The bill requires the department to convene a volunteer advisory committee to collect information and prepare materials for teaching Asian American, Native Hawaiian and Pacific Islander history and to develop and provide guidance, best practices and exemplar modules to local school administrative units to integrate Asian American, Native Hawaiian and Pacific Islander history into their curriculum. LD1840 | An Act to Amend the Maine Medical Use of Cannabis Act | This bill makes the following changes to the Maine Medical Use of Cannabis Act. 1. It amends the definition of "caregiver retail store" to clarify that it is a retail store with regular business hours at a location accessible to the general public where a registered caregiver sells cannabis paraphernalia, cannabis plants, harvested cannabis, related supplies or educational materials to qualifying patients without an appointment and other items to the general public. It provides that a caregiver retail store does not include an office at a location not accessible to the general public where a registered caregiver provides consultation services, cannabis paraphernalia, cannabis plants, harvested cannabis, related supplies or educational materials to qualifying patients by appointment. 2. It prohibits the Department of Administrative and Financial Services, except where explicitly authorized or directed by law, from requiring a registered caregiver, registered dispensary, cannabis testing facility or manufacturing facility to use a form issued by the department in complying with the requirements of the Act or of adopted rules and from issuing a guidance document or memorandum to such persons regarding compliance by those persons with the requirements of the Act or of adopted rules. The bill directs the department’s Office of Cannabis Policy to, as expeditiously as possible, rescind and remove from public availability any noncompliant forms and guidance documents or memoranda. 3. It repeals the provision of law that authorizes a caregiver to receive reasonable monetary compensation for costs associated with cultivating cannabis plants or assisting a qualifying patient with that patient's medical use of cannabis. 4. It provides that a caregiver is authorized to transport, sell, offer to sell or furnish cannabis plants or harvested cannabis on the property or premises owned, leased or rented by the caregiver; at trade shows, festivals or other cannabis industry-related events; or through delivery to or private arrangement with a qualifying patient, caregiver or registered dispensary. 5. It removes the process under the Act by which a person that is not a qualifying patient, registered caregiver, registered dispensary or manufacturing facility may receive authorization from the department to engage in cannabis extraction using an inherently hazardous substance and prohibits such cannabis extraction other than by qualifying patients, registered caregivers, registered dispensaries or manufacturing facilities. A qualifying patient, registered caregiver, registered dispensary or manufacturing facility that engages in cannabis extraction using an inherently hazardous substance must comply with any rules regarding that activity adopted by the department by rule but is not required to obtain additional approvals or authorizations from the department to do so. 6. It prohibits the department from posting on its publicly accessible website or otherwise making publicly available, except upon request, applications, supporting information and other nonconfidential information regarding a registered caregiver, including any address where the registered caregiver cultivates, manufactures, tests, packages, stores or sells cannabis plants or harvested cannabis under this chapter. The bill directs the office to, as expeditiously as possible, remove from the office's website and otherwise from public availability, except upon request, any such nonconfidential information regarding registered caregivers. 7. It prohibits the department from requiring a caregiver retail store, registered dispensary, cannabis testing facility or manufacturing facility to use a form provided by the department to demonstrate municipal approval or other local authorization, if such approval or authorization is required by the municipality in which the store, dispensary or facility is seeking to operate. 8. It provides that a caregiver retail store, registered dispensary, cannabis testing facility or manufacturing facility that was previously issued by the department a registration or other authorization to operate and was subsequently denied such registration or other authorization based solely on the failure of the store, dispensary or facility to obtain a completed form provided by the department to demonstrate municipal approval or other local authorization, or based solely on the failure of the municipality to adopt or amend an ordinance or approve a warrant article as required by law, is deemed in compliance with applicable municipal approval or local authorization requirements under the Act. A caregiver retail store, registered dispensary, cannabis testing facility or manufacturing facility deemed in compliance with applicable municipal approval or local authorization requirements pursuant to this provision may request and the department shall issue a registration or other authorization to renew operations, provided that: the store, dispensary or facility is to be located in the same municipality in which it was located when last issued a registration or other authorization to operate by the department; and the store, dispensary or facility satisfies all other applicable registration or authorization requirements pursuant to the Act and adopted rules, excluding any such requirements relating to municipal approval or local authorization and any such requirements that the store, dispensary or facility maintain continuous operation since it was last issued a registration or other authorization to operate by the department. 