HB1008 | Complementary Behavioral Health Services in Jails | Legislative Oversight Committee Concerning the Treatment of Persons with Behavioral Health Disorders in the Criminal and Juvenile Justice Systems. Under existing law, the behavioral health administration (BHA) in the department of human services administers the jail-based behavioral health services program (program). The bill requires the BHA to, as part of the program, provide funding to jails to administer services that complement a person's primary course of treatment for a behavioral health disorder (complementary behavioral health services) to persons in custody in the jail. A jail shall use the funding to train jail staff to administer complementary behavioral health services and to provide complementary behavioral health services to persons in custody in the jail at no cost to the person. The bill requires the general assembly to annually appropriate up to $50,000 for the administration of complementary behavioral health services as part of the program. | Dead |
HB1170 | Lobbying by Nonprofit Entities | Currently, a lobbyist may be either a professional lobbyist or a volunteer lobbyist. A professional lobbyist must register with the secretary of state before conducting lobbying activities with one or more covered officials. For each month in which a professional lobbyist lobbies one or more covered officials, a professional lobbyist must complete and submit a disclosure statement to the secretary of state. The bill creates a new category of lobbyist for nonprofit lobbyists and exempts nonprofit lobbyists from the registration and disclosure statement requirements for professional lobbyists. A nonprofit lobbyist is a lobbyist who is exclusively employed by a single nonprofit entity and who lobbies as an incidental part of the lobbyist's duties with the nonprofit entity. A nonprofit entity may use a nonprofit lobbyist to lobby a maximum of 30 days during a state fiscal year, with a maximum of 20 of those days occurring when the general assembly is in session. A nonprofit entity that employs a nonprofit lobbyist must report to the secretary of state the following information within 72 hours of engaging in lobbying of one or more covered officials: ! The name of the nonprofit lobbyist; ! The full legal name of the nonprofit entity on whose behalf the nonprofit lobbyist lobbied; ! The date on which the nonprofit lobbyist engaged in lobbying; ! Any matter about which the nonprofit lobbyist lobbied for the reported day; and ! The bill number of the legislation about which each nonprofit lobbyist lobbied for the reported day and whether the nonprofit entity is supporting, opposing, requesting amendments, or monitoring the legislation. A nonprofit entity may submit a single form for more than one nonprofit lobbyist if more than one nonprofit lobbyist lobbied for the nonprofit entity on the same day. A lobbyist who was a nonprofit lobbyist but no longer qualifies as a nonprofit lobbyist or who is employed by a nonprofit entity that does not comply with the timing limitations, and who meets the requirements of a professional lobbyist, must register and file disclosure statements with the secretary of state beginning in the month in which the lobbyist first lobbied as a professional lobbyist and must comply with the regulations imposed on a professional lobbyist. | Dead |

SB043 | Deflection Supports Justice-Involved Youth | Legislative Oversight Committee Concerning the Treatment of Persons with Behavioral Health Disorders in the Criminal and Juvenile Justice Systems. Current law establishes the youthful offender system in the department of corrections as a sentencing option that provides a continuum of services. Section 1 of the bill: ! Revises certain legislative declaration provisions to emphasize lasting behavioral changes in preparation for reentry, accountability, healthy relationship building, and offender and staff safety; ! Adds language related to housing arrangements and equitable treatment for youthful offenders, including youthful offenders with disabilities; ! Adds a requirement for rehabilitative treatment and life skills programming and, in certain cases, for individual and family therapy and substance use disorder treatment; ! Elaborates on clinician evaluations, tailored treatment plans, and client manager requirements for youthful offenders; and ! Imposes an annual reporting requirement beginning in January 2026. Section 2 of the bill applies the standards for determining competency in juvenile delinquency cases to juveniles who have charges directly filed against them in adult court, juveniles whose cases are transferred to adult court, or juveniles subject to concurrent court jurisdiction. Section 3 of the bill permits bridges court liaisons to access juvenile competency evaluations and related information. Current law sets forth procedures for court determinations of a juvenile's competency in juvenile justice proceedings. Section 4 of the bill requires a court to dismiss the case against a juvenile if the court makes a final determination that the juvenile is incompetent to proceed and the juvenile's highest charged act is a class 2 misdemeanor, a petty offense, a drug misdemeanor, or a traffic offense. Under current law, one year after a court finds a juvenile charged with a level 4 drug felony is incompetent to proceed the court shall enter a finding the juvenile is unrestorable to competency and shall determine whether