LD846 An Act to Protect Natural Resources by Clarifying Hydropower Dam Removal Requirements This bill amends the laws regulating permits for hydropower projects to include the following provisions applicable to the removal of an existing dam that is part of a hydropower project. 1. An applicant for a permit to remove an existing dam must propose removal of the entire dam structure and not just a portion of an existing dam. 2. If any portion of the dam structure is located on land owned by a municipality or other government entity, the applicant must demonstrate to the satisfaction of the Department of Environmental Protection or Maine Land Use Planning Commission, as applicable, that the municipality or entity has approved the removal of that portion of the dam structure. 3. If the removal of the dam is expected to result in the alteration of water levels in the body of water from which the dam is removed, the department or Maine Land Use Planning Commission, as applicable, must require as a permit condition that prior to dam removal, the applicant identify all landowners expected to be affected by that alteration of water levels and set aside sufficient funds for reimbursing those landowners for the corresponding loss in property value following dam removal. LD1528 An Act to Support Farmland Conservation This bill establishes a separate nonlapsing, interest-bearing account administered by the Department of Agriculture, Conservation and Forestry to support public-private partnerships to carry out the purposes of the Maine Working Farmland Access and Protection Program. The account consists of money appropriated or allocated to the program account by the Legislature or received from any private or public source. The bill establishes and provides ongoing funding for one full-time, permanent position within the Department of Agriculture, Conservation and Forestry, Bureau of Agriculture, Food and Rural Resources. The bill also transfers $1,000,000 from the unappropriated surplus of the General Fund to fund farmland conservation efforts under the Department of Agriculture, Conservation and Forestry, Bureau of Agriculture, Food and Rural Resources, Maine Working Farmland Access and Protection Program. LD924 Resolve, Directing the Judicial Branch to Authorize the Lease of a Courthouse That Meets Accessibility and Functional Needs in the Town of Newport This resolve directs the judicial branch to enter into a long-term lease agreement for a new courthouse facility in Newport. The leased facility must comply with the federal Americans with Disabilities Act of 1990 and the public accommodations provisions of the Maine Human Rights Act and include adequate space for courtroom operations. The resolve requires the judicial branch to dedicate up to $200,000 from the judicial branch's existing resources for maintenance and repair. LD921 An Act to Expand Use of Electronic Proceedings in the Judicial Branch This bill requires that certain categories of hearings and other judicial proceedings in the District Court, Superior Court and Supreme Judicial Court be conducted by electronic means absent a finding that conducting the proceeding by electronic means is inappropriate because it would result in a deprivation of due process, fairness or justice. This requirement does not apply to criminal trials or to civil jury trials requiring the presentation of evidence absent the approval of the court and consent of each party to the proceeding. The bill also requires the court to provide reasonable accommodations to individuals with limited access to the technology required to participate by electronic means as well as individuals with disabilities that limit the individuals' ability to fully participate by electronic means. The bill recognizes the authority of the Supreme Judicial Court to adopt rules and issue orders to implement the provisions of this legislation. It further directs the Supreme Judicial Court to submit an annual report to the joint standing committee of the Legislature having jurisdiction over judiciary matters regarding the conduct of hearings and other judicial proceedings by electronic means in state courts. The bill also requires the Supreme Judicial Court to submit a report by December 3, 2025 to the Joint Standing Committee on Judiciary detailing the provisions rendered of no effect due to the bill's provisions. LD1762 An Act to Protect Recreational Trails by Establishing the Trails for the Future Program This bill creates the Trails for the Future Fund and the Trails for the Future Program to protect public access to established recreational trails, including snowmobile trails and all-terrain vehicle, or ATV, trails, through the acquisition of property and the establishment of easements. The bill requires that an acquisition or grant made pursuant to the program is subject to the requirement that the recreational trail on the property may not be altered or developed in a manner that precludes its existing use, including use by a snowmobile or by an ATV, if applicable. The bill also requires that any change to the access or layout of a recreational trail protected pursuant to the program must be approved by the snowmobile club, ATV club or another club or group that maintains the recreational trail. If no club or group is responsible for maintaining the recreational trail the proposed changes must be approved by the Commissioner of Agriculture, Conservation and Forestry. Dead
