LD1672 | An Act to Allow Participation in the Adult Use Cannabis Tracking System to Be Voluntary | This bill amends the Cannabis Legalization Act to provide that a cannabis establishment licensee may voluntarily elect, but is not required, to use the tracking system for adult use cannabis and adult use cannabis products implemented and administered by the Department of Administrative and Financial Services, Office of Cannabis Policy. The office is directed to adopt major substantive rules regarding minimum inventory control system and other requirements that must be satisfied by a licensee that does not voluntarily elect to use that tracking system implemented and administered by the office. The bill also prohibits the office from renewing, extending, negotiating or entering into any contract or other agreement with a 3rd-party entity for the administration of, or otherwise relating to, the tracking system for adult use cannabis and adult use cannabis products. The office is directed to, as expeditiously as possible, take all reasonable steps to cancel or terminate any such existing contracts or agreements with 3rd-party entities, subject to the terms, conditions and other limitations of those contracts or agreements. For a detention or correctional facility administered by the Department of Corrections, it requires the department to provide a resident a telephone and video call allowance for 90 minutes of free telephone and video calls per week. The department also must provide a resident free telephone and video calls with the resident's attorney. A service provider may not charge a fee to deposit money into a resident's telephone or video call account. For a municipal or county jail, it requires the sheriff or jailer to provide a resident with a reasonable opportunity to make telephone and video calls to relatives and friends, except that the sheriff or jailer may restrict or prohibit telephone and video calls when the restriction or prohibition is necessary for the security of the jail. The sheriff or jailer must provide to a resident who has less than $50 in the resident's jail account a telephone and video call allowance for 90 minutes of free telephone and video calls per week. The sheriff or jailer also must provide a resident with a reasonable opportunity to make telephone and video calls protected by the attorney- client privilege. It establishes the Loans for Trade Tools Program, which is a program administered by the Finance Authority of Maine to provide low-interest loans to graduates of a trade program for the purchase of tools and equipment necessary for employment in a trade. Loans are limited to $20,000 and must be repaid within 10 years. If an employee maintains full-time employment, meaning at least 32 hours per week, in the trade, that employee's loan may be forgiven. 2. It establishes a tax credit for employers of employees engaged in a trade for the purchase of tools or equipment needed by that employee within the first year of employment with that employer. The credit is limited to 25% of the amount of the cost of the trade tools and $5,000 per employee, is nonrefundable and may not be carried forward from year to year. 3. It removes the requirement that an applicant's headquarters are, and have been for each of the last 5 years prior to application for a certificate of approval, located in the State. 2. It requires that an applicant employ or will employ within 12 months of the start-up of the facility at least 40 full-time employees based in the State. Current law requires that an applicant employ or will employ upon start-up of the facility at least 40 full-time employees based in the State. 3. It changes the criteria to be considered a qualified and certified applicant. 4. It increases the total value of certificates of approval that the Commissioner of Economic and Community Development may issue from $100,000,000 to $200,000,000. It also increases the cap on an individual certificate of approval from $85,000,000 to $100,000,000. 5. For a tax year beginning on or after January 1, 2027, it increases the amount of the credit a certified applicant is allowed from an amount equal to 1.8% of the certified applicant's qualified investment to an amount equal to 2% of the certified applicant's qualified investment. 6. It removes the provision that provides that a credit is not allowed for any tax year following 2 consecutive tax years during which a certified applicant did not have between $5,500,000 and $12,000,000 in ordinary business income. | In Committee |

The bill also directs the Secretary of State to seek from the United States Department of Transportation, Federal Motor Carrier Safety Administration a waiver of the engine compartment component of the pre-trip vehicle inspection skills testing requirement in 49 Code of Federal Regulations, Section 383.113(a)(1)(i), known as "the under-the-hood" component, for commercial driver's license applicants seeking the school bus and passenger endorsements, as well as a waiver of the requirement in 49 Code of Federal Regulations, Section 383.133(c)(1) that the State administer this portion of the pre-trip vehicle inspection skills test in accordance with a Federal Motor Carrier Safety Administration pre-approved examiner manual. The Secretary of State may seek additional waivers of requirements that the Secretary of State determines are unnecessary for operation of a school bus in this State. The bill requires a person registering an antique auto to show proof of registration and insurance for the motor vehicle used as that person's primary mode of transportation of passengers or goods and maintain the registration and insurance for that motor vehicle or a replacement motor vehicle during the term of registration of the antique auto.
