This bill authorizes the governor to appoint an Iowa resident, and the majority leader of the senate and the speaker of the house of representatives to each appoint a member of the general assembly from their respective chambers, to engage in negotiations with the state of Minnesota for the purchase of nine of Minnesota’s counties by Iowa. A negotiated agreement must include provisions relating to land ownership and lawsuits concerning land relinquished by Minnesota. An agreement is not valid unless passed into law by the general assembly and the Minnesota legislature, and approved by the United States Congress. The general assembly must also appropriate moneys to pay for the purchase of the land if necessary and Iowa must pass a constitutional amendment to ratify the new boundaries of the state. SF363 A bill for an act relating to the Iowa health and wellness plan and member community engagement requirements and including effective date provisions.(See SF 599, SF 615.) This bill relates to community engagement requirements for Iowa health and wellness plan membership. The bill requires as a condition of membership that an eligible individual participate in a community engagement activity that includes working or volunteering as detailed in the bill. Certain individuals are exempt from the community engagement requirement as described in the bill. If required, the department of health and human services shall submit a request for a section 1115 demonstration waiver to require an eligible individual to participate in a community engagement activity as a condition of membership in the Iowa health and wellness plan. The bill requires the department of health and human services to implement the provisions of the bill no later than July 1, 2025. The bill takes effect upon enactment. In Committee
SF431 A bill for an act relating to retention of fees for public improvement contracts.(See SF 574.) This bill relates to retention fees and bonds for public improvement contracts. The bill provides that after a claim has been filed for costs incurred in the construction of a public improvement and the general contractor has filed a surety bond in double the amount of the claim in controversy with a public corporation or person withholding funds, the public corporation or person must pay to the contractor the full amount of retention funds held for the project or double the amount of the claim, whichever is less. Interest will accrue on the unpaid amount beginning on the 21st day after the public corporation’s receipt of the surety bond. The bill requires that after the contractor serves a written demand on the person filing a claim, an action must be commenced within 30 days, or the claim will be barred and the public corporation or person withholding the funds must pay the contractor the full amount of retention funds held for the project or double the amount of the claim, whichever is less. Beginning on the 21st day after the public corporation’s receipt of a payment demand by the contractor with the accompanying documents, interest shall accrue on the unpaid amount. The bill allows a principal contractor to post with the public corporation a retention bond, with surety, in the amount of 5 percent of the original contract price as a substitute for the retention funds that are retained by a public corporation from each monthly payment for labor and material on a public improvement contract. The public corporation must pay all retention funds being held to the contractor within 20 days and hold no further retention funds on the project. Beginning on the 21st day after the public corporation’s receipt of the retention bond, interest shall accrue on the unpaid amount of the retention funds. The bill strikes the requirement that the retained and unpaid funds owed to the contractor be released if an action is not commenced within 30 days of the contractor serving written demand on the person filing a claim and that the public corporation or person pay the contractor the withheld funds after an action is commenced and the general contractor has filed a surety bond. Under current law, a court may grant a reasonable attorney fee to a claimant who has established a claim. The bill changes this to require a court to grant a reasonable attorney fee to a claimant who prevails and to a principal contractor who prevails in a dispute with a public corporation related to the contract, retention funds, or the public improvement. SF361 A bill for an act establishing the armed forces reserve component scholarship program within the college student aid commission. This bill establishes the armed forces reserve component scholarship program within the college student aid commission for members of the reserve forces of the United States armed forces who are enrolled as full-time students in an eligible institution. The bill provides that a qualified student who is enrolled as a full-time student in an eligible institution may receive a scholarship under the program for not more than the equivalent of eight semesters of study. If the eligible student is enrolled in a community college, the amount of the eligible student’s scholarship shall not exceed the lesser of the eligible student’s financial need or 100 percent of the resident tuition and mandatory fees charged by the community college. If the eligible student is enrolled in an institution of higher learning under the control of the state board of regents, or an accredited private institution, the amount of the eligible student’s scholarship shall not exceed the lesser of the eligible student’s financial need or 100 percent of the average resident tuition and mandatory fees for undergraduate study charged by the institutions of higher learning. The bill provides that if the amount appropriated in a fiscal year is insufficient to provide scholarships to all who apply for the program and who are determined to be eligible for the program, the commission shall determine the distribution of scholarships. The bill provides that if an eligible student discontinues attendance before the end of any semester, or the equivalent, after receiving scholarship payments, the entire amount of any refund due to that eligible student, up to the full amount of all of the annual scholarship payments made, shall be paid by the eligible institution to the commission. This provision does not apply to an eligible student who discontinues attendance due to the eligible student being ordered to active duty. Scholarship awards under the program are required to be paid to the eligible institution by the commission upon receipt of certification by the eligible institution as to the accuracy of charges made and as to the attendance and academic progress of the eligible student at the eligible institution. The bill requires the commission to maintain an annual record of the number of participants in the program and the dollar value of the scholarship awards issued. The bill provides that a member of a reserve component of the army, navy, air force, marine corps, coast guard, or space force of the United States, located in this state, is ineligible for a scholarship award under the program if the member has met the educational requirements for a baccalaureate degree or if the member was discharged from any branch of the armed forces under other than honorable conditions. If an eligible student is ordered to active duty during the time in which the eligible student is enrolled in an eligible institution and receiving scholarship awards under the program, the commission is authorized to waive or modify any statutory or regulatory provision applicable to the program to ensure that the eligible student is able to utilize any scholarships awarded to the eligible student under the program within five years after the eligible student’s enlistment obligation in a reserve component of the armed forces ends, and to ensure that administrative requirements placed on the eligible student are minimized, to the extent possible. The bill requires the commission to adopt rules to administer the program. The bill defines “active duty”, “commission”, “eligible institution”, “eligible student”, “financial need”, and “full-time”. SF89 A bill for an act relating to the statewide interoperable communications system, and including effective date provisions. This bill requires the statewide interoperable communications system (SICS) board to process all applications for access to the SICS. The board shall not delegate this responsibility to any other committee, subcommittee, or third party. The approval of an application shall not be delayed by any other committee, subcommittee, or third party. An application for access to the SICS shall not be delayed or prevented from being forwarded to the board for approval by the board at the board’s next meeting following the submission of an application. The bill requires the board to provide voice and data access to any public entity or public service organization that is qualified to be an SICS user, or any public service organization that is sponsored by the head of a public entity. No public service organization, regardless of whether it has direct or sponsored system access, shall be required to have a contract or agreement with a public entity or other governmental organization in order to qualify for SICS access. A public service organization shall specify the user level required when submitting the initial application for SICS access based upon the needs and capabilities of the public service organization. A request to change user level may be made at any time after approval. The SICS board shall approve the user level submitted by a public service organization. The bill provides that all equipment and programming costs associated with communications on the SICS, including encryption equipment, shall be the sole responsibility of the public service organization to purchase, program, and maintain. The state will provide the system access setup, training, support, and electronic codes or keys to public service organizations at no cost. A decision by the board to deny access to, or to remove current access to, the SICS may be appealed by the public service organization to an administrative law judge of the department of public safety.
