HB1302 Increase Access Homeowner's Insurance Enterprises The bill creates 2 enterprises in the division of insurance (division) in the department of regulatory agencies. The bill creates the strengthen Colorado homes enterprise (strengthen homes enterprise), which is a state-owned business that imposes and collects a fee from insurance companies (insurers), including the FAIR plan association, that offer homeowner's insurance policies in Colorado, which fee is equal to 1.5% of the dollar amount of the premiums that the insurer collects from homeowners for issuing homeowner's insurance policies (insurer fee). With the insurer fee revenue, the strengthen homes enterprise board administers a grant program (grant program) to strengthen homes against the risk of future damage claims caused by high winds, wildfire, hail, and other extreme weather events (extreme weather events) by allowing a homeowner to use grant money to upgrade their roof system with certain resilient roof materials. By paying the insurer fee to support the grant program to retrofit homes with resilient roofs, insurers reduce their overall risk in the market due to hail and other extreme weather events. The bill also creates the wildfire catastrophe reinsurance enterprise (reinsurance enterprise), which is a state-owned business implementing and administering the wildfire catastrophe reinsurance program (reinsurance program). The reinsurance program makes reinsurance payments to insurers that offer homeowner's insurance on properties located in the state to partially mitigate losses in the event of a state or federally declared wildfire-related disaster (wildfire-related disaster). The purpose of the reinsurance program is to stabilize the homeowner's insurance market in the state and to attract and retain homeowner's insurers. In exchange for access to the reinsurance program, the reinsurance program requires insurers to sell homeowner's insurance in areas of the state that are at high risk for wildfires. To pay for the reinsurance program, the reinsurance enterprise: ! Issues revenue bonds secured by the reinsurance enterprise; ! Issues a catastrophe bond to a person that purchases the bond but pays the principal to cover costs of a wildfire-related disaster if it occurs; ! May impose and collect an insurer fee on insurers to cover a shortfall if a wildfire-related disaster does not occur during the bond term and the reinsurance enterprise has insufficient money to redeem the bonds at maturity; and ! Invests the revenue from the bonds and insurer fees. In addition, the bill sets the loss ratio for homeowner's insurance by presuming that the rates charged to purchasers are excessive if the insurer's loss ratio is less than 75% over a 3-year period and, if rates are in excess of the loss ratio, requires insurers to submit rates that are at least 5% less than the previous year. SB134 Uniform Guardianship & Conservatorship Act Colorado Commission on Uniform State Laws. The bill repeals the "Uniform Guardianship and Protective Proceedings Act" and enacts the "Uniform Guardianship, Conservatorship, and Other Protective Arrangements Act", drafted by the uniform law commission. The bill provides guidance for guardians and conservators and clarifies how appointees must make decisions on behalf of a person under guardianship or conservatorship. The bill encourages the use of protective arrangements and less restrictive alternatives instead of conservatorship or guardianship if a person's needs can be met with support services and technology. The bill expands the procedural rights for respondents to ensure that guardianships and conservatorships are only imposed when necessary. The bill provides for expanded monitoring of guardians and conservators to ensure compliance with fiduciary duties and prevent exploitation. The bill provides for visitation and communication rights for individuals subject to guardianship or conservatorship. This includes a limitation on a guardian's ability to prevent communication, visitation, or interactions between a person subject to guardianship and a third party. The bill provides for protections to prevent exploitation of vulnerable individuals by allowing the court to restrict access to the respondent or the respondent's property by a specified person without imposing a guardianship or conservatorship. The bill prohibits courts from establishing full guardianship or conservatorship if a limited guardianship or conservatorship would meet the respondent's needs, requires a petitioner seeking full guardianship or conservatorship to provide support to justify full guardianship or conservatorship, and requires courts to provide findings to support the imposition of full guardianship or conservatorship. The bill updates provisions concerning minors subject to guardianship and provides for involvement of a minor in decisions that involve the minor. The bill provides guidance for property management for individuals subject to guardianship. The bill contains model forms for petitioners and respondents to use when filing petitions and notice with the court. Dead

HB1073 Protections Against Child Rape Under current law, sexual assault on a child is a class 4 felony if the victim is under 15 years of age, the actor is at least 4 years older than the victim, and specified aggravating circumstances do not apply. Sexual assault on a child by one in a position of trust is a class 4 felony if the actor is in a position of trust with respect to the victim, the victim is 15 years of age or older but under 18 years of age, and the offense is not committed as part of a pattern of sexual abuse. If the offense is committed as part of a pattern of sexual abuse or the victim is less than 15 years of age, sexual assault on a child by one in a position of trust is a class 3 felony. The presumptive range of penalties for a class 4 felony under current law is 2 to 6 years of imprisonment. The presumptive range of penalties for a class 3 felony under current law is 4 to 12 years of imprisonment. Under current law, a court shall sentence a sex offender to an indeterminate term in the custody of the department of corrections that can range from the applicable presumptive range minimum to a maximum of the sex offender's natural life. However, current law permits the court to sentence a sex offender to probation for an indeterminate period that can range from 10 years for a class 4 felony and 20 years for a class 3 felony to a maximum of the sex offender's natural life. The bill requires a court to sentence an offender convicted of a class 4 felony sexual assault on a child or sexual assault on a child by one in a position of trust to an indeterminate term of incarceration that can range from the presumptive range minimum of 2 years to a maximum of the offender's natural life. SB032 Naturopathic Doctor Requirements Formulary The bill clarifies that the existing naturopathic doctor formulary (existing formulary) includes prescription classes of medicines and clarifies what the practice of naturopathic medicine includes. In addition, the bill creates a new formulary for certain naturopathic doctors, which new formulary includes: ! All legend drugs, other than schedule I or II controlled substances or devices identified in the federal "Controlled Substances Act"; ! For a naturopathic doctor with a federal drug enforcement administration registration, anabolic steroids listed on schedule III of the "Uniform Controlled Substances Act of 2013"; and ! All drugs listed on schedules IV and V of the "Uniform Controlled Substances Act of 2013", except for benzodiazepines, oncological chemotherapeutics, and narcotics (new formulary). Before obtaining, dispensing, administering, injecting, ordering, or prescribing any of the medicines or devices included in the new formulary, a naturopathic doctor who is registered with the department of regulatory agencies (department) must provide proof of: ! Completion of 12 hours of pharmacological continuing education pertinent to or reflective of the naturopathic formulary; ! Passage of the elective pharmacology examination of the Naturopathic Physicians Licensing Examinations; or ! Licensure in good standing in another state that has equivalent prescribing authority. A medicine or device to an individual under 18 years of age; or ! Antipsychotics or ketamine to an individual of any age unless recommended by the naturopathic medicine advisory committee and approved by the director of the division of professions and occupations in the department (director). The bill requires an individual applying for issuance, renewal, or reinstatement of a registration as a naturopathic doctor on or after September 1, 2025, to pass a pharmacology examination administered by the North American Board of Naturopathic Examiners or a nationally recognized, director-approved successor entity. Upon passage of the exam, the individual is able to obtain, dispense, administer, inject, order, or prescribe any of the medicines or devices included in the new formulary.
