HB1016 Spending Reduction Procedures Under existing law, the governor is permitted to, by executive order, suspend or discontinue the functions or services of state government for 3 months when there are not sufficient revenues available to carry on the functions of the state government. The governor may extend the executive order every 3 months. The bill requires the governor to formulate a spending reduction plan (discretionary spending reduction plan) if the governor extends the initial executive order. The governor and the office of state planning and budgeting (OSPB) shall present the discretionary spending reduction plan to the joint budget committee (JBC) at a JBC meeting and consult with the JBC about the plan. The heads of departments included in the discretionary spending reduction plan shall be available at the JBC meeting to respond to questions from the JBC. Under existing law, the governor is required to formulate and implement a plan to reduce general fund expenditures (required spending reduction plan) when the governor's regular quarterly revenue estimate indicates that appropriations from the general fund then in effect will result in either using more than one-half of the required amount of general fund reserve (reserve) or the balance of the reserve dropping to below $1 billion. In addition to the regular quarterly revenue estimate trigger, the bill adds as a required spending reduction trigger for the governor that an interim revenue estimate prepared by the governor indicates the same. The bill requires the governor and OSPB to present a required spending reduction plan to the JBC at a JBC meeting and consult with the JBC about the required spending reduction plan before implementing the plan. The heads of departments included in the required spending reduction plan shall be available at the JBC meeting to respond to questions from the JBC. The bill requires the director of OSPB and the chief economist of the legislative council staff to present to the JBC any interim revenue estimates made by their respective agencies. Dead
HB1018 Income Tax Credit Adjustment Section of the bill creates a mechanism for temporarily suspending or prorating all income tax credits, excluding the Colorado affordable housing tax credit and the earned income tax credits (income tax credits), based on estimates of the state's revenue. Beginning with the December 2025 quarterly revenue forecast, each quarterly revenue forecast in June, September, or December, and any interim revenue estimate given between quarterly forecasts, must include 2 estimates of the amount of excess state revenues in relation to the income tax credits available. Excess state revenues, for purposes of these estimates, means the total amount of revenue collected by the state during the state fiscal year in excess of the limitation on state fiscal year spending imposed by the Taxpayer's Bill of Rights that voters statewide have not authorized the state to retain and spend, less: The reimbursement to local governments to offset the reduction in property taxes resulting from property tax exemptions for qualifying seniors, veterans with disabilities, and spouses of veterans who died in the line of duty or as a result of a service-related injury or disease; the reimbursement to local governments to offset the reduction in property taxes resulting from the reduced valuation for assessment of qualified-senior primary residences; and any temporary income tax rate reduction in effect. These estimates are: ! An estimate of the amount of excess state revenues in the state fiscal year during which the income tax year begins, assuming all income tax credits are available in the following income tax year; and ! An estimate of the amount of excess state revenues in the state fiscal year during which the income tax year begins, assuming no income tax credits are available in the following income tax year. The availability of income tax credits for the applicable income tax year is determined by which of these estimates results in the least amount of excess revenue. If the most recent quarterly June, September, or December revenue forecast, or the most recent interim revenue estimate, shows that: ! The estimate without income tax credits results in the least amount of excess revenue, then no income tax credits are available for the applicable income tax year; or ! The estimate with income tax credits results in the least amount of excess revenue, then all income tax credits are available for the applicable income tax year and are prorated so that the maximum total amount of each income tax credit claimed by all taxpayers claiming that credit does not exceed the amount equal to the estimated excess state revenues divided by the total number of income tax credits available during the applicable income tax year. The bill also makes the family affordability tax credit nonrefundable beginning in income tax year 2025 (section 2). Lastly, the bill alters the following refundable income tax credits: ! The credit for the sale of new, electric-powered lawn equipment for income tax years commencing on or after January 1, 2024, but before January 1, 2027. Under existing law, this credit is allowed to qualified retailers who sell new, electric-powered