support and teacher mentoring programs to be adopted by school administrative units. A school administrative unit may develop its own peer support and teacher mentoring program and submit the program to the department for approval. A peer support and teacher mentoring program must include a $5,000 stipend per school year for mentoring teachers for each teacher they mentor, plans to train mentoring teachers and to provide support for and regular engagement with teachers required to be mentored and regular professional development for mentoring teachers to improve their mentoring abilities. Mentoring teachers must be selected from a list provided by or in consultation with a local teacher's association and must have held a teacher certificate in the State for at least 5 years. All peer support and teacher mentoring programs must be reviewed by the department every 7 years. The Commissioner of Education may waive the requirement for a teacher to be mentored for no more than one year if the school administrative unit has demonstrated that the requirements of the peer support and teacher mentoring program would result in the school administrative unit being unable to operate. School administrative units without a peer support and teacher mentoring program may not hire conditionally certified teachers or teachers holding emergency teacher certificates. The legislation goes into effect July 1, 2026. Passed
LD697 An Act to Direct the Maine Prescription Drug Affordability Board to Assess Strategies to Reduce Prescription Drug Costs and to Take Steps to Implement Reference-based Pricing This bill makes the following changes to the laws governing the Maine Prescription Drug Affordability Board. 1. It adds to the board the executive director of the Maine Health Data Organization, or the executive director's designee, as an ex officio, nonvoting member. 2. It removes the authority of the board to recommend that public payors pay an annual assessment to support the administration of the board. 3. It changes the scope of the duties of the board from determining prescription drug spending targets to focusing on an assessment of strategies to reduce prescription drug costs, reduce the rate of growth in prescription drug spending and reduce cost barriers for consumers. 4. It requires the board to review how states with authority to establish upper payment limits have implemented that authority and their regulation of pharmacy benefits managers, to recommend whether the board should have comparable authority and to assess implementing reference-based pricing for the first 10 prescription drugs for which the Medicare program has negotiated maximum fair prices through the Medicare drug price negotiation program. 5. It requires the board to recommend annual spending targets for prescription drugs for public payors and implementing complementary purchasing strategies; annual spending targets and strategies for the commercial insurance market; transparency requirements and supply chain regulation; strategies to reduce out-of-pocket costs through insurance regulation; and aligning prescription drug payment with acquisition costs. The bill also directs the board to recommend a program to reduce the impact of prescription drug costs on the State's health care system, stem the rate of growth in prescription drug spending and reduce cost barriers for consumers based on data the board has collected. The board is directed to submit in reports to the joint standing committee of the Legislature having jurisdiction over health coverage, insurance and financial services matters a preliminary plan to implement the program by January 30, 2026 and a final plan by October 1, 2027. The joint standing committee is authorized to report out legislation based on the reports. Passed
LD870 An Act Regarding the Membership of the Maine Land Use Planning Commission This bill amends the membership of the Maine Land Use Planning Commission by increasing the number of members from 9 to 13, with the Governor appointing the additional members. The bill also adds qualifications to be considered by the Governor and boards of county commissioners when appointing members to the commission and provides a membership term limit of 2 consecutive 4-year terms. The bill also requires the Secretary of State to include information about the members of the commission in its annual report on board appointments, including information on the date of expiration of the term of each member and the authority responsible for appointments or reappointments. LD957 An Act to Integrate Asian American, Native Hawaiian and Pacific Islander History into the Statewide System of Learning Results This bill includes instruction on Asian American, Native Hawaiian and Pacific Islander history in the Department of Education's required units of instruction on American history and Maine studies. The bill requires the department to convene a volunteer advisory committee to collect information and prepare materials for teaching Asian American, Native Hawaiian and Pacific Islander history and to develop and provide guidance, best practices and exemplar modules to local school administrative units to integrate Asian American, Native Hawaiian and Pacific Islander history into their curriculum. The bill also requires the department to develop a process to enable a local school administrative unit to conduct an internal audit of its curriculum to ensure an equitable representation of Asian American, Native Hawaiian and Pacific Islander voices and an accurate historical account of Asian American, Native Hawaiian and Pacific Islander history and culture. The bill also requires the department to submit a report on the progress of the implementation of this legislation to the Joint Standing Committee on Education and Cultural Affairs no later than April 1, 2030. LD1141 An Act to Increase the Procurement of Maine Foods by Certain State Institutions This bill clarifies existing state policy governing food procurement by state institutions to require rather than encourage the procurement of Maine foods