9. It provides that the Department of Administrative and Financial Services, in its annual report to the Legislature regarding the medical cannabis program, must include information regarding the gross sales of cannabis for medical use for the current and prior fiscal years. 10. It directs the Department of Administrative and Financial Services, Office of Cannabis Policy, on or before January 9, 2026, to provisionally adopt and submit for legislative review major substantive rules necessary to implement the medical cannabis research grant program in accordance with the Maine Revised Statutes, Title 22, section 2430, subsection 5. | Passed |
LD1897 | An Act Regarding Outdoor Cultivation in the Medical Use Cannabis and Adult Use Cannabis Industries | This bill amends the Maine Medical Use of Cannabis Act and the Cannabis Legalization Act by: 1. Defining "sun-grown cultivators" under the medical use cannabis provisions and "sun-grown cultivation" under the adult use cannabis provisions; 2. It changes the minimum state supplemental income benefit from $8 per month for an individual and $12 per month for a couple to $65 per month for an individual and an amount per couple that is consistent with the amount provided to an individual and to a couple under current law, which requires benefits for a couple to be 150% of the benefit for an individual, making the new amount $97.50 per month for a couple. 2. It provides that, starting October 1, 2026, the state supplemental income benefit must be annually increased by the cost-of-living adjustment to the federal payment standard. 3. It provides that, in the priority sequence by which the Department of Health and Human Services must budget and authorize for expenditure appropriations available for benefits, the cost-of-living adjustment must have priority immediately after the minimum payment. 4. It updates the declared intent of the Act to provide that, if it is proposed that benefits provided are to be increased on any future date, cost-of-living adjustments be included in the benefits to be increased rather than increasing the benefits provided to a beneficiary who resides in certain living arrangements. 5. Appointments to the advisory council must be made within 30 days of the effective date of the legislation by the appointing authorities. The duties of the advisory council include: A. Assisting school administrative units and educators in the exploration of a wide range of educational materials and resources relating to African American studies; B. Identifying materials and resources for implementing African American studies; C. Making recommendations to the Department of Education regarding African American studies curricula, revisions to the system of learning results, funding and opportunities for professional development, training and technical assistance; and D. Using data gathered pursuant to the representative statewide sampling conducted by the Department of Education of African American studies curricula in school administrative units to establish a baseline measure of the implementation of African American studies in school administrative units. The advisory council is directed to submit an annual report to the joint standing committee of the Legislature having jurisdiction over education matters beginning January 15, 2027. 2. It directs the Department of Education to develop professional development opportunities for educators in African American studies. 3. It directs the State Board of Education to convene a stakeholder group to study the development of an endorsement in African American studies on an educator credential or the inclusion of a requirement for an African American studies course as a requirement for an educator credential in this State and report to the Joint Standing Committee on Education and Cultural Affairs no later than January 15, 2026. 4. It provides an appropriations and allocations section to: A. Establish in the Department of Education a content specialist position in African American studies and to provide outreach to school administrative units with support and technical assistance in curriculum development and implementation of African American studies; and B. In distributing funds to such persons, the fund administrator must give priority to persons that are not commercial entities or entities that are otherwise subject to regulation under law or rule; whose interest or position, as determined by the fund administrator, is not otherwise adequately represented in the rulemaking, proceeding or licensing action; and whose interest or position, as determined by the fund administrator, is primarily focused on protecting or conserving the State's natural resources or environment, protecting the public health or safety or ensuring freedom of access to public information and government transparency. The bill also directs the Office of the Attorney General to consult with each state agency that issues