LD1519 An Act to Create a Stewardship Program for Electronic Smoking Devices and Related Products This bill requires that, on or before November 1, 2026, a producer of electronic smoking devices, individually, collectively or through a stewardship organization, must submit to the Department of Environmental Protection for review and approval a plan for the establishment of a stewardship program to manage unwanted electronic smoking devices sold by the producer at the end of the device's life. One hundred eighty days after a stewardship plan is approved by the department, a producer of electronic smoking devices may not sell or offer for sale in the State an electronic smoking device unless the producer participates, individually, collectively or through a stewardship organization, in an approved electronic smoking device stewardship program. LD1775 An Act to Authorize the Issuance of a Revenue Bond to Upgrade County Jails to Meet the Corrections Needs of Maine's Counties This bill authorizes the Finance Authority of Maine to issue revenue bonds in the amount of $87,000,000 to provide funding to county jails, including those that detain adult residents for up to 72 hours, to upgrade their facilities to accommodate residents who have a substance use disorder and to provide treatment and recovery services for those residents and to provide supplemental funding for jails that may have potential funding shortfalls. The bonds are issued for 10 years and are repaid using equal amounts from revenue from the contract for wholesale spirits operations and the funds received from the opioid settlement funds. LD1219 An Act to Increase State Funding for the Campuses of the University of Maine System This bill requires that, beginning July 1, 2026, each campus of the University of Maine System be funded at no less than 95% of the funding that the campus's peer institution receives on a per student basis. Beginning July 1, 2027, each campus of the University of Maine System must be funded at no less than 100% of the funding that the campus's peer institution receives on a per student basis. For the purposes of these provisions, the bill provides that peer institutions are determined by the trustees for each campus of the University of Maine System. The bill also requires that, beginning July 1, 2025, the minimum hourly wage at the University of Maine System be equal to 125% of the State's minimum hourly wage. The bill also provides ongoing funds to support a 6% increase in funding for fiscal year 2025-26 and an additional 4% increase in funding for fiscal year 2026-27 to support the continuation of current University of Maine System operations. A member of the Penobscot Nation who is a resident of the State and who has lawfully killed or trapped and registered a bear, deer, moose or wild turkey or lawfully killed or trapped a wild bird within the Penobscot Indian territory may use, sell or offer for sale or aid in buying, selling or offering for sale bear, deer, moose, wild turkey and wild birds at an eating establishment, lodging place, mobile eating place or recreational camp or sporting camp that is located within the Penobscot Indian territory. LD754 An Act to Ban the Sale, Use and Possession of Single-use Electronic Cigarettes and to Review Extended Producer Responsibility Options for All Batteries This bill prohibits the sale, use and possession of single-use electronic nicotine delivery devices, which include electronic cigarettes, electronic cigars, electronic pipes, electronic hookahs and so-called vape pens. The bill establishes penalties for such sale, use and possession that are similar to the penalties for the sale of nicotine liquid containers that are not child resistant. The bill also directs the Department of Environmental Protection to convene a stakeholder group of interested parties to review the feasibility and viability of establishing an extended producer responsibility approach to all batteries not currently covered by an extended producer responsibility requirement, including, but not limited to, batteries used in electronic cigarettes, electronic cigars, electronic pipes, electronic hookahs and so-called vape pens. LD1224 An Act to Comprehensively Protect Consumer Privacy This bill enacts the Maine Consumer Privacy Act, which takes effect July 1, 2026. The Act regulates the collection, use, processing, disclosure, sale and deletion of nonpublicly available personal data that is linked or reasonably linkable to an individual who is a resident of the State, referred to in the Act as a "consumer," by a person that conducts business in this State or that produces products or services targeted to residents of this State, referred to in the Act as a "controller." Under the Act, a controller must limit the collection of personal data to what is adequate, relevant and reasonably necessary in relation to the purposes for which the controller processes that data, as disclosed in a privacy notice specifying the categories of personal data processed by the controller, the purposes for processing the personal data, the categories of personal data transferred to 3rd parties and the categories of 3rd parties to whom personal data is shared. A consumer has the right, under the Act, to confirm whether a controller is processing the consumer's personal data; to require the controller to correct inaccuracies in or delete the consumer's personal data; to obtain a copy of the consumer's personal data; and to opt out