HB1310 Purchasing Transparency Information Technology Procurement Joint Technology Committee. Section 1 of the bill authorizes the joint technology committee to conduct an annual review of all rates that the office of information technology (office) charges when billing users for the office's services. Section 2 requires that budget requests submitted to the joint technology committee include: ! Information and responses from a request for information for any budget request related to a major information technology project; and ! Formal market research for any budget request that is not related to a major information technology project. Section 3 provides that money in the information technology revolving fund, which the office expends to pay the costs of consolidation and information technology maintenance and upgrades, is no longer continuously appropriated to the office and instead is subject to annual appropriation by the general assembly. Section 4 repeals the office's ability to approve procurement contracts related to information technology resources on behalf of state agencies. The office may be a party to a procurement contract related to the procurement of information technology resources for a state agency if the state agency requests that the office be a party to the contract. Section 5 provides that state agencies are not required to obtain approval from the office before commencing work on a major information technology project or planning to make significant changes to the major information technology project or budget, and makes other conforming changes. Section 6 requires certain governmental bodies to issue a request for information prior to awarding a contract related to a major information technology project, and requires that the request for information be submitted to the joint technology committee as part of any budget request related to a major information technology project. Responses to a request for information related to a contract for a major information technology project must be presented to the joint technology committee if requested by the committee, and the committee shall meet in executive session to review the responses. Section 6 also requires certain governmental bodies to conduct market research prior to awarding a contract related to an information technology project that is not a major information technology project, and requires the market research to be submitted to the joint technology committee as part of any budget request related to the project. SB318 Artificial Intelligence Consumer Protections In 2024, the general assembly enacted Senate Bill 24-205, which created consumer protections in interactions with artificial intelligence systems (provisions). The bill amends these provisions by: ! Redefining "algorithmic discrimination" to mean the use of an artificial intelligence system that results in a violation of any applicable local, state, or federal anti-discrimination law; ! Creating an exception to the definition of "developer" of an artificial intelligence system (developer) if a person offers the artificial intelligence system with open model weights or if the person meets specified conditions regarding the artificial intelligence system; ! Exempting specified technologies that do not make, or are not a substantial factor in making, a consequential decision from the definition of "high-risk artificial intelligence system"; ! Eliminating the duty of a developer or deployer of a high-risk artificial intelligence system (deployer) to use reasonable care to protect consumers from any known or reasonably foreseeable risks of algorithmic discrimination; ! Eliminating the requirement that a developer or deployer notify the attorney general of any known or reasonably foreseeable risks of algorithmic discrimination arising from the intended uses of the high-risk artificial intelligence system; ! Exempting a developer from specified disclosure requirements if the developer has received less than $10,000,000 from third-party investors, has annual revenues of less than $5,000,000, and has been actively operating and generating revenue for less than 5 years and sells, distributes, or otherwise makes available to deployers high-risk artificial intelligence systems that do not exceed specified limits on the number of consequential decisions made by the systems; ! Requiring a deployer to include in an impact assessment whether the system poses any known or reasonably foreseeable risks of limiting accessibility for certain individuals, an unfair or deceptive trade practice, a violation of state or federal labor laws, or a violation of the "Colorado Privacy Act"; ! Requiring a deployer to provide additional information to a consumer if the high-risk artificial intelligence system makes, or is a substantial factor in making, a consequential decision concerning the consumer; ! Amending provisions regarding a consumer's right to appeal an adverse consequential decision concerning the consumer so that the provisions apply only to an adverse consequential decision that is not a time-limited decision or a competitive decision; ! Clarifying the meaning of "adverse" when referring to a consequential decision; ! Broadening an exemption for a deployer from specified disclosure requirements based on the deployer's number of full-time equivalent employees; ! Exempting a deployer from specified requirements if the deployer uses the high-risk artificial intelligence system solely relating to the recruitment, sourcing, or hiring of external candidates for employment, meets specified disclosure requirements, and does not employ more than specified limits on the number of full-time equivalent employees; ! Applying specified requirements only to high-risk artificial intelligence systems that make, or are the principal basis in making, consequential decisions; ! Requiring a developer or deployer that withholds information otherwise subject to disclosure to provide specified information regarding the disclosure; and ! Requiring that the attorney general's authority to investigate and enforce violations of the provisions begins on January 1, 2027. Dead

SB073 Military-Connected Children with Disabilities The bill clarifies the process and timeline for an administrative unit or a state-operated program to provide special education services to a military-connected child with disabilities (child) who transfers from one administrative unit or state-operated program within Colorado to another, or transfers from an out-of-state school district or private school to an administrative unit or a state-operated program within Colorado, as a result of an inbound active duty military member's (member) order to permanently change military stations. For a child who transfers from an administrative unit or state-approved program to a private school within Colorado, or transfers from an out-of-state school district or private school to a private school within Colorado, the administrative unit with jurisdiction over the geographic boundary that the private school is located in shall review the child's evaluation information and existing individualized education program (IEP) or section 504 plan in consultation with the child's member, parent, legal guardian, or custodian. The administrative unit shall determine and provide equitable special education and related services, an IEP, or a section 504 plan to the child enrolled in the private school. For a child who transfers from an out-of-state school district or private school with an individualized family service plan, the administrative unit or the state-operated program shall follow the process to coordinate, in conjunction with the department of early childhood, the transition of the child from an early intervention program for infants and toddlers pursuant to part C of the federal "Individuals with Disabilities Education Act" (IDEA) to a program component to serve children with disabilities from 3 to 21 years of age pursuant to part B of the IDEA. The bill requires an administrative unit, a state-operated program, or an administrative unit with jurisdiction over the geographic boundary that a private school is located in to receive informed consent from the member, parent, legal guardian, or custodian of a child before: ! There are revisions to the child's category of disability; ! There are revisions to the child's IEP or section 504 plan; ! There are changes to the child's eligibility for special education and related services; or ! There is a partial or complete termination of special education and related services, except if the child graduates with a standard or advanced studies diploma. In the event a dispute between an administrative unit or a state-operated program and a member, parent, legal guardian, or custodian of a child results in a due process hearing, the administrative unit or the state-operated program has the burden of proof. HB1261 Consumers Construction Defect Action In an action against a construction professional, section 2 of the bill requires the construction professional to provide the claimant or the claimant's legal representative with: ! Copies of all plans, specifications, soils reports, and available engineering calculations; ! Any maintenance and preventive maintenance recommendations; ! The name, last-known address, and scope of work of each construction professional that performed work or services; and ! Copies of all insurance policies held by the construction professional during the appropriate time. The construction professional may charge reasonable copying costs for the documents. Failure to provide the identifying information of the other construction professionals bars the construction professional from designating the unidentified construction professionals as nonparties at fault in any subsequent action. Section 3 requires a court to award prejudgement interest of 8% to a prevailing claimant who alleges defects in a residential property construction. Section 5 voids a provision in a real estate contract that: ! Prohibits group lawsuits against a construction professional; or ! Imposes different or additional requirements than the statutory requirements to bring or join a legal action. Section 6 changes the time when a claim of relief arises, for the purposes of the statute of limitation and repose, to include both the discovery of the physical manifestation and the cause of the defect. Current law authorizes, subject to the requirements of the common interest community's (community) declarations, a community to engage in certain actions, such as instituting, defending, or intervening in litigation or administrative proceedings on matters affecting the community. Section 7 exempts an association's authority to institute, defend, or intervene in litigation proceedings concerning construction defects from the requirement that the action be subject to the declaration. Section 8 requires the department of regulatory agencies to include in its "SMART Act" report information concerning construction liability insurance and the basis for rates. Dead