lawn equipment and offer a discount on the purchase price (section 4); ! The credit for the installation of heat pump technology or a thermal energy network for income tax years commencing on or after January 1, 2024, but before January 1, 2033. Under existing law, this credit is allowed to eligible taxpayers who meet certain industry criteria and install heat pump technology or a thermal energy network, if the eligible taxpayer provides a discount from the amount charged for installation (section 5); and ! The credit for the sale of new qualified electric bicycles for income tax years commencing on or after January 1, 2024, but before January 1, 2033. Under existing law, this credit is allowed to qualified retailers who sell a qualified electric bicycle and offer a discount on the bicycle purchase price (section 6). The bill modifies the 3 income tax credits so that income tax year 2025 is the last tax year that each credit can be claimed as it currently exists and allows the department of revenue (department) to sell the income tax credits in state fiscal year 2025-26 to taxpayers who meet the existing eligibility requirements (qualified taxpayers). In state fiscal year 2025-26, the department is authorized to issue up to $40 million in income tax credit certificates to qualified taxpayers, subject to procedures established by the department. The proceeds of these sales are credited to the general fund. A qualified taxpayer may claim the full amount of tax credit against its income tax liability in income tax year 2030; except that the amount of the credit claimed cannot exceed the taxpayer's income tax liability for a given year. The unused amount of the credit carries forward and may be claimed in subsequent years; except that a credit cannot be carried over to any taxable year that begins after December 31, 2050. Dead

HB1021 Retention of Vendors Fees for Collecting Sales Tax. Current law requires a retailer to periodically remit to the department of revenue the sales tax revenue that it collects and allows some retailers to retain a sales tax vendor fee to cover the retailer's expenses incurred in collecting and remitting state sales tax (vendor fee). For sales made on or after January 1, 2026, the bill increases the maximum dollar amount that a retailer may retain as a vendor fee from $1,000 to $2,000. Beginning on January 1, 2026, the bill requires that: ! The percentage of sales tax reported that a retailer may retain as a vendor fee must never fall below 2% of the tax reported; and ! The maximum dollar amount that a retailer may retain in any filing period as a vendor fee must never fall below $2,000. Dead
HB1020 Additions to Definition Federal Taxable Income For tax years commencing on and after January 1, 2026, current law requires taxpayers to add the amount of any overtime compensation excluded or deducted from that taxpayer's federal gross income to that taxpayer's federal taxable income for purposes of determining the taxpayer's state taxable income. The bill repeals this addition and clarifies that this addition is "a tax policy change directly causing a net tax revenue gain to any district", so that reinstating this addition requires voter approval in advance pursuant to section 20 (4)(a) of article X of the state constitution. For tax years commencing before January 1, 2026, current law requires certain taxpayers to add to their federal taxable income, for purposes of determining their state taxable income, an amount equal to the federal qualified business income deduction allowed under section 199A of the federal "Internal Revenue Code of 1986". The bill clarifies that extending this tax policy to apply to any tax year commencing on or after January 1, 2026, would be "a tax policy change directly causing a net tax revenue gain to any district" and requires voter approval in advance pursuant to section 20 (4)(a) of article X of the state constitution. SB120 Nuclear Workforce Development & Education Program The bill creates the Colorado nuclear workforce development and education program (program) in the department of higher education (department) to help meet growing workforce demand in the nuclear energy sector. The bill establishes a related grant program to provide grants to institutions of higher education for the development or expansion of nuclear engineering degree or certificate programs or course offerings. The Colorado nuclear workforce development and education council shall advise and assist the department regarding the grant program's implementation and evaluation. The department may seek, accept, and expend gifts, grants, and donations for program-related purposes. The state treasurer shall credit the gifts, grants, and donations to the Colorado workforce development and education cash fund (cash fund). The general assembly shall not appropriate general fund dollars to implement or maintain program operations or grant awards. The department shall begin awarding grants only after the balance of the cash fund reaches or exceeds $500,000. The bill imposes requirements to report to the general assembly about the program's implementation and use of funds. SB131 Reducing the Cost of Housing Current law restricts construction defect negligence claims unless