The credit is equal to 30% of the cost of the qualifying working waterfront disaster mitigation project but may not exceed $300,000. LD229 An Act to Bring Fairness in Income Taxes to Maine Families by Adjusting the Tax Brackets and Tax Rates This bill changes, beginning in 2026, the current income tax brackets by increasing the threshold amount of income subject to the current tax rates of 5.8%, 6.75% and 7.15%. The bill adds 3 new income tax brackets and imposes tax rates of 7.52%, 7.15% and 8.2% in those new brackets. LD1232 An Act to Require Radon Testing for Certain Commercial and Residential Construction This bill requires a radon permit for new commercial and residential construction and for improvements or alterations to a commercial structure requiring a building permit. A person registered by the Department of Health and Human Services to test radon must apply for the permit and conduct testing, and if it is determined that radon mitigation measures are required, the person designing and installing the radon mitigation measures must be registered by the department. Residential construction in a municipality without a building code or performed by a homeowner acting as a general contractor and who performs more than 50% of the framing and finishing of the structure are exempt from the permit requirements. LD1112 RESOLUTION, Proposing an Amendment to the Constitution of Maine Requiring Not Less Than 90 Percent State Reimbursement for Residential Real Estate Property Tax Exemptions and to Establish a Minimum Homestead Exemption This resolution proposes to amend the Constitution of Maine to require the Legislature to reimburse municipalities for not less than 90% of the lost property tax revenue associated with residential real estate exemptions extended to veterans of the Armed Forces of the United States and persons who are legally blind and for qualifying homesteads of permanent residents of this State. The resolution also establishes the minimum homestead exemption at $50,000, which must be adjusted annually by the percentage change in the consumer price index, or similar inflationary index. The resolution also provides that, at a minimum, no less than 5% of state sales and income tax revenues must be shared with municipalities and protects future increases in the percentage of state sales and income tax revenues distributed to municipalities. LD1914 An Act to Address Housing Density Requirements in Sole Source Aquifer Island and Peninsular Communities This bill establishes an exemption from the Maine Revised Statutes, Title 30-A, sections 4364 to 4364-C for municipalities that are located wholly or partially on an island or peninsula and rely on a primary drinking water supply derived from a sole source aquifer. The bill provides that such a municipality is exempt from these provisions until a licensed geologist has analyzed the groundwater and septic capacity within the municipality or a particular area within the municipality and determined that it can support an increase in housing density. If the licensed geologist determines in the geologist's evaluation report that the area can support an increase in housing, the municipality is required to comply with the provisions of Title 30-A, sections 4364 to 4364-C, to the extent that the licensed geologist determines the area can support the increase. If the geologist's evaluation report indicates the area cannot support an increase in housing density, the municipality is exempt from Title 30-A, sections 4364 to 4364-C. The Department of Economic and Community Development and the Department of Environmental Protection are directed to adopt rules to implement this legislation. The Department of Environmental Protection has rule-making authority limited to establishing criteria by which municipalities may select a licensed geologist and other rules necessary to perform the geological evaluation required under this legislation. LD1929 An Act to Improve Public Utility Service by Addressing Seasonal Property Hazards This bill requires the owner of a seasonal residential dwelling to conduct inspections at least annually to identify and address potential hazards such as overgrown trees or damaged utility lines; arrange for services of a caretaker or responsible person during a period when the seasonal residential dwelling is unoccupied to ensure the timely resolution of public utility-related issues; and provide contact information for the caretaker or responsible person to each public utility to which the seasonal residential dwelling is connected and to the municipality in which the seasonal residential dwelling is located. It requires the Public Utilities Commission to establish a statewide system to allow persons and public utilities to report hazards related to seasonal residential dwellings; conduct a public education campaign to raise awareness among owners of seasonal residential dwellings regarding the impact of seasonal residential dwellings on public utilities and the importance of regular maintenance; and provide financial assistance to low-income owners of seasonal residential dwellings to help them comply with the requirements of the bill. It requires a public utility to maintain a list containing contact information for caretakers and responsible persons for seasonal residential dwellings; develop protocols regarding repairs on portions of a utility line affected by hazards related to seasonal residential dwellings with a focus on minimizing disruptions to residential dwellings that are occupied at the time of the repairs and prioritizing residential dwellings that are occupied at the time of the repairs in storm restoration efforts; and conduct inspections at least annually of portions of a utility line with a history of outages, particularly those with a history of issues related to seasonal residential dwellings. LD1885 An Act to Create a State Property Tax Directed Toward 2nd Homes for the Purposes of Funding Education, Early Childhood Programs and the Land for Maine's Future Trust Fund This bill creates the statewide property tax to impose a tax of 5 mills of the assessed value of real estate that is not exempt from taxation. This bill also establishes an exemption from the statewide property tax of the just value up to $1,000,000 for homesteads that are eligible for the Maine homestead property tax exemption, including being occupied by a permanent resident of the State as that person's permanent residence. The statewide property tax exemption applies only to the taxes assessed for the statewide property tax. The State Tax Assessor is directed to administer the statewide property tax in the same manner and under the same constraints as currently done for real property in the unorganized territory. The bill also creates 2 new funds, the Fund for Essential Programs and Services and the Early Childhood Education Fund. The Fund for Essential Programs and Services receives 50% of the revenue from the statewide property tax, which must be used to provide funds to school administrative units that do not achieve the annual target for the state share percentage of the statewide adjusted total cost of the components of essential programs and services, if that shortage is the result of a municipality within that school administrative unit having a higher poverty rate than the median poverty rate for the State and a lower median income rate than the median income rate for the State. The Early Childhood Education Fund receives 40% of the revenue from the statewide property tax, which must be used to provide funds for the purpose of expanding or developing early childhood education programs, as determined by the Commissioner of Education. The remaining 10% of revenue is deposited in the Land for Maine's Future Trust Fund. Dead
LD1463 An Act to Prohibit the Auctioning of State Surplus or Forfeited Firearms This bill prohibits the State from offering surplus or forfeited firearms for private or public sale and requires all surplus and forfeited firearms to be destroyed except for firearms that were assigned to a state employee as a part of the employee's official duties, which may be purchased by that employee upon leaving employment. The bill also requires the Director of the Bureau of General Services within the Department of Administrative and Financial Services, with the approval of the Commissioner of Administrative and Financial Services and the Commissioner of Public Safety, to update the rules of the Department of Administrative and Financial Services and the Department of Public Safety relating to the destruction of surplus and forfeited firearms. The revenue from the local option sales tax must be distributed to the municipality imposing the local option sales tax. The distributed revenue must be used in municipal programs for affordable housing in that municipality, including rental assistance for lower income households or moderate income households or to support the costs to municipalities for providing general assistance. Revenue received by a municipality may not be used to reduce or eliminate funding otherwise due the municipality under other provisions of law.
