LD1705 An Act Regarding Adult Education Funding and Oversight This bill establishes the Career Advancement and Navigation Program within the Department of Education in collaboration with the Maine Community College System. The program requires the department to employ one college and career success coordinator at each community college campus to provide students with academic support, advisory services and referrals to community services. The bill also requires the Department of Education to annually assess adult education needs in the State relative to funding appropriated by the Legislature and requires the department to annually submit a report to the Legislature detailing its assessment and recommendations. The bill also requires the department to submit to the Legislature a detailed written explanation for any funding for adult education that is not disbursed in accordance with the reimbursement procedures described in the laws governing adult education. The department is also required to adopt guidelines for the use of state funds for adult education programs and to convene a stakeholder group to provide input on statewide goals for adult education, funding priorities and statewide program improvements. The bill requires the Legislature to appropriate from the General Fund an amount equal to 100% of the state obligation for adult education funding in accordance with the Maine Revised Statutes, Title 20-A, section 8606-A, subsection 4. LD1858 An Act to Promote Local Seafood in Schools This bill establishes the Local Seafood Fund to be used to match $1 for every $3 a school administrative unit pays for seafood purchased directly from a person who fishes commercially, a cooperative of persons who fish commercially, an aquaculture farmer, an aquaculture farmer's cooperative, a local food hub, a local food processor or a food service distributor in the State, to a maximum state contribution of $5,000 per school administrative unit in fiscal year 2025-26 and subsequent years or $5,500 per school administrative unit if funding is received and the school administrative unit sends a food service employee to a local seafood training program established and administered by the Department of Education pursuant to the bill. LD1163 Resolve, Directing the State Board of Education to Amend Its Educator Credentialing Rules to Create a Pathway for an Industrial Arts Endorsement This bill creates a pathway for a teacher to obtain an endorsement on a teacher certificate for a component of industrial arts with experiential, laboratory-based instruction. For a teacher to be eligible for an endorsement, the teacher must have: completed an apprenticeship program; completed a 2-year degree or certificate from a technical institution; completed a minimum number of hours of paid applied employment or teaching in the component area for which the endorsement is sought; and completed a minimum number of hours of experience learning the trade or craft for which the endorsement is sought. LD1760 An Act to Promote Public Education in Maine by Amending the Laws Governing Student Transfers This bill amends the laws governing student school transfers by: 1. Consolidating the provisions regarding elementary school transfers and secondary school transfers into one section of law; 2. Requiring notification of accepted transfers to parents and guardians and the sending school administrative unit and amending decision review procedures; 3. Establishing requirements regarding school capacity for transfer students and requiring school administrative units to report to the Commissioner of Education annually the number of transfer applications, acceptances and denials and the reason for each denial; 4. Requiring that a school administrative unit's transfer policy not discriminate against any student on the basis of that student's residential address, ability, disability, race, ethnicity, sex or socioeconomic status; 5. Requiring school boards of 2 or more school administrative units that wish to allow the transfer of students among the participating units to adopt mutual policies that set forth procedures and standards governing the transfers and requiring members of an education service center to adopt a mutual policy allowing the transfer of students among the member school administrative units; and 6. Requiring the commissioner to adopt rules to ensure that homeless students have unrestricted access to free public education. Dead
LD1887 Resolve, To Improve Air Quality and Ventilation in Newly Constructed Schools This resolve amends Resolve 2021, chapter 114, which required the Department of Education to amend its school construction and siting and basic approval standards rules to require standards governing air quality and ventilation for all public schools. LD1612 Resolve, Directing the Department of Transportation to Solicit Proposals for the Utilization of Unused State-owned Railroad Lines This resolve requires the Department of Transportation to develop and issue requests for proposals for each unused railroad line owned by the State no later than 180 days after the effective date of this resolve. The department must evaluate proposals based on criteria outlined in the requests for proposals, which may include financial feasibility and potential economic benefits to the State, consistency with environmental and community development objectives and a proposer's qualifications and ability to execute the proposed project. The department must allow proposals to include traditional rail services