LD245 An Act to Implement the Recommendations of the Blue Ribbon Commission to Study Emergency Medical Services in the State This bill does the following. 1. It establishes a permanent Maine Emergency Medical Services Commission to monitor and evaluate the State's emergency medical services system on a continuing basis and to provide recommendations to the appropriate state agencies and to the Legislature regarding necessary changes in the emergency medical services system. 2. It permits the municipal officers of a municipality to adopt and post a plan stipulating the method by which transporting emergency medical services will be delivered within the municipality. A municipality is not required to directly or indirectly provide or fund the delivery of transporting emergency medical services within the municipality. 3. It amends the Maine Emergency Medical Services Act of 1982 to authorize an emergency medical services provider to render emergency medical services within a hospital or health care facility where the provider is a contractor of the hospital or facility. 4. It directs the Department of Public Safety, Maine Emergency Medical Services to conduct a funding needs analysis of communities seeking to engage in regional collaboration or the adoption of a regional model in the delivery of emergency medical services and to submit a report describing the findings of its analysis and any associated recommendations on or before December 3, 2025 to the Joint Standing Committee on Criminal Justice and Public Safety. The committee may report out related legislation to the Second Regular Session of the 132nd Legislature. 5. It directs the Department of Public Safety, Maine Emergency Medical Services to submit to the Joint Standing Committee on Criminal Justice and Public Safety by December 3, 2025 a proposal, including draft legislation, regarding the reorganization of the Emergency Medical Services' Board consistent with the document titled "Maine EMS: Two-Year Action Plan" published by Maine Emergency Medical Services on October 27, 2023. The committee may report out related legislation to the Second Regular Session of the 132nd Legislature. 6. It directs the Department of Public Safety, Maine Emergency Medical Services, as resources allow, to develop and, not later than July 1, 2026, implement a public information campaign designed to enhance the public's understanding and appreciation of the delivery of emergency medical services, the design and funding of the emergency medical services system in the State and the essentiality of the services provided by emergency medical services entities. On or before December 3, 2025, Maine Emergency Medical Services is required to submit a report to the Joint Standing Committee on Criminal Justice and Public Safety regarding its development and anticipated implementation of the public information campaign. The committee may report out related legislation to the Second Regular Session of the 132nd Legislature. Passed
LD1141 An Act to Increase the Procurement of Maine Foods by Certain State Institutions This bill clarifies existing state policy governing food procurement by state institutions to require rather than encourage the procurement of Maine foods and food products by state institutions. The bill requires the Commissioner of Agriculture, Conservation and Forestry to implement and promote a Maine foods and food products procurement program that consolidates food commodity purchases by centralizing the control and purchase of food to stabilize state institution food budgets. The program must allow state institutions to take advantage of opportunity buying, coordinate dietary requirements and establish healthy menus consistently throughout state institutions. The bill creates a definition for "opportunity buying," which is defined as the purchasing of food and food products from vendors at a significant discount that is only available for a short period of time before the food or food products become unavailable for purchase. The bill also requires that the program measurably improve the quality and reduce the cost of food and food products for state institutions. Current law requires the Commissioner of Agriculture, Conservation and Forestry to establish a Maine foods and food products procurement program with the goal that 20% of food procured by state institutions is Maine food and food products. The bill adjusts the program goal with a requirement that, by 2030, that percentage must be 30%. The bill also requires the commissioner to designate an employee of the department as an institutional food procurement coordinator to coordinate food procurement for all state institutions and to implement and oversee a strategy to strengthen connections between Maine food producers, distributors and other institutional stakeholders outside of State Government to achieve the procurement goal established. The bill gives permission for the State to engage in off-contract purchasing, outlines requirements for the convening of an annual meeting and an advisory committee to assist the coordinator in advancing strategies for increasing purchases of Maine foods and food products by state institutions and requires the inclusion of the progress toward the procurement goal in the commissioner's biennial report. LD1957 An Act to Promote Film Production in Maine This bill repeals the law