and food products by state institutions. The bill requires the Commissioner of Agriculture, Conservation and Forestry to implement and promote a Maine foods and food products procurement program that consolidates food commodity purchases by centralizing the control and purchase of food to stabilize state institution food budgets. The program must allow state institutions to take advantage of opportunity buying, coordinate dietary requirements and establish healthy menus consistently throughout state institutions. The bill creates a definition for "opportunity buying," which is defined as the purchasing of food and food products from vendors at a significant discount that is only available for a short period of time before the food or food products become unavailable for purchase. The bill also requires that the program measurably improve the quality and reduce the cost of food and food products for state institutions. Current law requires the Commissioner of Agriculture, Conservation and Forestry to establish a Maine foods and food products procurement program with the goal that 20% of food procured by state institutions is Maine food and food products. The bill adjusts the program goal with a requirement that, by 2030, that percentage must be 30%. The bill also requires the commissioner to designate an employee of the department as an institutional food procurement coordinator to coordinate food procurement for all state institutions and to implement and oversee a strategy to strengthen connections between Maine food producers, distributors and other institutional stakeholders outside of State Government to achieve the procurement goal established. The bill gives permission for the State to engage in off-contract purchasing, outlines requirements for the convening of an annual meeting and an advisory committee to assist the coordinator in advancing strategies for increasing purchases of Maine foods and food products by state institutions and requires the inclusion of the progress toward the procurement goal in the commissioner's biennial report. LD1187 An Act to Include Certain Mental Health Data in Firearm Fatalities and Hospitalizations Reports This bill adds to the categories of uniform crime reports that all law enforcement agencies are required to submit to the Department of Public Safety, Bureau of State Police, State Bureau of Identification to require the reporting of the number of mental health referrals made pursuant to the extreme risk protection order statutes and the number of individuals who received services pursuant to those referrals. LD1738 An Act to Establish the Biohazard Waste Disposal Grant Program to Support Public Health Efforts in the State This bill establishes the Biohazard Waste Disposal Grant Program within the Department of Health and Human Services, Maine Center for Disease Control and Prevention. The purpose of the program is to disseminate grant funds to community organizations seeking to develop or enhance community hypodermic apparatus mitigation and disposal efforts. LD1955 An Act to Increase Child Care Affordability and Early Childhood Educator Stability This bill does the following. 1. It replaces the early childhood educator workforce salary supplement system with the Salary Sustainability Program for Child Care Professionals. It establishes requirements for the program, requires 5-year assessments and provides funding for the program. 2. It enacts the child care staff scholarship program established as a pilot program in Public Law 2023, chapter 643, Part TT as a permanent program in the Maine Revised Statutes known as the Maine Child Care Affordability Program Child Care Award. 3. It establishes a program of child care provider scholarships for early childhood education or related fields to eligible individuals pursuing associate, bachelor's or graduate degrees or certificates in those fields. 4. It establishes a program of apprenticeships for individuals employed or seeking employment at a licensed child care facility or licensed family child care provider. 5. It requires the State Board of Education to update its plan for career and technical education centers to include opportunities for early childhood education and child care education at career and technical education centers around the State. 6. It requires the Department of Health and Human Services to develop a long-term plan for financial sustainability of the Maine Child Care Affordability Program and submit a report to the Joint Standing Committee on Health and Human Services no later than January 2, 2026. 7. It requires an appropriation of $3,800,000 to the Maine Child Care Affordability Program and a yearly appropriation of $500,000 for wage supplement awards and $1,000,000 to support child care needs. LD1859 An Act to Improve Access to Child Care and Early Childhood Education by Establishing Regional Resource Hubs This bill directs the Department of Health and Human Services to establish, through contracts with community entities, early childhood learning and development resource hubs. The resource hubs must provide families with the information and support necessary to locate early childhood programs; assist families in connecting with other resources in the State; support the training of child care workers; and build networks among child care providers. The bill requires the department, beginning January 1, 2027 and annually thereafter, to submit a report to the joint standing committees of the Legislature having jurisdiction over health and human services matters and education and cultural affairs and to the members of the Children's Cabinet and its advisory council regarding the status of state and regional early childhood education and family needs, data collected by resource hubs and any related recommendations to increase access to early childhood services. The bill provides $471,087 in funds in fiscal year 2025-26 and $1,621,048 in fiscal year 2026-27 to support the purposes of the resource hubs. Passed
