LD1816 An Act to Establish a Statewide Sexual Assault Forensic Examination Kit Tracking System and Conduct an Inventory of Existing Forensic Examination Kits in the Possession of Law Enforcement This bill directs the Department of Public Safety to establish, operate and maintain a sexual assault forensic examination kit tracking system for all completed kits regardless of whether the alleged offense related to the kit was reported to a law enforcement agency. The tracking system must be continuously accessible to approved users. The department is required to submit a report by January 1, 2027, and annually thereafter, to the joint standing committee of the Legislature having jurisdiction over criminal justice and public safety matters and the Governor concerning information related to the status of sexual assault forensic examination kits reported in the tracking system. The bill provides requirements for the tracking system and requires the department to adopt routine technical rules, including rules regarding participation in the tracking system, confidentiality and the operation of the tracking system. The bill directs that, by June 1, 2026, a law enforcement agency that receives, maintains, stores or preserves sexual assault forensic examination kits must complete an inventory of all kits in its possession and report its findings to the Department of Public Safety. The department must compile all agency reports and present findings of the inventory by January 1, 2027 to the joint standing committee of the Legislature having jurisdiction over criminal justice and public safety matters and at the same time post the report on the department's publicly accessible website. Public Law 2023, chapter 236 changed a provision in the Maine Revised Statutes, Title 25 to require law enforcement agencies to store sexual assault forensic examination kits for 20 years. For consistency with that provision, this bill amends a provision in Title 24 to require law enforcement agencies to store sexual assault forensic examination kits for 20 years. Passed

LD1756 An Act to Establish a Statewide Transportation Project Selection Prioritization Process This bill establishes the Transportation Project Selection Council to develop and manage a statewide project selection prioritization process. The council is directed to: 1. Advise the Department of Transportation and the Maine Turnpike Authority on the development of the prioritization process, in accordance with federal transportation requirements, and in cooperation with municipalities, counties and other planning organizations within the State; 2. Review projects and strategies to determine whether projects are consistent with assessment of capacity needs outlined in the department's or the authority's long-range transportation plans; 3. Weigh key goals for each of the State's federally designated planning organization regions; and 4. Solicit input from municipalities, counties and other planning organizations, transit operators, environmental groups, active transportation groups, economic development groups and other stakeholders in the development of the prioritization process. Specifying that the report of abortions made to the Department of Health and Human Services must include the race, marital status and level of education of the person on whom the abortion is performed and any other information as prescribed by the National Association for Public Health Statistics and Information Systems, Technical Resource for Reporting Induced Termination of Pregnancy; 2. Changing the standard for when an abortion may be performed after viability by allowing an abortion to be performed after viability only when it is medically necessary to preserve the life or health of the mother, rather than when a licensed physician determines it is necessary, or when the fetus is diagnosed with a fetal anomaly that will, with a reasonable certainty, result in the death of the child within 3 months after birth; and 3. LD1400 An Act to Exempt Certain Public School Districts and Their Employees from the Paid Family and Medical Leave Benefits Program This bill provides that a school district is exempt from the paid family and medical leave benefits program if the school district: 1. Provided family leave and medical leave benefits substantially equivalent to those provided in the paid family and medical leave benefits program pursuant to a collective bargaining agreement in effect on January 1, 2025; and 2. Continually maintains substantially equivalent paid family leave and medical leave benefits for employees pursuant to a collective bargaining agreement or other contractual agreement, including benefits for sick leave and family sick leave, that accrue annually to at least 12 weeks of leave. It also requires the Department of Labor to refund contributions made to the department by a school district before the school district was exempt from the paid family and medical leave benefits program. It requires a school district employer that deducted a portion of the premium to the employee as part of the employee's wage to remit that portion of the premium to the employee as part of the employee's wage. LD369 An Act to Grant or Extend Conditional Teaching Certificates Under Certain Circumstances This bill allows the Commissioner of Education to grant an extension of a conditional teaching certificate in the case of extenuating circumstances. The request for an extension must be accompanied by supporting documentation of the circumstances. The bill also allows the commissioner to issue a conditional certificate to an individual who has been employed as a full-time professor at a college or university in the State for at least 5 years and prohibits the Commissioner of Public Safety from assessing a fee for fingerprinting such an applicant. The bill requires an employer that deducted a portion of the premium required for an employee from that employee's wages to remit that portion of the premium to the employee as part of the employee's wages. If the commission finds, after conducting an investigation and an adjudicatory proceeding, that a public utility is in violation of the law, the commission must order divestiture of or by the public utility. LD1203 An Act to Provide Grants to Schools That Contract for Behavioral and Mental Health Services This bill establishes a grant program within the Department of Education to provide grants to school administrative units that contract for behavioral and mental health services provided by licensed behavioral and mental health service providers. The bill limits the use of funds provided through the grant program to behavioral and mental health services that are not otherwise covered or reimbursable through the MaineCare program and provides that funds must be used in a manner that does not supplant qualified and available school administrative unit behavioral and mental health staff. The bill also provides that the amounts of the grants must be based on a school administrative unit's need for clinicians and in the amount of $20,000 per clinician prior to July 1, 2027 and $25,000 per clinician beginning July 1, 2027.
