LD1926 An Act to Require Increased Housing Density or Lower Minimum Lot Sizes for Workforce Housing This bill requires municipalities to allow for increased housing density or lower minimum lot sizes for housing developments rented or sold to households earning less than 220% of the median income for the area as defined by the United States Department of Housing and Urban Development. The bill requires that the owner of a housing development with a housing density or minimum lot size adjustment under the bill file in the appropriate registry of deeds a declaration of restrictive covenant that requires the units in the development to be rented or sold in accordance with the income limitations in the bill for a period of 30 years. The bill requires a municipality to determine compliance with requirements applicable to the structure or number of lots or units based on the size of the structure or number of lots or units prior to a dwelling unit increase or an alternative minimum lot size allowance. It provides that a workforce housing development that receives a density increase is in compliance with any state or local requirement that a certain number or percentage of units be affordable housing units as defined by the state or local requirement. LD549 An Act to Establish a Statewide Sexual Assault Forensic Examination Kit Tracking System and Update Certain Requirements Regarding Sexual Assault Forensic Examination Kits This bill directs the Department of Public Safety to establish, operate and maintain a sexual assault forensic examination kit tracking system. The system must provide relevant information for victims, both those who choose to report to a law enforcement agency and those who choose not to report, and other approved users regarding the processing, custody, analysis and destruction of evidence. The department is required to submit an annual report beginning January 1, 2027 to the joint standing committee of the Legislature having jurisdiction over criminal justice and public safety matters and the Governor concerning information related to the status of sexual assault forensic examination kits reported in the tracking system. The bill provides requirements for the tracking system and requires the department to adopt routine technical rules, including rules regarding participation in the tracking system, confidentiality and the operation of the tracking system. The bill directs that, by June 1, 2026, a law enforcement agency that receives, maintains, stores or preserves sexual assault forensic examination kits must complete an inventory of all kits in its possession and report its findings to the Department of Public Safety. The department must compile all agency reports and present findings of the inventory by January 1, 2027 to the joint standing committee of the Legislature having jurisdiction over criminal justice and public safety matters and at the same time post the report on the department’s publicly accessible website. Public Law 2023, chapter 236 changed a provision in the Maine Revised Statutes, Title 25 to require law enforcement agencies to store sexual assault forensic examination kits for 20 years. For consistency with that provision, this bill amends a provision in Title 24 to require law enforcement agencies to store sexual assault forensic examination kits for 20 years. The bill allows an alleged victim who has not reported an alleged offense to a law enforcement agency to request that a completed kit be transported to the Maine State Police Crime Laboratory to be processed by signing a consent form, and the results of the analysis must be kept anonymous. The bill requires that, beginning January 1, 2027, and every 5 years thereafter, all completed kits that identify an alleged victim and are being stored by a law enforcement agency must be transported to the Maine State Police Crime Laboratory and be processed on a rolling basis, beginning with kits most recently stored. The bill also requires all forensic examination kits completed on or after January 1, 2027 to be transported to the Maine State Police Crime Laboratory and be processed. Passed
LD849 An Act to Establish a Recall Process for Public School Board Members This bill provides that public school board members may be recalled only for specified behavior or misconduct and may not be recalled for the performance of a required duty or a discretionary duty. The petition to recall the school board member must be signed by at least 25% of the voters who voted in the last gubernatorial election in the municipality or, if the school board member was elected as a school board member-at-large, by at least 25% of the voters who voted in the school administrative unit in the last gubernatorial election. The recall must be approved by a majority of voters in an election in which the total number of ballots is at least 35% of the number of votes cast in the municipality or, if applicable, the school administrative unit in the last gubernatorial election. LD1177 Resolve, to Study the Public Health and Environmental Risks from Synthetic Turf This resolve puts a 3-year moratorium on the installation or reinstallation of synthetic turf in any park, outdoor playing field or athletic field, indoor athletic facility or similar venue. It directs the Department of Environmental Protection to examine whether synthetic turf is a risk to public health, the surrounding environment and the climate emissions goals of the State as compared to turf and, if it is a risk, the ways in which synthetic turf is a risk. It directs the department to submit, no later than November 4, 2026, a report that includes its findings and recommendations, including suggested legislation, for presentation to the 133rd Legislature in 2027. It creates the position of auditor of the Maine Information and Analysis Center within the Office of the Attorney General. 