the negligence claim arises from a construction defect which results in actual damage to or loss of the use of real or personal property; bodily injury or wrongful death; or a risk of bodily injury or death to, or a threat to the life, health, or safety of, the occupants of the residential real property. Section 1 of the bill changes this restriction so that all construction defect claims are restricted unless the claim arises from a construction defect that causes: ! Actual damage to real or personal property caused by the violation of a building code, manufacturer's instructions, or industry standard; ! Actual loss of the use of real or personal property; ! Bodily injury or wrongful death; or ! An imminent and unreasonable risk of bodily injury or death to, or an imminent or unreasonable threat to the life, health, or safety of, the occupants of the residential real property. Sections 2 through 12 modify existing warranty of habitability laws by repealing recent updates and reenacting the laws as they were prior to the updates. The modifications include repealing certain procedures for both landlords and tenants when a warranty of habitability claim is alleged by the tenant; repealing a rebuttable presumption that a landlord failed to remedy an uninhabitable premises in certain conditions; modifying requirements regarding notice given to a landlord of an uninhabitable premises; and modifying other laws related to rental agreements, records, and procedures for remedying uninhabitable premises. Section 13 repeals law that allows the attorney general to independently initiate and bring actions to enforce laws relating to the warranty of habitability. Section 14 makes a conforming change to law governing county courts' jurisdiction over cases involving tenant's remedies in warranty of habitability cases and tenant's remedies in cases of unlawful removal. Section 15 modifies the statement included in a summons issued to a defendant in a court proceeding regarding an action for possession brought by a landlord. Sections 16 through 20 repeal provisions related to evictions of residential tenants, including repealing: ! Requirements that a landlord and residential tenant participate in mandatory mediation prior to commencing an eviction action if the residential tenant receives cash assistance; ! A prohibition on a law enforcement officer's ability to execute a writ of restitution until 30 days after the entry of judgment if the residential tenant receives cash assistance; ! Requirements that a written demand include a statement that a residential tenant who receives cash assistance has a right to mediation prior to the landlord filing an eviction complaint; ! Requirements that a written rental agreement include a statement that current law prohibits source of income discrimination and requires a nonexempt landlord to accept any lawful and verifiable source of money paid directly, indirectly, or on behalf of a person; and ! Requirements that prohibit a written rental agreement from including a waiver of mandatory mediation or a clause that allows a landlord to recoup any costs associated with mandatory mediation. Sections 21 and 22 require any provision of any energy code adopted by a county or municipality on or after January 1, 2026, to be cost effective. "Cost effective" means, using the existing energy efficiency standards and requirements as a base of comparison, that the economic benefits of the proposed energy efficiency standards and requirements will exceed the economic costs of those standards and requirements based upon an incremental multi-year analysis. Charging a fee to a consumer or merchant related to a disputed credit card transaction until the dispute has been resolved and the consumer or merchant has been provided written notice of the determination; or ! Imposing a penalty on a merchant for setting prices in a manner that complies with state and federal law. The bill prohibits a payment card network from establishing, putting forward, or implementing a fee schedule that the payment card network knows or reasonably should know has been used by one or more issuers other than the payment card network to determine the amount of an interchange fee received or charged in respect to a charitable contribution, unless the interchange fee does not exceed: ! 0.2% of the amount of a charitable contribution made by means of a debit card; or ! 0.3% of the amount of a charitable contribution made by means of a credit card. If a payment card network violates the act, a merchant, consumer, or other individual or entity that is injured as a result may bring a civil action. A payment card network that is found to have violated the act as a result of a civil action other than a certified class action is liable in an amount equal to the sum of: ! The greater of: ! The amount of actual damages sustained plus interest; or ! $500; or ! times the amount of actual damages sustained if the payment card network engaged in bad faith conduct; plus ! The costs of the action plus reasonable attorney fees. SB119 Measures to Modify the Department of Early Childhood Current law authorizes the executive director of the department of early childhood (department) to adopt all rules for the administration of