LD1957 An Act to Promote Film Production in Maine This bill repeals the law governing the certified visual media production tax credit. It increases reimbursements under the laws governing the visual media production reimbursement and places limits on those reimbursements. It changes the definition of "visual media production expense" and requires an applicant for a visual media production certificate to agree to withhold a percentage of payments made to an entity created to hire out the services of one individual. It prohibits the Department of Health and Human Services from adopting any rule reducing or otherwise restricting maximum levels of municipal general assistance for providing emergency shelter or any rule establishing maximum time periods for eligibility for emergency housing assistance that are more restrictive than limits established in the laws governing municipal general assistance. LD1728 An Act to Establish the Maine Child Care Affordability Program Advisory Board The bill establishes the Maine Child Care Affordability Program Advisory Board to advise the Department of Health and Human Services, Office of Child and Family Services on the Maine Child Care Affordability Program, including any program changes. The board consists of 5 members, with the legislative member serving a 2-year term, and the remaining 4 members serving 3-year terms. The board must meet at least quarterly and submit an annual report to the joint standing committee of the Legislature having jurisdiction over health and human services matters on its activities and with its recommendations. The joint standing committee of the Legislature having jurisdiction over health and human services matters is authorized to report out legislation in the year in which the report is submitted. The bill requires the Office of Child and Family Services to amend its rule Chapter 6: Child Care Affordability Program Rules, to add child care employees who qualify for the program to be included in the families who are prioritized when there is a waiting list for the program. The bill requires the Department of Health and Human Services together with the Maine Child Care Affordability Program Advisory Board to develop a long-term plan for financial sustainability of the Maine Child Care Affordability Program and submit the report to the Joint Standing Committee on Health and Human Services no later than January 2, 2026. LD1983 An Act to Protect Minors from Intoxicating Hemp-derived Products by Regulating Those Products Under the Adult Use Cannabis Laws This bill makes the following changes to the cannabis laws regarding the regulation of intoxicating hemp-derived products. 1. It amends the definition of "hemp" in the Maine Revised Statutes, Title 7, section 2231 to exclude intoxicating hemp-derived products. 2. It defines in Title 7, section 2231 "hemp product," "intoxicating hemp-derived product" and "total tetrahydrocannabinol" and distinguishes hemp products from intoxicating hemp-derived products for the purposes of tracking and regulating intoxicating hemp-derived products as adult use cannabis under Title 28-B, chapter 1. 3. It amends Title 28-A to prohibit the sale of intoxicating hemp-derived products by liquor licensees and creates a penalty for liquor licensees found to be in violation of that prohibition. 4. It amends the definitions of "cannabis," "cannabis concentrate" and "cannabis product" to include intoxicating hemp-derived products and defines "intoxicating hemp- derived product" in Title 28-B, chapter 1. 5. It permits a products manufacturing facility licensee to accept transfers of intoxicating hemp-derived products from outside the adult use cannabis program for testing, tracking, packaging, labeling and sale within the adult use cannabis program. 6. It provides for the taxation of intoxicating hemp-derived products and applies a tax of 20% of the cost price of any intoxicating hemp-derived products sold wholesale to adult use cannabis establishments or sold to a consumer. LD1177 Resolve, to Study the Public Health and Environmental Risks from Synthetic Turf This resolve puts a 3-year moratorium on the installation or reinstallation of synthetic turf in any park, outdoor playing field or athletic field, indoor athletic facility or similar venue. It directs the Department of Environmental Protection to examine whether synthetic turf is a risk to public health, the surrounding environment and the climate emissions goals of the State as compared to turf and, if it is a risk, the ways in which synthetic turf is a risk. It directs the department to submit, no later than November 4, 2026, a report that includes its findings and recommendations, including suggested legislation, for presentation to the 133rd Legislature in 2027. The department is also directed to conduct an outreach program to inform local governments, civic organizations, schools and the public regarding the findings of the report. Passed
LD1261 Resolve, to Establish the Community Navigator Pilot Program to Support At-risk Families This bill establishes a 2-year pilot program in the Department of Health and Human Services to award contracts to 4 child abuse and neglect prevention councils in this State for a community navigator position within each council. The bill requires community navigators to work with families who have been reported to the department for suspected child abuse or neglect but have been determined by the department to not meet the criteria for a child protective services investigation. Community navigators are required to help connect these families with community services as needed. Under the bill, community navigators are required to provide outreach and education to mandated reporters of suspected child abuse or neglect to enhance their knowledge of available community services for families and how to connect families with those services. The educational outreach must also provide mandated reporters with guidelines for working directly with families in need to help shift the role of mandated reporters from just reporting suspected child abuse or neglect to actively supporting families in need. The bill requires the department to provide funding for the community navigators in the amount of $90,000 per position, per year, for both year one and year 2 of the pilot program. The department must determine to which child abuse and neglect councils the contracts are awarded based on which child abuse and neglect prevention councils are most prepared to participate in the pilot program. LD1746 An Act to Reduce Dental Disease and Ensure Access to Essential Preventive Dental Care Among Maine Children This bill does the following. 