governing the certified visual media production tax credit. It increases reimbursements under the laws governing the visual media production reimbursement and places limits on those reimbursements. It changes the definition of "visual media production expense" and requires an applicant for a visual media production certificate to agree to withhold a percentage of payments made to an entity created to hire out the services of one individual. A school administrative unit must additionally provide training opportunities for educational technicians on disabilities and behavioral needs of the students the educational technicians work with, following lesson plans, the individual needs of each student and paid time or time during the school day to review or be briefed on a student's individualized education program. LD1744 An Act to Modify Provisions of the State Civil Service System Governing Employee Recruitment and Retention This bill makes the following changes to the laws governing recruitment and retention adjustments for state employees in the classified service. 1. It changes one of the criteria for authorizing payment of a recruitment and retention adjustment to add the existence of high turnover or long-term vacancies within a specific department in the relevant occupational classifications or job series. It changes another of the criteria to require that reasonable recruitment and retention efforts have been attempted and have proven ineffective at the current levels of compensation. 2. It provides that payment of a recruitment and retention adjustment may be authorized when an occupational classification is in a job series or job family with an occupational classification entitled to an adjustment and the occupational classification would suffer from either salary compression or salary separation as a result of payment of that adjustment to the other occupational classification. 3. It requires the labor market adjustment to be reviewed at least every 4 years, in alignment with the market pay study conducted by the State. The resulting recruitment and retention adjustment applies to employees hired subsequent to this review. 4. It provides that, if the committee formed to evaluate each request from an agency or bargaining agent for a recruitment and retention adjustment agrees on the appropriate adjustments, the committee must provide a report recommending and documenting those adjustments. If the committee does not agree on the appropriate adjustments, the matter must be submitted to a neutral 3rd party for a final decision and report. 5. It requires the Department of Administrative and Financial Services, Bureau of Human Resources to prescribe the forms to be filed with the bureau to request a recruitment and retention adjustment. 6. It removes language that authorizes payment of a recruitment and retention adjustment when the relevant occupational classification or job series has a clear, geographically definable labor market within which the State must compete. 7. It provides that if the committee that reviews adjustments agrees on the appropriate adjustment, the committee must provide the appropriate persons with a report recommending and documenting the adjustments. LD1671 An Act to Establish Disclosure Requirements Regarding Law Enforcement Officer Credibility Information This bill requires that a law enforcement agency disclose to a prosecuting attorney's office when a law enforcement officer who is a potential witness in a criminal prosecution has engaged in certain specified conduct that calls into question the credibility of the officer as a witness, including, but not limited to, knowingly making untruthful statements of material facts, tampering with evidence, other dishonest acts or admissions of dishonesty, demonstrated patterns of bias against protected classes and facts reflecting an officer's impaired ability to perceive or recall the truth of a matter. Law enforcement agencies must notify the law enforcement officer when disclosing the credibility information to a prosecuting attorney's office. The prosecuting attorney's office must provide notice to the law enforcement officer and the chief law enforcement officer of the reporting law enforcement agency at least 10 calendar days before disclosure of the information to a defendant, except under specific circumstances, and provide the law enforcement officer an opportunity to address a potential disclosure to a defendant before any such disclosure is made. The bill requires a law enforcement agency to adopt written policies and procedures for disclosing credibility information to a prosecuting attorney's office. It requires the prosecuting attorney's office to adopt written policies and procedures for receiving and maintaining credibility records concerning law enforcement officers, disclosing credibility information to a defendant under the Maine Rules of Unified Criminal Procedure, Rule 16, notifying other prosecuting attorney's offices in the State of the credibility information and removing such records if the information is later determined to be inaccurate or false. The bill allows an officer to file a petition in Superior Court to require a prosecuting attorney's office to remove the credibility information from the officer's records of that officer if the credibility information is found to be false or inaccurate. LD852 An Act to Reduce the Property Tax Burden by Adequately Funding County Jail Operations This bill amends the laws governing the operation of county jails as follows. 