LD1812 An Act to Establish the Loans for Trade Tools Program This bill, to encourage participation in the trades, does the following. 1. It establishes the Loans for Trade Tools Program, which is a program administered by the Finance Authority of Maine to provide low-interest loans to graduates of a trade program for the purchase of tools and equipment necessary for employment in a trade. Loans are limited to $20,000 and must be repaid within 10 years. If an employee maintains full-time employment, meaning at least 32 hours per week, in the trade, that employee's loan may be forgiven. 2. It establishes a tax credit for employers of employees engaged in a trade for the purchase of tools or equipment needed by that employee within the first year of employment with that employer. The credit is limited to 25% of the amount of the cost of the trade tools and $5,000 per employee, is nonrefundable and may not be carried forward from year to year. 3. It provides an appropriation of $1,000,000 for each year of the 2026-2027 biennium to the Finance Authority of Maine for the Loans for Trade Tools Program. Passed
LD1804 An Act Concerning Funding and Oversight of Transportation Matters This bill amends the laws related to legislative oversight of transportation funding and use of the funds from the Highway Fund. The bill: 1. Codifies the joint standing committee of the Legislature having jurisdiction over transportation matters as having jurisdiction over the Highway Fund. It updates references to the Highway Fund; 2. Establishes a minimum level of funding for transportation infrastructure programs related to bridges, highway lights and multimodal transportation, and requires the State Budget Officer to adjust the minimum level of funding by the percentage change in the Consumer Price Index each biennium beginning July 1, 2027; 3. Increases, from 40% to 60%, the percentage of automobile-related sales and use taxes transferred to the Highway Fund and adds automobile-related sales and use taxes to the list of revenue that is allocated to and becomes part of the Highway Fund beginning July 1, 2027; 4. Provides for the net revenue from liquor operations to be deposited as undedicated revenue to the General Fund, rather than being split between undedicated revenue to the General Fund and undedicated revenue to the Highway Fund; 5. Provides for state funding for the Department of Public Safety, Bureau of State Police to come solely from the General Fund, rather than being split between the General Fund and the Highway Fund, beginning in fiscal year 2027-28; 6. Removes the Department of Public Safety, Bureau of State Police from the list of allowable uses of the Highway Fund; 7. Adds multimodal transportation to the list of allowable uses of the Highway Fund; 8. Redefines “transportation infrastructure” to mean the infrastructure, assets, facilities and systems related to all modes of transportation, including highways, bridges, aviation, transit, railroads, ferries, ports and other marine infrastructure, trails and bicycle and pedestrian facilities, as well as all buildings, utilities and other appurtenances related to those modes; 9. Removes the designation of project-specific and nonproject-specific procurement and retains the provision that the Department of Transportation has full power to purchase all supplies, materials and equipment that are incidental to, or necessary for, construction, improvement or maintenance of transportation infrastructure; and 10. Requires, beginning March 1, 2026, the Department of Transportation and the Maine Turnpike Authority to submit biennial reports in each even-numbered year, summarizing the procurement activities over the preceding 2 calendar years. LD1032 An Act Regarding Court Security This bill requires the State Court Administrator to contract for the services of qualified individuals to perform court security-related functions and services at a court if court operations at that court have been adversely affected by a lack of available court security for more than 2% of scheduled court time in a month at that court. It provides that, when the State Court Administrator contracts for the services of qualified individuals to perform court security-related functions and services, the State Court Administrator must first offer the contract to the appropriate sheriff's office before the contract is offered to another party. LD1169 An Act Regarding Employer Payments for the Paid Family and Medical Leave Benefits Program Current law allows an employer that has a private plan substantially equivalent to the paid family and medical leave plan established in the Maine Revised Statutes, Title 26, chapter 7, subchapter 6-C and administered by the Department of Labor to apply for and receive approval to not participate in the department's plan. Until approval is given, the employer is responsible for the premiums of 1% of each employee's wages, 50% of which may be paid by the employee. This bill allows an employer whose private plan is approved by the department to request a refund of the premiums paid if that employer had a substantially equivalent private plan in place on or before January 1, 2025, the date that premiums started to be due. The department or administrator, after verifying the amount paid by the employer, is required, within 90 days of receipt of the refund request, to refund the employer the premiums paid, plus interest that accrues to the date the refund payment is issued. The bill also requires the department to make available information regarding the availability of a refund. Dead
LD332 An Act to Establish Mandatory Minimum Sentences for Gross Sexual Assaults Against Children and Aggravated Sex Trafficking of Children This bill provides that if the State pleads and proves that a gross sexual assault was committed against an individual who had not yet attained 12 years of age, the court is required to impose a definite term of imprisonment of not less than 25 years, none of which may be suspended. It also provides that, in the case of a gross sexual assault committed against an individual who had not yet attained 12 years of age when the defendant had previously been convicted and sentenced for committing gross sexual assault, formerly denominated as gross sexual misconduct, or rape against an individual who had not yet attained 12 years of age or that the defendant had previously been convicted and sentenced for engaging in substantially similar conduct in another jurisdiction against an individual who had not yet attained 12 years of age, the court is required to instead impose a term of imprisonment for life. It also provides that, in the case of aggravated sex trafficking for which the State pleads and proves that the defendant knowingly promoted prostitution of a person who had not yet attained 12 years of age, the court is