1. It delays the requirement for oral health services to be available in all schools from January 1, 2025 to January 1, 2027 and clarifies that the requirement applies only to public schools. 2. It requires the Department of Health and Human Services to develop public-private partnerships to establish a model to provide for mobile dental services providers to provide additional preventive oral health and disease intervention services in schools based on the model in the Cumberland County School Oral Health Project. It requires the department to provide for at least one mobile dental services provider in each public health district per school year. 3. It requires the Department of Health and Human Services to provide training and education to primary care providers on minimally invasive dental disease treatment for infants and small children using guidance from the From the First Tooth program or its successor program and the American Academy of Pediatrics. Pediatricians are encouraged to use silver diamine fluoride in primary care settings to reduce dental disease and prevent cavities. 4. It makes permanent 2 previously established limited positions related to provided oral health services in public schools within the Department of Health and Human Services, Maine Center for Disease Control and Prevention. LD1847 An Act to Institute Testing and Tracking of Medical Use Cannabis and Cannabis Products Similar to Adult Use Cannabis and Cannabis Products, Dedicate a Portion of the Adult Use Cannabis Sales and Excise Tax to Medical Use Cannabis Programs and Create a Study Group This bill provides: 1. For the same testing and tracking provisions that are applied for adult use cannabis and adult use cannabis products to be applied for medical use cannabis and medical use cannabis products; 2. A requirement that a portion of the adult use cannabis and adult use cannabis products excise and sales tax must be used to fund public health and safety campaigns related to the sale and use of medical use cannabis and medical use cannabis products; 3. That edible adult use cannabis products that are gummies must be blister packaged; and 4. For the establishment of a study group to examine youth consumption of medical use and adult use cannabis, including a study of data related to cannabis use of people under 21 years of age in the State, science concerning the effects of the use of cannabis on youth development and overall health, strategies to improve the quality, availability and transparency of data concerning cannabis use by people under 21 years of age in the State and an approach to regularly report to the Legislature on youth consumption of cannabis. LD1843 An Act to Provide Peer Respite for Individuals with Mental Health Care Needs This bill requires the Department of Health and Human Services to provide peer respite services and establish a peer respite center. The center must provide 24-hour peer respite services to individuals 18 years of age or older in need of voluntary, short-term mental health services. Passed
LD1647 An Act to Amend the Maine Human Rights Act to Provide Additional Remedies for Educational Discrimination This bill modifies provisions of the Maine Human Rights Act to allow a court to award compensatory damages in cases of intentional educational discrimination. Compensatory damages include damages for loss of education, loss of educational opportunity, past and future pecuniary losses, emotional pain, suffering, inconvenience, mental anguish, loss of enjoyment of life and other nonpecuniary losses. The bill specifies that these compensatory damages are not available in cases when the discriminatory practice involves the provision of a reasonable accommodation and the educational institution had demonstrated good faith efforts, in consultation with the person with the disability, to make a reasonable accommodation that would provide that individual with an equally effective opportunity and would not cause undue hardship on the operation of the educational institution. Compensatory damages are not available in cases in which the practice was unlawful only because of its disparate impact. The bill also adds language that excludes cases of intentional educational discrimination from the existing limited monetary remedy available for unlawful discrimination under the Maine Human Rights Act. LD1658 An Act to Preserve and Strengthen the Fund for a Healthy Maine This bill, beginning January 5, 2026, increases the cigarette excise tax rate by 50 mills, changing the rate per pack of 20 cigarettes from $2 to $3, and the rate per cigarette from 10¢ to 15¢. Under current law, when the cigarette tax increases, the tax on tobacco products also increases by an equivalent amount. The bill includes in the excise tax on tobacco products that equivalent increase and specifies that the definition of "tobacco products" includes products with synthetic nicotine. The bill also, beginning in fiscal year 2027-28, requires the State Tax Assessor and the State Controller to annually determine the amount of revenue from the taxes on cigarettes and tobacco products that is needed to ensure the Fund for a Healthy Maine receives at least $65,000,000 annually from all sources of revenue, including from the so-called tobacco settlement and from certain slot machine income. LD1665 An Act to Provide Property Tax Relief to Maine Families This bill amends the property tax fairness credit, for tax years beginning in 2025 or later by increasing the benefit base as follows: 1. For individuals filing as a head of household who