2. It adds a definition for "de-identified" and requires that reports submitted to the joint standing committee of the Legislature having jurisdiction over criminal justice and public safety matters and posted on the publicly accessible website of the auditor of the Maine Information and Analysis Center be de-identified. 3. It provides that the powers and duties of the auditor include ensuring that the center operates within the law and in a manner that preserves the privacy, civil liberties and civil rights of all people in the State. 4. It requires that reports of the auditor to the committee that are posted on the auditor's publicly accessible website may not contain any records that are confidential or otherwise not authorized by law to be disseminated to the public. 5. It specifies that the identity of any person who submits a good faith complaint to the auditor against the center using the auditor's publicly accessible website or by other means is confidential and that the auditor must maintain the identity of such persons as confidential. 6. LD500 An Act to Ensure Access to Safe Drinking Water from Household Wells in Rural Areas by Expanding Testing This bill adds contaminants to the Department of Health and Human Services' uniform testing recommendation for private wells. The bill requires a program to provide free testing for perfluoroalkyl and polyfluoroalkyl substances in household well water of low- income residents through contracts with qualified laboratories to be paid for by funds from the department's Health and Environmental Testing Laboratory dedicated account. The department is required to conduct educational outreach to make low-income residents aware of the availability of free testing of well water and eligibility for grants from the Maine State Housing Authority to pay for water treatment systems. The bill clarifies that homeowners served by well water that exceeds state standards for perfluoroalkyl and polyfluoroalkyl substances and other contaminants are eligible for the grants. Passed

LD1247 An Act to Restrict Municipal Ordinance Requirements Regarding Housing Developments This bill provides restrictions on municipal ordinance requirements related to minimum lot size in areas where water and sewer infrastructure are available. For a housing development that is served by a public, special district or other centrally managed water system and a public, special district or other comparable sewer system and that is located in an area in which dwelling units are allowed, a municipality must allow a dwelling unit on a lot with a minimum size of 5,000 square feet. LD1138 An Act to Reduce Pollution Associated with Transportation in Alignment with the State's Climate Action Plan This bill implements the following provisions designed to limit greenhouse gas emissions from the transportation sector. 1. It amends the law regulating state monitoring of, reporting on and compliance with the requirements for gross and net annual greenhouse gas emissions reductions levels to require the Department of Transportation to adopt rules necessary to ensure compliance with those reductions levels. Under current law, the Department of Transportation is authorized but not required to adopt such rules. 2. It requires the Department of Environmental Protection, by December 31, 2025, to adopt rules establishing greenhouse gas emissions limits specific to different source categories within the transportation sector that are designed to be achieved through biennial targets imposed over a 10-year period and to ensure compliance with established gross and net annual greenhouse gas emissions levels and with the transportation-specific greenhouse gas emissions reductions projections established in the climate action plan under the Maine Revised Statutes, Title 38, section 577, subsection 5-A. The Department of Transportation is required to adopt rules necessary to ensure compliance with those greenhouse gas emissions limits established by the Department of Environmental Protection by rule. 3. It requires the Department of Transportation to develop and, by July 1, 2026, publish a plan that, at a minimum, sets forth strategies for reduction of greenhouse gas emissions from the transportation sector necessary to achieve the greenhouse gas emissions reductions and limits under Title 38, section 576-A and strategies for reduction of statewide vehicle miles traveled in accordance with the targets identified in the climate action plan. 4. It provides that, beginning July 1, 2026, prior to inclusion of a capacity expansion project in a Department of Transportation or Maine Turnpike Authority transportation improvement program, work plan or long-range transportation plan, the department or the authority, as applicable, must complete an impact assessment of the project. The bill defines "capacity expansion project" as a transportation project that results in modifications or other changes to a transportation facility and that is designed to improve vehicle travel time or increase maximum throughput. The impact assessment