licenses, permits or other approvals to persons to engage in regulated activities relating to the environment, natural resources, public health and safety and freedom of information and government transparency to identify a mechanism for imposing an additional fee amount for the issuance of those licenses, permits or approvals to support activities under the Fund for Administrative Oversight, in a manner designed to satisfy the anticipated annual demand for distributions from that fund for the agency. The fee amounts identified must be reasonable, must not unreasonably impede the activities of the regulated entity and must be designed to reflect the anticipated cost to the agency of oversight of the regulated entity and addressing any potential violations by the regulated entity, including any costs of corrective action or remediation undertaken by the agency. By January 1, 2026, the office must submit a report to the Joint Standing Committee on State and Local Government outlining its recommendations for imposing such additional fee amounts, including necessary proposed legislation, and the committee may report out related legislation. Submit a human health impact assessment for the proposed mining operation that identifies all potential emissions and effects from the mining operation in a proposed mining area and affected area that can reasonably be expected to cause or threaten harm to human health and to particularly vulnerable populations. The assessment must include a baseline health data evaluation for the population surrounding the mining operation; B. Demonstrate specific plans to provide for and fund the perpetual treatment and monitoring of mine waste and tailings in the event that the applicant fails to satisfy applicable mine waste or tailings management requirements, applicable closure and post-closure monitoring requirements or other applicable requirements resulting in the need for perpetual treatment of mine waste or tailings following closure; C. Demonstrate specific plans to address natural events that may affect mining operations and for the implementation of climate adaptation measures as specified by rule; and D. Demonstrate specific plans for ensuring that the mining operation will use clean energy measures and technologies to the greatest extent practicable. 2. In addition to other restrictions provided under current law, the bill prohibits the Department of Environmental Protection from issuing a mining permit for a mining operation that: A. Will involve or result in the release of perfluoroalkyl and polyfluoroalkyl substances into the air, soil, groundwater or surface water within any mining area or affected area; B. Will involve the use of explosives or other blasting materials that contain perchlorate; or C. Does not meet all applicable setback requirements specified in rule, which must include, but are not limited to, minimum setbacks from schools, day care facilities, residences, hospitals, national and state parks, elder care facilities, community gardens, churches, locations considered sacred by federally recognized Indian tribes, nations or bands in the State, water bodies and wildlife refuges. 3. In addition to other requirements provided under current law, the bill requires a mining permittee to: A. Comply with applicable air quality standards and requirements through direct measurement of emissions and not by estimating emissions concentrations; to conduct air emissions monitoring for the pollutants described in the State's ambient air quality standards laws and for other hazardous air pollutants specified in rule; to install and operate fenceline monitoring equipment for air emissions from any stack, flue, chimney, vent or other potential source of air pollution within a mining area; and to ensure the monitoring and measurement of fugitive emissions to the air within a mining area; and B. Provide proof of and maintain comprehensive general liability insurance for the mining operation for the same duration as financial assurance is required by law, which must provide sufficient coverage to address potential harm to members of the public located adjacent to or in proximity to mining areas or affected areas. 4. The bill amends the provisions of the mining law regarding imminent endangerment to provide the department with authority to take action necessary to prevent an imminent and substantial endangerment to the public health or safety, environment or natural resources that a mining operation has the potential to cause or result in, regardless of whether a violation exists. 5. The bill amends certain definitions within the mining law and makes other associated changes to the mining law to provide for the regulation of smelting or refining activities and facilities that are part of the mining operation. If a mining operation involves on-site smelting or refining activities or facilities, if mine waste or other materials resulting from those activities is removed for off-site storage or disposal, the permittee must conduct post-closure groundwater monitoring at any location where the mine waste or other materials are stored or disposed. 6. The bill amends permittee notification requirements to require the provision of information to communities surrounding a mining operation regarding air emissions and other fugitive emissions, material safety data for all chemicals and substances used in the mining operation and the results of studies or modeling regarding the mining operation.