have one child or dependent or for married individuals filing joint returns who have one child or dependent, the benefit base is increased to $3,250; 2. For individuals filing as a head of household who have more than one child or dependent or for married persons who have more than one child or dependent, the benefit base is increased to $4,000; and 3. For individuals 65 years of age or older, the benefit base is increased to $4,250. This bill also increases the maximum credit for an individual filing as a head of household or filing a joint return and who has a child or dependent to $2,000. This bill also requires the Department of Administrative and Financial Services, Bureau of Revenue Services to convene a working group to study the property tax fairness credit and make recommendations for how to make the credit easier to understand and simplify the process for applying for the credit. The working group consists of advocates for low-income and elderly individuals and municipal governments. Passed

LD896 An Act to Provide Young Children Stable Access to Health Care This bill requires the Department of Health and Human Services to apply, by December 31, 2025, to the federal Department of Health and Human Services, Centers for Medicare and Medicaid Services for a waiver or demonstration project or to amend a pending or current waiver or demonstration project to provide continuous eligibility to a child from birth through 5 years of age who is eligible for and enrolls in the Medicaid program. Upon the approval of such a waiver or demonstration project, it requires the department to adopt rules to establish the continuous eligibility of a child from birth through 5 years of age who is eligible for and enrolls in the Medicaid program, regardless of the child's family's change in income. Continuous eligibility must be maintained through the end of the month in which the child attains 6 years of age, but a child's eligibility to receive continuous coverage must be redetermined or terminated if the child is no longer a resident of the State, the child's parent or legal guardian requests termination of the child's eligibility, the child dies or the department determines that the child's eligibility was erroneously granted at the most recent determination, redetermination or renewal of eligibility because of agency error, fraud, abuse or perjury. LD943 An Act to Require the ASPIRE-TANF Program to Be Administered by State Employees This bill requires the Department of Health and Human Services to administer the Additional Support for People in Retraining and Employment - Temporary Assistance for Needy Families program, also known as the ASPIRE-TANF program, with department employees and provides for the phasing out of contracted public and private agencies providing program services by December 31, 2026, except for certain service delivery functions including job training and education, employment support, child care assistance and transportation assistance. The bill also requires the department to submit an annual report to the Legislature detailing the staffing and participant outcomes of the program and the challenges and successes of administering the program. It replaces provisions of law that currently provide that payments to couples, both of whom receive the supplement, are 150% of the benefit for an individual with provisions of law providing that payments to the couples are 200% of the benefit for an individual. 2. It requires that the standard used to determine need is the current annual budget at the lower level of living for an individual as most recently determined by the United States Department of Labor, Bureau of Labor Statistics, for Portland, Maine, or budgets consistent with such a budget taking into account budget variances by living arrangements permitted pursuant to Title XVI of the United States Social Security Act. 3. It establishes that, in determining any increase according to the United States Consumer Price Index, consideration must be given to the goal of reaching, within a reasonable time, a benefit level equal to or consistent with the current budget at the lower level of living for an individual, rather than a retired couple, established by the United States Department of Labor, Bureau of Labor Statistics, for Portland, Maine. LD834 An Act to Update the State Supplement to Supplemental Security Income This bill amends the 1974 State Supplemental Income Act in the following ways. 1. It changes the minimum state supplemental income benefit from $8 per month for an individual and $12 per month for a couple to $65 per month for an individual and an amount per couple that is consistent with the amount provided to an individual and to a couple under current law, which requires benefits for a couple to be 150% of the benefit for an individual, making the new amount $97.50 per month for a couple. 2. It provides that, starting October 1, 2026, the state supplemental income benefit must be annually increased by the cost-of-living adjustment to the federal payment standard. 3. It provides that, in the priority sequence by which the Department of Health and Human Services must budget and authorize for expenditure appropriations available for benefits, the cost-of-living adjustment must have priority immediately after the minimum payment. 4. It updates the declared intent of the Act to provide that, if it is proposed that benefits provided are to be increased on any future date, cost-of-living adjustments be included in the benefits to be increased rather than increasing the benefits provided to a beneficiary who resides in certain living arrangements. 5. It requires the Department of Health and Human Services to ensure that eligible individuals residing in nursing homes have a monthly amount for personal needs equal to at least 3 times the amount of the state supplemental income benefit. Provides an additional 25% reduction in property taxes to open space land for which an approved wildlife habitat management plan or forest climate resilience and carbon management plan has been completed.