of the processing of the consumer's personal data for purposes of targeted advertising, sale or profiling in furtherance of decisions about the consumer's access to financial or lending services, housing, insurance, education, criminal justice, employment opportunities, health care services and essential goods and services. The privacy notice must describe how a consumer may exercise these rights. The controller must obtain the affirmative, informed consent of a consumer before processing the consumer's sensitive data, including data revealing the consumer's race or ethnic origins, religious beliefs, medical history or mental or physical health conditions or diagnoses, sexual orientation or citizenship or immigration status; genetic or biometric data used to uniquely identify an individual; precise geolocation data; data of a known child who has not attained 13 years of age; or data concerning the consumer's status as the victim of a crime. If the controller knows that the consumer has not attained 13 years of age, the controller may not process the consumer's data for any purpose without parental consent. If the controller knows or willfully disregards that the consumer is at least 13 years of age but has not attained 16 years of age, the controller may not process the consumer's data for targeted advertising and must obtain the consumer's consent before processing the consumer's data for sale. The Act prohibits a controller from processing data in a manner that discriminates against a person in violation of state or federal law. A controller is also prohibited from retaliating against a consumer for exercising the consumer's rights under the Act, except that a controller may offer different prices or selection of goods in connection with a consumer's voluntary participation in a bona fide loyalty or discount program. A controller must establish, implement and maintain reasonable data security practices. Beginning July 1, 2026, if a controller engages in a data processing activity that presents a heightened risk of harm to a consumer, including processing any data for targeted advertising, sale or profiling or any processing of sensitive data, the controller must conduct and document a data protection assessment to identify and weigh the benefits and potential risks of the processing activity. The controller may be required to disclose the data protection assessment to the Attorney General, who must keep it confidential, when the assessment is relevant to an investigation conducted by the Attorney General. The provisions of the Act do not apply to specifically enumerated persons, including the State, political subdivisions of the State and federally recognized Indian tribes in the State; financial institutions or their affiliates subject to the federal Gramm-Leach-Bliley Act that are directly and solely engaged in financial activities; state-licensed and authorized insurers that are in compliance with applicable Maine laws governing insurer data security and data privacy; and persons that both processed the personal data of fewer than 25,000 consumers in the preceding calendar year and derived no more than 25% of gross revenue from the sale of personal data. The Act also does not apply to persons that controlled or processed the personal data for purposes other than completing payment transactions of fewer than 100,000 consumers in the preceding calendar year, except that, beginning January 1, 2028, this exception applies only to persons that controlled or processed the personal data for purposes other than completing payment transactions of fewer than 50,000 consumers in the preceding calendar year. In addition, the provisions of the Act do not apply to specifically enumerated types of data, including: nonpublic personal information regulated under the federal Gramm-Leach- Bliley Act; health care information protected under the Maine Revised Statutes, Title 22, section 1711-C; protected health information under the federal Health Insurance Portability and Accountability Act of 1996; personal data regulated by the Family Educational Rights and Privacy Act of 1974; data processed and maintained by the controller regarding an applicant for employment or employee to the extent the data is collected and used within the context of that role; and data necessary for the controller to administer benefits. The Maine Consumer Privacy Act also does not prohibit controllers from engaging in specifically enumerated activities, including complying with state or federal law; complying with investigations or subpoenas from governmental authorities including the Federal Government and the government of a state or a federally recognized Indian tribe in the State; cooperating with federal, state or tribal law enforcement agencies; providing a product or service specifically requested by the consumer; protecting life and physical safety of consumers and preventing or responding to security incidents; and conducting internal product research, effectuating a product recall or performing other internal operations aligned with the expectations of a consumer. Violations of the Act may be enforced exclusively by the Attorney General under the Maine Unfair Trade Practices Act. Absent a showing of immediate irreparable harm, the Attorney General is required to provide a potential defendant with at least 30 days' notice prior to initiating an enforcement action, during which time the potential defendant may cure any violation