as well as innovative uses for recreational or commercial activities as long as they do not preclude the preservation of rights-of-way for future freight or passenger rail purposes in accordance with the State Railroad Preservation and Assistance Act. The department must submit a report to the joint standing committee of the Legislature having jurisdiction over transportation matters detailing the results of the request for proposals process within 90 days after the submission deadline. LD38 An Act Requiring Photographic Identification for Voting This bill requires the presentation of proof of identity in the form of a photograph identification document when voting in person. Acceptable forms of photograph identification are a current and valid driver's license or nondriver identification card issued in this State, a United States passport, a military identification or a permit to carry a concealed handgun issued in this State if that permit includes a photograph. An identification issued by a college or university may not be accepted for voter identification. LD1466 An Act Related to Excusing a School from Making Up Missed Days When It Cannot Operate During a Declared State of Emergency This bill requires the Commissioner of Education to exempt a school from making up missed instructional days in cases when the school is located in a section of the State for which a state of emergency has been declared by the Governor and the school was in fact unable to operate due to circumstances or conditions related to the reason for the emergency proclamation. The bill requires the Department of Education to update its rules and requires that the rules clarify that a school requesting the exemption may not be required to submit a waiver application. Dead
LD1588 An Act to Ensure Transparency in Student Transfer Requests This bill modifies the education laws governing student transfers to require greater transparency by school administrative units and the Commissioner of Education. The bill requires school administrative units to report information pertaining to requests by students to transfer either to or from that school administrative unit within the past year. The bill also requires the commissioner to make a de-identified version of that information available on the Department of Education's publicly accessible website, including information related to any transfer request reviewed by the commissioner. LD1344 An Act to Improve the Response Time to Tenant Mold Complaints This bill requires that a complaint for nonsurface mold in a tenant-occupied dwelling unit be investigated within 90 days of the complaint. The bill requires that if the investigation finds an unhealthy level of nonsurface mold, remediation efforts must be initiated by the landlord within 5 business days of the investigation. The bill requires a local health officer to investigate a dwelling unit to determine if all surface mold has been remediated. Finally, the bill provides that a tenant may file a complaint under the implied warranty and covenant of habitability laws if the landlord fails to remediate the nonsurface mold within 60 days of the report. LD1431 An Act to Implement an Interstate Voter Registration Cross-check Program This bill authorizes the Secretary of State to collaborate and cross-check voter registration data with other states to identify voters who may have moved out of the State and registered in another state. The bill also authorizes the Secretary of State to contract with a private sector data system provider to support a program for maintenance of voter registration. The bill also ensures that the personally identifying data and other information of the voters of the State are protected when exchanging data with other states and with a private sector data provider. LD681 An Act Regarding Public Higher Education Funding in the State This bill provides that, beginning in fiscal year 2025-26 and each fiscal year thereafter, the Legislature must increase the percentage of the Maine Maritime Academy's total state appropriation as a share of its total operating costs by 5% until the percentage of the Maine Maritime Academy's total state appropriation as a share of the academy's total operating costs equals at least the lesser of the percentages of the University of Maine System's and the Maine Community College System's total state appropriation as a share of each respective system's total operating costs. The bill also establishes the Commission to Study the Funding of Public Institutions of Higher Education to review the State's laws and rules related to higher education, analyze past, present and alternative methods and mechanisms of funding public higher education and analyze present and future goals, including expanding access to affordable higher education. The commission is required to submit a report based on its findings to the Joint Standing Committee on Education and Cultural Affairs by December 3, 2025. Passed
