HB1170 Lobbying by Nonprofit Entities Currently, a lobbyist may be either a professional lobbyist or a volunteer lobbyist. A professional lobbyist must register with the secretary of state before conducting lobbying activities with one or more covered officials. For each month in which a professional lobbyist lobbies one or more covered officials, a professional lobbyist must complete and submit a disclosure statement to the secretary of state. The bill creates a new category of lobbyist for nonprofit lobbyists and exempts nonprofit lobbyists from the registration and disclosure statement requirements for professional lobbyists. A nonprofit lobbyist is a lobbyist who is exclusively employed by a single nonprofit entity and who lobbies as an incidental part of the lobbyist's duties with the nonprofit entity. A nonprofit entity may use a nonprofit lobbyist to lobby a maximum of 30 days during a state fiscal year, with a maximum of 20 of those days occurring when the general assembly is in session. A nonprofit entity that employs a nonprofit lobbyist must report to the secretary of state the following information within 72 hours of engaging in lobbying of one or more covered officials: ! The name of the nonprofit lobbyist; ! The full legal name of the nonprofit entity on whose behalf the nonprofit lobbyist lobbied; ! The date on which the nonprofit lobbyist engaged in lobbying; ! Any matter about which the nonprofit lobbyist lobbied for the reported day; and ! The bill number of the legislation about which each nonprofit lobbyist lobbied for the reported day and whether the nonprofit entity is supporting, opposing, requesting amendments, or monitoring the legislation. A nonprofit entity may submit a single form for more than one nonprofit lobbyist if more than one nonprofit lobbyist lobbied for the nonprofit entity on the same day. A lobbyist who was a nonprofit lobbyist but no longer qualifies as a nonprofit lobbyist or who is employed by a nonprofit entity that does not comply with the timing limitations, and who meets the requirements of a professional lobbyist, must register and file disclosure statements with the secretary of state beginning in the month in which the lobbyist first lobbied as a professional lobbyist and must comply with the regulations imposed on a professional lobbyist. HB1310 Purchasing Transparency Information Technology Procurement Joint Technology Committee. Section 1 of the bill authorizes the joint technology committee to conduct an annual review of all rates that the office of information technology (office) charges when billing users for the office's services. Section 2 requires that budget requests submitted to the joint technology committee include: ! Information and responses from a request for information for any budget request related to a major information technology project; and ! Formal market research for any budget request that is not related to a major information technology project. Section 3 provides that money in the information technology revolving fund, which the office expends to pay the costs of consolidation and information technology maintenance and upgrades, is no longer continuously appropriated to the office and instead is subject to annual appropriation by the general assembly. Section 4 repeals the office's ability to approve procurement contracts related to information technology resources on behalf of state agencies. The office may be a party to a procurement contract related to the procurement of information technology resources for a state agency if the state agency requests that the office be a party to the contract. Section 5 provides that state agencies are not required to obtain approval from the office before commencing work on a major information technology project or planning to make significant changes to the major information technology project or budget, and makes other conforming changes. Section 6 requires certain governmental bodies to issue a request for information prior to awarding a contract related to a major information technology project, and requires that the request for information be submitted to the joint technology committee as part of any budget request related to a major information technology project. Responses to a request for information related to a contract for a major information technology project must be presented to the joint technology committee if requested by the committee, and the committee shall meet in executive session to review the responses. Section 6 also requires certain governmental bodies to conduct market research prior to awarding a contract related to an information technology project that is not a major information technology project, and requires the market research to be submitted to the joint technology committee as part of any budget request related to the project. HB1079 Independent Ethics Commission Jurisdiction Under current law, the independent ethics commission created in article XXIX of the state constitution does not have jurisdiction over officials or employees of special districts or school districts. The bill gives the independent ethics commission jurisdiction to hear complaints, issue findings, assess penalties, and issue advisory opinions on ethics issues concerning a special district official or employee or school district official or employee. However: ! "Officials" include only members of a school district or special district board; ! "School district employee" includes only the superintendent or head administrative officer designated by a school board to execute its policy decisions who is appointed or hired by, directly reports to, and is subject to the direction of the school district board; and ! "Special district employee" includes only an employee of a special district who is appointed or hired by, directly reports to, and is subject to the direction of the special district's board. Existing law establishes ethical standards for a special district official or employee or school district official or employee. The bill incorporates those standards under the independent ethics commission's jurisdiction and expands the standards to include those described in article XXIX of the state constitution. Dead
