HB1194 Protections for Victims of Economic Abuse Sections 2 and 5 of the bill require a creditor, debt collector, or debt collection agency to cease collection of a debt or any disputed portion of a debt if a consumer notifies the creditor, debt collector, or collection agency in writing that the debt or a portion of the debt is the result of economic abuse or coerced debt and provides a written statement of coerced debt and sufficient documentation to the creditor, debt collector, or collection agency until the debt collector or collection agency obtains a decree, judgment, or court order finding the debt was not the result of economic abuse or coerced debt. Sections 3 and 4 prohibit a debt collector or debt collection agency from collecting or attempting to collect any debt that is the result of economic abuse or coerced debt unless the debt collector or debt collection agency first obtains a decree, judgment, or court order finding the debt was not the result of economic abuse or coerced debt. Current law requires a consumer reporting agency to reinvestigate a disputed item in the consumer's file free of charge. Sections 6 and 7 authorize a consumer reporting agency to reinvestigate an item that the consumer asserts is the result of economic abuse or coerced debt. Section 8 adds economic abuse and coerced debt to the definition of "coercion" as it relates to civil protection orders issued in cases of domestic violence. Dead

HB1128 Income Tax Credit for Firearm Safety Device The bill creates a new income tax credit in an amount equal to the purchase price of a firearm safety device, not to exceed $200, that is purchased by an eligible taxpayer from a federally licensed dealer (credit). A firearm safety device is a device that is designed or can be used to store a firearm and is designed to be unlocked only by means of a key, a combination, or by other similar means. The credit is available for income tax years 2027 and 2028, and if the amount of the credit exceeds the eligible taxpayer's tax liability, the credit may be carried forward for a period of 5 income tax years. In addition, the maximum amount of aggregate credits that can be claimed in an income tax year is $5 million. Dead
HB1233 Veterans Benefits Claims Consumer Protections The bill makes it a deceptive trade practice under the "Colorado Consumer Protection Act" for a person who advises, assists, or consults a veteran, in connection with a claim for veterans' benefits (veterans' benefits matter), to: ! Receive compensation in excess of $12,500 for the service, subject to additional limitations linking permissible compensation to results delivered; ! Receive compensation for referring a veteran to a third party; ! Collect compensation on behalf of a third party engaged to assist with any aspect of a veterans' benefits matter; ! Receive compensation in connection with a claim filed within the one-year period following a veteran's release from active duty without a signed waiver from the veteran; ! Fail to provide a veteran the option of an interest-free payment plan; ! Guarantee a successful outcome in a veterans' benefits matter or engage in certain direct advertising; ! Fail to memorialize the payment terms and certain disclosures in a written, signed business agreement; ! Fail to take various security measures related to veterans' personal information; or ! Fail to remain a member in good standing of a national veterans' benefit trade organization that holds members to ethics and certification standards. The bill requires the attorney general or district attorney to transmit any civil penalty collected for a violation of the veterans' benefits matter provisions to the state treasurer for deposit in the Colorado state veterans trust fund. HB1164 Constitutional Carry of Handgun The bill grants a person who is at least 18 years of age and permitted to possess a handgun pursuant to federal and state law the same authority to carry a concealed handgun as a person who holds a permit to carry a concealed handgun (permit). A person who carries a concealed handgun without a permit has the same rights, limitations, and authority to carry as a person who holds a permit. A person may obtain a permit for the purpose of using the permit to carry a concealed handgun in another state that recognizes a Colorado permit. The bill makes the minimum age to obtain a permit 18 years of age. Under existing law, Colorado recognizes permits issued in other states that meet certain criteria, including that the holder of the out-of-state permit is at least 21 years of age. The bill changes the minimum age for recognition of an out-of-state permit to 18 years of age. Under existing law, a permit is valid for 5 years. The bill makes a permit valid for the life of the permit holder. Existing permits, other than temporary emergency permits, are converted to lifetime permits. Because the bill makes permits valid for the life of the holder, the bill repeals provisions relating to the renewal of permits. The bill repeals the temporary emergency permit to carry a concealed handgun. The bill repeals local government authority to regulate open or concealed carry of a handgun, including repealing the authority of special districts and the governing boards of institutions of higher education, as applicable. Current law tasks the underfunded courthouse facility cash fund commission (commission) to evaluate grant applications and issue grants to counties for underfunded courthouse facilities through master planning services, matching funds or leveraging grant funding opportunities, or for addressing emergency needs due to the imminent closure of a court facility. The bill changes the name of the commission and the underfunded courthouse facility cash fund and expands the responsibilities of the commission to include jails in addition to court facilities. Additionally, the bill allows grants to be issued for up to 50% of a county's annual voter-approved debt service on any county-approved financing of the construction or remodeling costs of a court or jail facility. SB044 Synthetic Opiates Criminal Penalties The bill makes it a level 1 drug felony if a person manufactures, dispenses, sells, or distributes, or possesses with intent to do the same, (manufactures or distributes) any material, compound, mixture, or preparation that contains fentanyl, carfentanil, benzimidazole opiate, or an analog thereof (qualifying controlled substance). Because manufacture or distribution of any amount of a qualifying controlled substance is a level 1 drug felony under the bill, the bill repeals penalty level provisions involving manufacture or distribution of a qualifying controlled substance that are weight- or circumstance-dependent, and related immunity and sentencing requirements. Effective July 1, 2025, the bill makes the possession of a qualifying controlled substance a level 4 drug felony. The bill repeals the following provisions of law related to the penalties for possessing a qualifying controlled substance: ! A provision that reduces the penalty if the fact finder in the case finds that the possessor made a reasonable mistake of fact and did not know that the material, compound, mixture, or preparation contained fentanyl, carfentanil, benzimidazole opiate, or an analog thereof; and ! A provision that requires a court to vacate the drug felony conviction and enter a conviction for a level 1 drug misdemeanor upon the defendant's successful completion of a community-based sentence to probation or to a community corrections program.