LD660 An Act to Provide Transparency and Public Access to Public School Curricula This bill requires school administrative units to adopt policies and procedures to ensure that the approved curriculum presented is implemented in the classroom without change, to post at least 3 years of data regarding certain student enrollment and performance, to maintain lists regarding participation in and development of professional development programs and to create an online portal that will act as the single source for all student information and data that can be accessed by 3rd-party contractors, including curriculum materials and information regarding speakers and guests. The bill requires the Department of Education to list and make available to the public all administrator, teacher and staff professional development and instructional programs offered to schools that are paid for with state funds and maintain a list of school boards that have approved a statewide program. The bill places restrictions on the choice of academic class offerings and curriculum materials and on-site professional development programs. Certain provisions of this bill are designed to satisfy federal law related to parental access to information and protection of pupil's rights. Dead
LD358 An Act to Increase Fees Paid to Registers of Deeds This bill increases fees paid to a county register of deeds for certain services. It implements a flat fee of $45 for receiving, recording and indexing instruments that do not already have a specific fee set forth in statute and changes the fee for recording, indexing and preserving plans to $45. The bill also increases fees applicable to electronic or printed images and electronic abstracts from a county registry of deeds website and increases the surcharge a register of deeds may collect per document. It also increases the fees associated with downloads of 1,000 or more consecutive electronic images or abstracts from a county registry of deeds and prohibits the buyer from selling such images or abstracts to another person. The bill also repeals a $13 fee for requests for more than one previously recorded instrument. In current law, an annual report is required from the register of deeds for each county to the joint standing committee of the Legislature having jurisdiction over state and local government matters on the amount of surcharge funds raised and expended and the use of those funds; the bill makes the report required only if requested by the committee. LD369 An Act to Grant or Extend Conditional Teaching Certificates Under Certain Circumstances This bill allows the Commissioner of Education to grant an extension of a conditional teaching certificate in the case of extenuating circumstances. The request for an extension must be accompanied by supporting documentation of the circumstances. The bill also allows the commissioner to issue a conditional certificate to an individual who has been employed as a full-time professor at a college or university in the State for at least 5 years and prohibits the Commissioner of Public Safety from assessing a fee for fingerprinting such an applicant. LD1389 An Act to Create the Building Opportunity Through Out-of-school Time Program This bill establishes the Building Opportunity Through Out-of-school Time Program within the Department of Health and Human Services as a competitive grant program to expand out-of-school programming opportunities for school-age youth by increasing or enhancing current programming, reducing barriers for access to out-of-school programming and creating new programming. It directs the department to issue by December 1, 2026 program grant awards to eligible community nonprofit organizations or libraries and monitor grantee performance and, no later than February 1, 2027 and annually thereafter, submit a report to the joint standing committee of the Legislature having jurisdiction over health and human services matters summarizing the operation of the program for the immediately preceding fiscal year. The bill appropriates $5,000,000 from the General Fund to the department for the 2026-27 fiscal year to carry out the requirements of the program. Passed
LD1881 An Act to Ensure the Rights of Parents of Minor Children in Education This bill provides that a parent is entitled to access all information regarding the school activities of the parent's minor child; review all information regarding mental, emotional and physical health care services available at the school the parent's minor child attends as well as teaching and instructional materials for the parent's minor child; receive a well- being questionnaire or health screening form before that questionnaire or form is administered to the minor child; access health care and educational records of the parent's minor child; and refuse the parent's minor child's participation in a noneducational or core assignment, activity or service or assignment of material and request an alternative assignment, activity or service or material. The bill prohibits the governing body of a school administrative unit from adopting procedures or student support forms that prohibit school administrative unit personnel from notifying a parent of a student about the student's mental, emotional or physical health or well-being or that encourage or have the effect of encouraging a student to withhold this information from the student's parent. It also prohibits school administrative unit personnel from discouraging or prohibiting parental notification of and involvement in critical decisions affecting a student's educational learning or mental, emotional or physical health or well-being. It provides an exception for a school administrative unit to adopt procedures that permit school administrative unit personnel to withhold information from a parent if a reasonably prudent person would believe that disclosure would result in child abuse or neglect or child abandonment. LD549 An Act to Establish a Statewide Sexual Assault Forensic Examination Kit Tracking System and Update Certain Requirements Regarding Sexual