the department, for the execution and administration of department functions, and for the programs and services managed by the department. The bill repeals the executive director's rule-making authority and creates the state board of early childhood services (state board). The bill authorizes the state board to adopt all rules for the administration of the department, for the execution and administration of department functions, and for the programs and services managed by the department. Current law allows a local coordinating organization (LCO) to participate in the Colorado universal preschool program (program) by allocating funding to school- and community-based preschool providers (preschool providers), ensuring a mixed delivery system of preschool providers, and coordinating with preschool providers and the early childhood and family support programs and services. On June 1, 2026, LCOs will no longer participate in the program, but LCOs will continue to support families who apply for early childhood and family support programs and services, coordinate with county departments and tribal agencies, and work with early child care providers to increase recruitment and retention of individuals in the early child care workforce. The bill requires the department to modify the unified application to grant administrative access to a preschool provider who participates in the program to help families enroll their children in the program and to assist families with their administrative needs, including with the completion of their first program application and maintaining the continued enrollment of their children who have been receiving preschool services from the preschool provider. Administrative units will also have access to the unified application to help families enroll children with disabilities in the program and to assist families with their administrative needs. Current law requires the executive director to adopt rules for the maximum allowable educator-to-child ratios and group sizes (ratios and group sizes) in alignment with national best practices. The bill requires the state board to adopt rules for ratios and group sizes in alignment with state licensing standards. When the department adjusts ratios and group sizes, and prior to adopting rules for the preschool program, the department is required to coordinate with preschool providers to determine the ratios and group sizes. The bill requires the department to distribute funding to preschool providers in advance of services provided throughout the school year based on enrollment data. Dead
SB156 Reducing Costs of State Regulation Sections 1 and 2 of the bill prohibit a state agency from imposing a personal qualification requirement in order to engage in a profession or occupation unless the agency can show that the requirement is demonstrably necessary and narrowly tailored to address a specific, legitimate public health, safety, or welfare objective. On or before July 1, 2026, every agency must review occupational regulations and determine whether the regulation should be repealed or amended. Any person may file a petition with an agency requesting that an occupational regulation be repealed or amended. Regardless of whether a petition is filed with an agency, any person may file a civil suit requesting that the court enjoin the adoption or enforcement of an occupational regulation. When an agency files a notice of proposed rule-making with the secretary of state, if the proposed rule-making includes a proposed occupational regulation, the agency must also submit a statement to the secretary of state describing how the proposed occupational regulation complies with the bill's requirements. Section 3 repeals the industrial and manufacturing operations clean air grant program, the cannabis resource optimization cash fund, the community access to electric bicycles grant program, and the electrifying school buses grant program, which were enacted in 2022 by Senate Bill 22-193. SB117 Reduce Transportation Costs Imposed by Government For the purpose of reducing transportation costs, the bill repeals the following fees, effective July 1, 2025: ! The road usage fee imposed by the state and the bridge and tunnel impact fee imposed by the statewide bridge and tunnel enterprise that are imposed on the purchase of each gallon of taxed gasoline and special fuel; ! The fee imposed by the state on short-term motor vehicle rentals; ! The passenger per-ride fees imposed on car share rides by the state, the clean fleet enterprise, and the nonattainment area air pollution mitigation enterprise; and ! The waste tire enterprise fee imposed on the purchase of new motor vehicle and trailer tires by the waste tire management enterprise. Because this fee is the only source of revenue for the waste tire management enterprise, the bill also repeal the enterprise. The bill also requires the nonattainment area air pollution mitigation enterprise, no later than January 1, 2026, to establish a reformulated gasoline cost stabilization program to offer reformulated gasoline cost stabilization rebates to individuals who own motor vehicles that are registered in counties in which the federal government requires all gasoline sold to be reformulated gasoline.