required to set a definite term of imprisonment of not less than 25 years, none of which may be suspended. LD1549 RESOLUTION, Proposing an Amendment to the Constitution of Maine Regarding the Use and Oversight of Transportation-related Revenues This resolution proposes to amend the Constitution of Maine to provide that, beginning July 1, 2027, at least 60% of automobile-related sales and use tax revenue must be transferred to the Highway Fund and must be expended solely for costs of all modes of transportation, including public highways, bridges, aviation, transit, railroads, ferries, ports and other marine infrastructure, trails, pedestrian infrastructure and bicycle facilities and related appurtenances. It provides that such a student must meet the voting residency qualifications and that the student may be considered a permanent resident for homestead property tax exemption purposes and a resident for estate tax purposes, subject to resident income taxes and eligible to run for state office. A family member of the student may be eligible for in-state tuition rates at a postsecondary educational institution in the State. The bill also requires a person to be a graduate of a high school in the State or reside in the State for at least 2 years prior to enrollment in a Maine community college in order to be eligible for free tuition in the Maine Community College System. SUMMARY This resolve creates the Independent Commission to Study the Effects of 5G and Other Non-ionizing Radio Frequency Radiation-emitting Technology. The independent commission is directed to review scientific literature related to the effects of so-called 5G wireless technology and other non-ionizing radio frequency radiation-emitting wireless technology on bird, bee, insect and other wildlife populations and to study the effects of long-term and acute exposure to 5G and other non-ionizing radio frequency radiation- emitting wireless technology and radio frequency radiation on children. The independent commission is required to report findings to the Joint Standing Committee on Energy, Utilities and Technology and the Joint Standing Committee on Education and Cultural Affairs no later than December 3, 2025. LD397 An Act to Require a Voter to Show Photographic Identification This bill requires the presentation of proof of identity in the form of a photograph identification document when voting in person or by absentee ballot and removes certain official documents from the list of forms of documentation accepted to verify the identity of an applicant who is registering to vote. Under the bill, acceptable photograph identification is a current and valid driver's license or nondriver identification card issued in this State, a United States passport, a military identification or a permit to carry a concealed handgun issued in this State if that permit includes a photograph. The bill provides that a student photograph identification document issued by a college or university in this State may not be accepted for voter identification when voting or when registering to vote. The bill also allows a person who does not possess a photograph identification document to request a free special voter photograph identification card from the Secretary of State. Dead
LD1608 An Act to Counter Unlawful Cannabis Cultivation This bill allows the Department of Administrative and Financial Services to deny a registry identification card or registration certificate to any person who would be authorized under that registration to cultivate cannabis at a geographical location that has been the site of repeated violations under the Maine Medical Use of Cannabis Act or the Cannabis Legalization Act. It allows the department to place a moratorium not to exceed 10 years on such geographical locations for the purpose of issuing or renewing a registration. It also allows the Office of Cannabis Policy within the Department of Administrative and Financial Services to place a moratorium not to exceed 10 years on any geographical location that has been the site of repeated violations under the Maine Medical Use of Cannabis Act or the Cannabis Legalization Act for the purposes of issuing or renewing licenses under the Cannabis Legalization Act. LD880 An Act Regarding Nondiscrimination in Financial Services This bill requires financial institutions to provide financial services to clients based on quantitative, impartial, risk-based financial standards. If a financial institution uses nonfinancial, nontraditional or subjective criteria in approving or denying financial services for a person, the financial institution must disclose the criteria to the Department of Professional and Financial Regulation, Bureau of Financial Institutions and the client. LD735 An Act to Protect Sand Dunes on Sears Island and to Establish Criteria for Legislation Regarding Land Development This bill repeals the provisions in law that authorize the Department of Environmental Protection to consider and potentially grant a permit under the Maine Revised Statutes, Title 38, section 480-D for construction of an offshore wind terminal on Sears Island in the Town of Searsport to be located on or that will otherwise impact a coastal sand dune system on the island. The bill also repeals the provisions in law that direct the Department of Transportation, in collaboration with the Maine Coast Heritage Trust, to take all reasonable steps to ensure the conservation and protection of a parcel of land in the northwest portion of Sears Island that is approximately 10 acres in size and that includes a coastal sand dune system that is approximately 1 1/2 acres in size. The bill also requires that any legislation proposing to enact a measure regarding the development of land that is in conflict with United States Environmental Protection Agency regulations may be sponsored only by a member of the House of Representatives or Senate who represents the affected district and may be enacted only with a 2/3 vote of the Legislature. The bill also prohibits the State from authorizing any land development on Sears Island without first establishing an indigenous lands protection committee and obtaining from that committee a certification that any area to be developed does not contain a site sacred to indigenous people in Maine. A school chaplain must be certified, licensed or ordained by a faith organization recognized by the United States Department of Defense but is not required to be certified by the Department of Education. A school chaplain must undergo fingerprinting and a criminal background check and may not be listed on a sex offender registry in this State or another jurisdiction. A school chaplain is immune from civil liability for acts and statements made as a school chaplain except for malicious, willful and deliberate acts or statements intended to cause harm or intimidate.