Assault Forensic Examination Kits This bill directs the Department of Public Safety to establish, operate and maintain a sexual assault forensic examination kit tracking system. The system must provide relevant information for victims, both those who choose to report to a law enforcement agency and those who choose not to report, and other approved users regarding the processing, custody, analysis and destruction of evidence. The department is required to submit an annual report beginning January 1, 2027 to the joint standing committee of the Legislature having jurisdiction over criminal justice and public safety matters and the Governor concerning information related to the status of sexual assault forensic examination kits reported in the tracking system. The bill provides requirements for the tracking system and requires the department to adopt routine technical rules, including rules regarding participation in the tracking system, confidentiality and the operation of the tracking system. The bill directs that, by June 1, 2026, a law enforcement agency that receives, maintains, stores or preserves sexual assault forensic examination kits must complete an inventory of all kits in its possession and report its findings to the Department of Public Safety. The department must compile all agency reports and present findings of the inventory by January 1, 2027 to the joint standing committee of the Legislature having jurisdiction over criminal justice and public safety matters and at the same time post the report on the department’s publicly accessible website. Public Law 2023, chapter 236 changed a provision in the Maine Revised Statutes, Title 25 to require law enforcement agencies to store sexual assault forensic examination kits for 20 years. For consistency with that provision, this bill amends a provision in Title 24 to require law enforcement agencies to store sexual assault forensic examination kits for 20 years. The bill allows an alleged victim who has not reported an alleged offense to a law enforcement agency to request that a completed kit be transported to the Maine State Police Crime Laboratory to be processed by signing a consent form, and the results of the analysis must be kept anonymous. The bill requires that, beginning January 1, 2027, and every 5 years thereafter, all completed kits that identify an alleged victim and are being stored by a law enforcement agency must be transported to the Maine State Police Crime Laboratory and be processed on a rolling basis, beginning with kits most recently stored. The bill also requires all forensic examination kits completed on or after January 1, 2027 to be transported to the Maine State Police Crime Laboratory and be processed. In Committee
LD1404 Resolve, to Create a Working Group on the Status of School Libraries and on Public Libraries in Maine This resolve directs the State Librarian to convene a working group on the status of school libraries and public libraries in the State. The working group is required to study: 1. Library services for specific segments of the Maine population; 2. The role that libraries play in emergency preparedness; cultural diversity and inclusion; public health and safety; community identity and resiliency; economic development; and 3. Access to public services and resources; and the current overall status of school and public libraries in the State, including information on partnerships, resources, facilities, technology and staffing. The State Librarian is required to submit a report of the working group's findings and recommendations by November 1, 2027 to the joint standing committee of the Legislature having jurisdiction over education and cultural affairs, which is authorized to report out legislation based on the report to the Second Regular Session of the 133rd Legislature. LD482 An Act to Expand Educational Opportunities and Broaden Educational Services for Students Enrolled in Equivalent Instruction Programs This bill modifies the provisions of law governing standards for participation in public school by students who are enrolled in equivalent instruction programs. Equivalent instruction programs include home instruction programs, private schools or other alternative arrangements approved by the Commissioner of Education. Current law provides different standards for participation in public school for students enrolled in home instruction programs as opposed to students enrolled in certain recognized private schools. The bill amends the law to provide one set of standards to apply to all types of equivalent instruction programs. The bill makes changes related to the approval process that a student enrolled in an equivalent instruction program must follow to participate in regular classes in a public school. These changes include eliminating the requirement that a student receive written approval from the superintendent or the superintendent's designee to enroll in or audit a course and modifying the terms used to describe the academic achievement a student must demonstrate in order to participate. The bill allows an equivalent instruction program to use facilities on property owned or leased by a library, community service organization, museum, performing arts venue, theater, cinema or church facility if the property is being used solely for the purpose of operating a type of facility described in the bill, the facility is or was actively used for one of those purposes within 5 years of any executed agreement for the equivalent instruction program to use that