process is to be used by the department or the authority to determine whether a capacity expansion project is consistent with the transportation greenhouse gas emissions reductions plan under Title 23, section 4209-C, the transportation-related targets in the climate action plan and the transportation sector greenhouse gas emissions limits. The impact assessment must, at a minimum, include projections for greenhouse gas emissions associated with the capacity expansion project over a 20-year period, net change in vehicle miles traveled for the affected transportation network as a result of the capacity expansion project and the direct impacts and induced demand impacts of the capacity expansion project on vehicle miles traveled for the affected transportation network as a result of the project. If, through the impact assessment, the department or the authority determines that the project is not consistent with the plan, targets and limits, the department or the authority must alter the scope or design of the project to ensure greater consistency with the plan, target or limits, incorporate sufficient mitigation measures into the project or halt project development. The bill describes the types of mitigation measures that may be incorporated into a capacity expansion project and sets forth the criteria for determining whether such mitigation measures will be considered sufficient to allow the project to proceed. 5. It establishes the Transportation Climate Technical Committee to assist in the development and review of the transportation greenhouse gas emissions reductions plan to assist the Department of Transportation and the Maine Turnpike Authority in the implementation of the requirements and processes for evaluating the greenhouse gas emissions associated with capacity expansion projects under Title 23, section 710, and to otherwise advise the Department of Transportation, the Maine Turnpike Authority and the Legislature regarding achievement of the transportation sector targets identified in the transportation greenhouse gas emissions reductions plan, the climate action plan and the greenhouse gas emissions reductions levels and limits. LD1120 An Act to Promote the Secure Storage of Firearms Under current law, it is a Class D crime to negligently store a loaded firearm in a manner that allows a child under 16 years of age to gain access to the loaded firearm without the permission of the child's parent. This bill repeals that law and makes it a Class D crime to negligently store a firearm so that a minor or person who is prohibited from possessing a firearm may gain access to the firearm and either use it in the commission of a crime or display it in a threatening manner. The bill also makes it a Class C crime to negligently store a firearm in a way so that a minor or prohibited person may gain access to the firearm and use it to cause the death of or serious bodily injury to any person. The bill also requires licensed firearms dealers to post a notice in any area where sales or transfers occur informing purchasers that access to a firearm in the home significantly increases the risk of suicide, death during domestic violence disputes and unintentional death of children. The bill stipulates that the department may waive access management rules and issue a permit for a driveway only if the property is located within a locally designated growth area identified in a state- approved comprehensive plan. LD1073 An Act to Amend Provisions of the Maine Metallic Mineral Mining Act to Advance Health Equity and Improve the Well-being of Vulnerable Populations This bill provides a number of amendments to the Maine Metallic Mineral Mining Act, including the following. 1. In addition to other requirements provided under current law, the bill requires an applicant for a mining permit to: A. Submit a human health impact assessment for the proposed mining operation that identifies all potential emissions and effects from the mining operation in a proposed mining area and affected area that can reasonably be expected to cause or threaten harm to human health and to particularly vulnerable populations. The assessment must include a baseline health data evaluation for the population surrounding the mining operation; B. Demonstrate specific plans to provide for and fund the perpetual treatment and monitoring of mine waste and tailings in the event that the applicant fails to satisfy applicable mine waste or tailings management requirements, applicable closure and post-closure monitoring requirements or other applicable requirements resulting in the need for perpetual treatment of mine waste or tailings following closure; C. Demonstrate specific plans to address natural events that may affect mining operations and for the implementation of climate adaptation measures as specified by rule; and D. Demonstrate specific plans for ensuring that the mining operation will use clean energy measures and technologies to the greatest extent practicable. 2. In addition to other restrictions provided under current law, the bill prohibits the Department of Environmental Protection from issuing a mining permit for a mining operation that: A. Will involve or result in the release of perfluoroalkyl and polyfluoroalkyl substances into the air, soil, groundwater or surface water within any mining area or affected area; B. Will involve the use of explosives or other blasting materials that contain perchlorate; or C. Does not meet all applicable setback requirements specified in rule, which must include, but are not limited to, minimum setbacks from schools, day care facilities, residences, hospitals, national and state parks, elder care facilities, community gardens, churches, locations considered sacred by federally recognized Indian tribes, nations or bands in the State, water bodies and wildlife refuges. 