HB1302 Increase Access Homeowner's Insurance Enterprises The bill creates 2 enterprises in the division of insurance (division) in the department of regulatory agencies. The bill creates the strengthen Colorado homes enterprise (strengthen homes enterprise), which is a state-owned business that imposes and collects a fee from insurance companies (insurers), including the FAIR plan association, that offer homeowner's insurance policies in Colorado, which fee is equal to 1.5% of the dollar amount of the premiums that the insurer collects from homeowners for issuing homeowner's insurance policies (insurer fee). With the insurer fee revenue, the strengthen homes enterprise board administers a grant program (grant program) to strengthen homes against the risk of future damage claims caused by high winds, wildfire, hail, and other extreme weather events (extreme weather events) by allowing a homeowner to use grant money to upgrade their roof system with certain resilient roof materials. By paying the insurer fee to support the grant program to retrofit homes with resilient roofs, insurers reduce their overall risk in the market due to hail and other extreme weather events. The bill also creates the wildfire catastrophe reinsurance enterprise (reinsurance enterprise), which is a state-owned business implementing and administering the wildfire catastrophe reinsurance program (reinsurance program). The reinsurance program makes reinsurance payments to insurers that offer homeowner's insurance on properties located in the state to partially mitigate losses in the event of a state or federally declared wildfire-related disaster (wildfire-related disaster). The purpose of the reinsurance program is to stabilize the homeowner's insurance market in the state and to attract and retain homeowner's insurers. In exchange for access to the reinsurance program, the reinsurance program requires insurers to sell homeowner's insurance in areas of the state that are at high risk for wildfires. To pay for the reinsurance program, the reinsurance enterprise: ! Issues revenue bonds secured by the reinsurance enterprise; ! Issues a catastrophe bond to a person that purchases the bond but pays the principal to cover costs of a wildfire-related disaster if it occurs; ! May impose and collect an insurer fee on insurers to cover a shortfall if a wildfire-related disaster does not occur during the bond term and the reinsurance enterprise has insufficient money to redeem the bonds at maturity; and ! Invests the revenue from the bonds and insurer fees. In addition, the bill sets the loss ratio for homeowner's insurance by presuming that the rates charged to purchasers are excessive if the insurer's loss ratio is less than 75% over a 3-year period and, if rates are in excess of the loss ratio, requires insurers to submit rates that are at least 5% less than the previous year. SB318 Artificial Intelligence Consumer Protections In 2024, the general assembly enacted Senate Bill 24-205, which created consumer protections in interactions with artificial intelligence systems (provisions). The bill amends these provisions by: ! Redefining "algorithmic discrimination" to mean the use of an artificial intelligence system that results in a violation of any applicable local, state, or federal anti-discrimination law; ! Creating an exception to the definition of "developer" of an artificial intelligence system (developer) if a person offers the artificial intelligence system with open model weights or if the person meets specified conditions regarding the artificial intelligence system; ! Exempting specified technologies that do not make, or are not a substantial factor in making, a consequential decision from the definition of "high-risk artificial intelligence system"; ! Eliminating the duty of a developer or deployer of a high-risk artificial intelligence system (deployer) to use reasonable care to protect consumers from any known or reasonably foreseeable risks of algorithmic discrimination; ! Eliminating the requirement that a developer or deployer notify the attorney general of any known or reasonably foreseeable risks of algorithmic discrimination arising from the intended uses of the high-risk artificial intelligence system; ! Exempting a developer from specified disclosure requirements if the developer has received less than $10,000,000 from third-party investors, has annual revenues of less than $5,000,000, and has been actively operating and generating revenue for less than 5 years and sells, distributes, or otherwise makes available to deployers high-risk artificial intelligence systems that do not exceed specified limits on the number of consequential decisions made by the systems; ! Requiring a deployer to include in an impact assessment whether the system poses any known or reasonably foreseeable risks of limiting accessibility for certain individuals, an unfair or deceptive trade practice, a violation of state or federal labor laws, or a violation of the "Colorado Privacy Act"; ! Requiring a deployer to provide additional information to a consumer if the high-risk artificial intelligence system makes, or is a substantial factor in making, a consequential decision concerning the consumer; ! HB1261 Consumers Construction Defect Action In an action against a construction professional, section 2 of the bill requires the construction professional to provide the claimant or the claimant's legal representative with: ! Copies of all plans, specifications, soils reports, and available engineering calculations; ! Any maintenance and preventive maintenance recommendations; ! The name, last-known address, and scope of work of each construction professional that performed work or services; and ! Copies of all insurance policies held by the construction professional during the appropriate time. The construction professional may charge reasonable copying costs for the documents. Failure to provide the identifying information of the other construction professionals bars the construction professional from designating the unidentified construction professionals as nonparties at fault in any subsequent action. Section 3 requires a court to award prejudgement interest of 8% to a prevailing claimant who alleges defects in a residential property construction. Section 5 voids a provision in a real estate contract that: ! Prohibits group lawsuits against a construction professional; or ! Imposes different or additional requirements than the statutory requirements to bring or join a legal action. Section 6 changes the time when a claim of relief arises, for the purposes of the statute of limitation and repose, to include both the discovery of the physical manifestation and the cause of the defect. Current law authorizes, subject to the requirements of the common interest community's (community) declarations, a community to engage in certain actions, such as instituting, defending, or intervening in litigation or administrative proceedings on matters affecting the community. Section 7 exempts an association's authority to institute, defend, or intervene in litigation proceedings concerning construction defects from the requirement that the action be subject to the declaration.