facility and the facility follows the state and local health, safety and welfare laws, codes and rules applicable to that facility, including fire safety and building safety. LD1927 An Act to Protect Housing Quality by Enacting Mold Inspection, Notification and Remediation Requirements This bill requires a landlord, upon receipt of a request from a tenant, to inspect a dwelling unit within 24 hours following a leaking event or for visible mold or dampness. The bill also requires a landlord to demonstrate reasonable effort to repair the source of the leak and restore the area within 5 days of inspection. The bill requires a tenant to, after reasonable notice, allow the landlord or the landlord's agent access to the dwelling unit for remediation purposes. Finally, the bill gives remedies and enforcement mechanisms to the landlord and the tenant for noncompliance with the duties given under these provisions. In Committee

LD928 An Act to Maintain Public Access to Town Ways in Maine This bill provides that if the municipal officers or county commissioners have declared a town way discontinued by abandonment and have retained a public easement in the abandoned town way under this section for at least 15 years, the municipality, county commissioners or an abutter on the way may not gate, bar or otherwise obstruct the town way. The board is directed to establish hope accounts that may be used by the parents or legal guardians of qualified students to pay for the education of those students enrolled in certain private schools and students receiving home instruction. The funding for these hope accounts comes from shifting 90% of the essential programs and services funding that would otherwise be provided by the State and by the school administrative unit for each qualified student into a hope account. LD169 Resolve, Establishing the Commission to Study MaineCare Estate Recovery This bill requires the Department of Health and Human Services to return the state portion of estate recovery under the MaineCare program to the estate. This requirement does not impact the portion that is required to be paid to the Federal Government for estate recovery for Medicaid. The bill requires the department to amend its rules in Chapter 332: MaineCare Eligibility Manual, Part 15, Transfer of Assets, to change the standard for transfer of assets from "clear and convincing evidence" to a "preponderance of evidence." The rule is a major substantive rule. The bill also requires the department to develop educational materials to assist individuals with accessing programs that allow family members or legal guardians to be reimbursed for providing personal care services to a family member who is eligible to receive home and community-based services under the MaineCare program or a state-funded program. LD1689 An Act to Implement the Recommendations of the Commission to Study Expansion of Public Preschool and Early Care and Education This bill implements the recommendations of the Commission to Study Expansion of Public Preschool and Early Care and Education, which was established pursuant to Public Law 2023, chapter 477. It provides that a public elementary school constructed after October 1, 2025 must include an area that may be used for preschool instruction or child care. It directs the Department of Education to revise the essential programs and services funding formula regarding the method it uses to fund preschool instruction to use a method similar to that used for funding kindergarten instruction in order to provide incentives to school administrative units to provide full-day preschool instruction. It directs the Department of Education to study early childhood educator and provider credentialing procedures and policies as they relate to nursery school teachers, preschool teachers, kindergarten teachers and elementary school teachers. The department is required to identify barriers to the expansion of preschool programs in this State and recommend improvements to early childhood educator and provider credentialing procedures and policies that would provide greater flexibility in credentialing and facilitate the expansion of preschool programs by school administrative units. It directs the Department of Health and Human Services, in collaboration with the Department of Education and stakeholders, to study the standards and rules for early childhood educators and providers in order to better align standards and rules across early childhood educators and providers and reduce barriers to the expansion of preschool programs and the provision of early childhood education services. It requires the Department of Education and the Department of Health and Human Services to each report their findings, including any suggested legislation, to the Joint Standing Committee on Education and Cultural Affairs and the Joint Standing Committee on Health and Human Services no later than December 3, 2025. The Joint Standing Committee on Education and Cultural Affairs and the Joint Standing Committee on Health and Human Services each may report out legislation based on the reports to the Second Regular Session of the 132nd Legislature. The bill provides funding to establish 4 regional coordinator positions in the Department of Education to work with schools and potential partners in different regions of the State that are looking to start or expand public preschool programs. The bill also provides a total of $4,000,000 for fiscal years 2025-26 and 2026-27 for a preschool expansion grant program. Dead