a management plan is necessary for the juvenile. The bill reduces the time from one year to 6 months. The bill imposes certain limitations on a case management plan's contents in cases that involve sexual conduct and addresses court responses when a juvenile or a juvenile's parent or guardian fails to engage with a management plan's ordered services. Section 5 of the bill requires that a person sentenced for a delinquent act committed as a juvenile receive credit for any period of confinement prior to sentencing. Section 6 of the bill creates the deflection and community investment grant program (grant program) in the office of adult and juvenile justice assistance in the division of criminal justice to provide grants to eligible nonprofit and tribal applicants to implement a mixed-delivery system of trauma-informed health and development deflection programs for youth, including Native American youth. | Dead |

SB073 | Military-Connected Children with Disabilities | The bill clarifies the process and timeline for an administrative unit or a state-operated program to provide special education services to a military-connected child with disabilities (child) who transfers from one administrative unit or state-operated program within Colorado to another, or transfers from an out-of-state school district or private school to an administrative unit or a state-operated program within Colorado, as a result of an inbound active duty military member's (member) order to permanently change military stations. For a child who transfers from an administrative unit or state-approved program to a private school within Colorado, or transfers from an out-of-state school district or private school to a private school within Colorado, the administrative unit with jurisdiction over the geographic boundary that the private school is located in shall review the child's evaluation information and existing individualized education program (IEP) or section 504 plan in consultation with the child's member, parent, legal guardian, or custodian. The administrative unit shall determine and provide equitable special education and related services, an IEP, or a section 504 plan to the child enrolled in the private school. For a child who transfers from an out-of-state school district or private school with an individualized family service plan, the administrative unit or the state-operated program shall follow the process to coordinate, in conjunction with the department of early childhood, the transition of the child from an early intervention program for infants and toddlers pursuant to part C of the federal "Individuals with Disabilities Education Act" (IDEA) to a program component to serve children with disabilities from 3 to 21 years of age pursuant to part B of the IDEA. The bill requires an administrative unit, a state-operated program, or an administrative unit with jurisdiction over the geographic boundary that a private school is located in to receive informed consent from the member, parent, legal guardian, or custodian of a child before: ! HB1141 | Gift Card & Retail Property Crime Penalties | Current law requires mandatory sentencing to at least the minimum of the prescribed range for a person who, within the immediately preceding 4 years, was twice convicted of felony theft from a store and who is once again convicted of felony theft from a store. The bill requires a state court to sentence a person convicted of burglary, robbery, theft, or a related property crime from or of a store, who was convicted of any 2 of the specified property crimes or comparable municipal offenses from or of a store within the preceding 4 years, to at least the midpoint term for the current offense. The bill adds language to the existing theft statute clarifying how a gift card's value is determined for purposes of determining the offense level and associated penalty. If the stolen item of value is a gift card, then the value is the full monetary face value or, in the case of a variable load gift card, the maximum potential value, regardless of whether funds have been transferred to the gift card at the time of the theft. HB1164 | Constitutional Carry of Handgun | The bill grants a person who is at least 18 years of age and permitted to possess a handgun pursuant to federal and state law the same authority to carry a concealed handgun as a person who holds a permit to carry a concealed handgun (permit). A person who carries a concealed handgun without a permit has the same rights, limitations, and authority to carry as a person who holds a permit. A person may obtain a permit for the purpose of using the permit to carry a concealed handgun in another state that recognizes a Colorado permit. The bill makes the minimum age to obtain a permit 18 years of age. Under existing law, Colorado recognizes permits issued in other states that meet certain criteria, including that the holder of the out-of-state permit is at least 21 years of age. The bill changes the minimum age for recognition of an out-of-state permit to 18 years of age. Under existing law, a permit is valid for 5 years. The bill makes a permit valid for the life of the permit holder. Existing permits, other than temporary emergency permits, are converted to lifetime permits. Because the bill makes permits valid for the life of the holder, the bill repeals provisions relating to the renewal of permits. The bill repeals the temporary emergency permit to carry a concealed handgun.