1. It amends the County Jail Operations Fund to provide that, beginning July 1, 2025 and prior to July 1, 2026, state funding must be appropriated annually for the fund in the amount of $25,445,838 plus any additional amount the Legislature may appropriate. Beginning July 1, 2026, state funding must be appropriated annually for that fund in an amount equal to 20% of the total General Fund appropriation to the Department of Corrections for the costs of all correctional facilities under the department plus any additional amount the Legislature may appropriate. Under current law, state funding is required to be appropriated annually for that fund in the amount of $20,342,104. 2. It provides that, in addition to those state funding requirements for the County Jail Operations Fund, beginning July 1, 2026, state funding must be appropriated annually for the fund in an amount equal to 90% of the costs incurred by county jails and the regional jails in the prior fiscal year in complying with the mandatory standards established by the Commissioner of Corrections. 3. It stipulates that, if a county jail fails to report certain information to the department by the end of a fiscal year as required by law, the department shall distribute the quarterly funding payment for that jail under the County Jail Operations Fund between all other jails that are in compliance with the reporting requirement for that quarter. 4. It provides that, in adopting rules and standards for the county jails, the commissioner incorporate the advisory input of the County Corrections Professional Standards Council. Current law only requires the commissioner to consider that advisory input. 5. It amends the law establishing the council to provide that administrative services costs associated with the activities of the council must be paid by the department. Passed

LD655 An Act Establishing a State Minimum Hourly Wage for Agricultural Workers This bill provides that individuals employed to perform agricultural labor may not be paid at a rate less than the state minimum hourly wage of $14.65 per hour and that, on January 1, 2027 and each January 1st thereafter, the minimum hourly wage then in effect must be increased by the increase in the cost of living. It also provides that employers that employ individuals to perform agricultural labor are required to keep a true and accurate record of the hours worked by each employee and the wages paid to each employee. LD1178 An Act to Expedite the Process Involving Municipalities That Illegally Move a Person to Avoid Responsibility for General Assistance Support This bill decreases from 30 to 15 working days the period for the Department of Health and Human Services to determine if a municipality has illegally moved an individual to avoid responsibility for general assistance support. The bill reduces the appeals period from 30 to 15 days after the determination is made. The bill also provides for interest on unreimbursed amounts to be paid by the offending municipality and a penalty of up to $10,000 for a repeat violation within a 12-month period and creates the rebuttable presumption that if a municipality moves a person to another municipality, the municipality did so to avoid paying general assistance to that person. LD1053 An Act to Ensure That Rebates from Prescription Drug Manufacturers Are Passed on to Patients at Pharmacies This bill removes a provision that requires that compensation remitted by or on behalf of a pharmaceutical manufacturer, developer or labeler to a pharmacy benefits manager be remitted to the carrier if it is not remitted to the covered person. It retains the provision that requires that the compensation be remitted to the covered person to reduce the out-of- pocket costs associated with a prescription drug. It requires pharmacy benefits managers to annually report compliance with this requirement to the Superintendent of Insurance. It authorizes the superintendent to impose civil penalties and take enforcement action for noncompliance by a carrier or pharmacy benefits manager. LD811 An Act to Require a Municipal Public Hearing and Vote Before a Sports Wagering Facility May Be Established This bill requires an applicant for a facility sports wagering license to request and receive approval from the municipal officers of the municipality in which the sports wagering facility is to be physically located before the director of the Gambling Control Unit within the Department of Public Safety may issue the license. The municipal officers are required to hold a public hearing for the consideration of the request to conduct sports wagering at a physical location within that municipality before issuing a decision, which must be provided to the applicant and the director in writing. An aggrieved applicant may appeal the decision of the municipal officers to the director. If the sports wagering facility is to be physically located in an unincorporated place, the applicant must request and receive approval from the county commissioners of the county in which the sports wagering facility is to be physically located. A facility sports wagering license is valid only at the facility sports wagering licensee's municipally approved physical location. Dead