3. In addition to other requirements provided under current law, the bill requires a mining permittee to: A. Comply with applicable air quality standards and requirements through direct measurement of emissions and not by estimating emissions concentrations; to conduct air emissions monitoring for the pollutants described in the State's ambient air quality standards laws and for other hazardous air pollutants specified in rule; to install and operate fenceline monitoring equipment for air emissions from any stack, flue, chimney, vent or other potential source of air pollution within a mining area; and to ensure the monitoring and measurement of fugitive emissions to the air within a mining area; and B. Provide proof of and maintain comprehensive general liability insurance for the mining operation for the same duration as financial assurance is required by law, which must provide sufficient coverage to address potential harm to members of the public located adjacent to or in proximity to mining areas or affected areas. 4. The bill amends the provisions of the mining law regarding imminent endangerment to provide the department with authority to take action necessary to prevent an imminent and substantial endangerment to the public health or safety, environment or natural resources that a mining operation has the potential to cause or result in, regardless of whether a violation exists. 5. The bill amends certain definitions within the mining law and makes other associated changes to the mining law to provide for the regulation of smelting or refining activities and facilities that are part of the mining operation. If a mining operation involves on-site smelting or refining activities or facilities, if mine waste or other materials resulting from those activities is removed for off-site storage or disposal, the permittee must conduct post-closure groundwater monitoring at any location where the mine waste or other materials are stored or disposed. 6. The bill amends permittee notification requirements to require the provision of information to communities surrounding a mining operation regarding air emissions and other fugitive emissions, material safety data for all chemicals and substances used in the mining operation and the results of studies or modeling regarding the mining operation. At the request of a surrounding community that receives such information, the permittee must attend a public meeting to provide additional information. Dead

On or before January 1, 2026, the department is required to submit to the Joint Standing Committee on Environment and Natural Resources a report outlining the findings and recommendations of the evaluation and including any proposed legislation, and the committee may report out related legislation to the Second Regular Session of the 132nd Legislature. 2. It requires the Department of Administrative and Financial Services, Bureau of General Services and the Department of Environmental Protection to evaluate options for amending the operating services agreement of February 5, 2004, as amended, between the bureau and the operator of the state-owned Juniper Ridge Landfill in the City of Old Town concerning the operation of the landfill for the purpose of enhancing the transparency and oversight of the operation of the landfill and of the activities of the operator of the landfill. On or before January 1, 2026, the bureau and the Department of Environmental Protection are required to jointly submit to the Joint Standing Committee on Environment and Natural Resources a report outlining the findings and recommendations of this evaluation and including any proposed legislation. After reviewing the report, the committee may report out related legislation to the Second Regular Session of the 132nd Legislature. 3. It requires the Department of Administrative and Financial Services, Bureau of General Services to initiate a process to negotiate an amendment to the operating services agreement of February 5, 2004, as amended, with the operator of the state-owned Juniper Ridge Landfill in the City of Old Town concerning the operation of the landfill. It prohibits the bureau from executing any amendment to that agreement prior to the bureau's submission of an application for a public benefit determination for a license for the expansion of the landfill in accordance with the Maine Revised Statutes, Title 38, section 1310-AA and unless the amendment to the agreement includes certain specified provisions. Those provisions include requirements that the operator disclose and make available to the bureau the terms and conditions of all contracts and agreements between the operator and its contractors, subcontractors and customers regarding the use, operation and maintenance of the landfill and requirements that the operator implement and operate at the landfill the technology, facilities or processes necessary to ensure that the leachate collected from the landfill is treated prior to discharge such that the concentration of regulated PFAS contaminants in the treated leachate does not exceed specified standards.