alleged in the notice. Any civil penalties, attorney's fees or costs awarded to the State for a violation of the Act must be deposited in the Maine Privacy Fund, which is established to provide funding for the enforcement staff and activities of the Department of the Attorney General. The Act further requires the Attorney General to submit a report by February 1, 2027 to the joint standing committee of the Legislature having jurisdiction over judiciary matters regarding the operation and implementation of the Act. The bill provides an exception to allow a federal, state, county or local law enforcement officer to possess firearms in a municipality's buildings and voting places and at municipal public proceedings within the municipality. If a municipality adopts such an order, ordinance, policy or regulation, it is required to post, in a prominent location outside of all buildings and other places to which the order, ordinance, policy or regulation applies, notice of the limitation or prohibition against the possession of firearms, including any adopted exceptions to the limitation or prohibition. For a municipal public proceeding that is conducted in a part of a nonmunicipal building, the limitation or prohibition does not extend to those nonmunicipal parts or users of the building. Current law requires that the total number of votes cast for and against the question equals or exceeds 30% of the total votes cast in the municipality in the last gubernatorial election. The bill requires instead that the number of votes cast in favor of the question equals or exceeds 15% of the total votes cast in the municipality in the last gubernatorial election. Also, while this bill does not change the requirement that a majority of votes cast for and against the proposed change be in favor of it in order for that change to go into effect, it clarifies that blank votes are not counted in that calculation. It makes changes to the provision of law regarding the obligation of dealers and redemption centers to preserve the value of beverage containers. The changes include providing that a commingling group may refuse to accept, or pay the refund value and handling costs for, a beverage container that has been sorted in a manner that is inconsistent with an approved commingling agreement or an approved cooperative plan; and removing the authority for a commingling group to refuse beverage containers that have been processed by a reverse vending machine or account-based bulk processing program. 3. LD1885 An Act to Create a State Property Tax Directed Toward 2nd Homes for the Purposes of Funding Education, Early Childhood Programs and the Land for Maine's Future Trust Fund This bill creates the statewide property tax to impose a tax of 5 mills of the assessed value of real estate that is not exempt from taxation. This bill also establishes an exemption from the statewide property tax of the just value up to $1,000,000 for homesteads that are eligible for the Maine homestead property tax exemption, including being occupied by a permanent resident of the State as that person's permanent residence. The statewide property tax exemption applies only to the taxes assessed for the statewide property tax. The State Tax Assessor is directed to administer the statewide property tax in the same manner and under the same constraints as currently done for real property in the unorganized territory. The bill also creates 2 new funds, the Fund for Essential Programs and Services and the Early Childhood Education Fund. The Fund for Essential Programs and Services receives 50% of the revenue from the statewide property tax, which must be used to provide funds to school administrative units that do not achieve the annual target for the state share percentage of the statewide adjusted total cost of the components of essential programs and services, if that shortage is the result of a municipality within that school administrative unit having a higher poverty rate than the median poverty rate for the State and a lower median income rate than the median income rate for the State. The Early Childhood Education Fund receives 40% of the revenue from the statewide property tax, which must be used to provide funds for the purpose of expanding or developing early childhood education programs, as determined by the Commissioner of Education. The remaining 10% of revenue is deposited in the Land for Maine's Future Trust Fund. Dead

LD811 An Act to Require a Municipal Public Hearing and Vote Before a Sports Wagering Facility May Be Established This bill requires an applicant for a facility sports wagering license to request and receive approval from the municipal officers of the municipality in which the sports wagering facility is to be physically located before the director of the Gambling Control Unit within the Department of Public Safety may issue the license. The municipal officers are required to hold a public hearing for the consideration of the request to conduct sports wagering at a physical location within that municipality before issuing a decision, which must be provided to the applicant and the director in writing. An aggrieved applicant may appeal the decision of the municipal officers to the director. If the sports wagering facility is to be physically located in an unincorporated place, the applicant must request and receive approval from the county commissioners of the county in which the sports wagering facility is to be physically located.
