HB1118 Catalytic Converter Replacement Exemption When a catalytic converter mechanically fails or is stolen from a motor vehicle, current rules of the air quality control commission require the replacement to comply with the rules of the California air resources board. The bill creates a temporary exception that allows a person to use a replacement catalytic converter that complies with the standards established by rules of the federal environmental protection agency if: ! In the case of the theft of a catalytic converter, the theft has been reported to a law enforcement agency; and ! The owner or operator of the motor vehicle has made a reasonable effort to obtain the required replacement catalytic converter and has been unable to obtain the replacement catalytic converter. HB1202 Increasing Public Awareness of Mold Health Effects Section 1 of the bill enacts the "Mold Awareness and Registration Act", which requires the department of public health and environment (department) to establish a public awareness campaign (campaign) to assist the public in understanding the health dangers of mold and the importance of removing mold from indoor environments. The department is directed to establish the campaign, and the state board of health is directed to adopt rules governing the campaign. As part of the campaign, the department is required to: ! Inform the public on the health dangers of mold; ! Provide the public with contact information for organizations or government agencies that can provide further information relating to the health effects of mold, mold testing methods, or accredited industry standards for mold remediation; and ! Every 5 years, perform a review of the technology or treatment techniques for mold identification and remediation that protect public health and safety. Section 1 also requires the executive director of the department to issue a registration to a person that provides mold remediation or assessment services in the state if the person applies for registration and provides evidence of an active third-party remediation or assessment certification, as well as evidence of financial responsibility. The executive director is required to maintain on the department's website a public database of all persons that have been issued a registration. Sections 2 and 3 require a contract to sell residential real property to contain, and a landlord of residential real property to provide to prospective tenants, in writing: ! A warning statement about the health dangers of mold; ! Any knowledge the seller or landlord has of the residential real property's mold concentrations and history, including assessments performed, reports written, and mitigation or remediation conducted; and ! The most recent brochure published by the department that provides information about the health dangers of mold in indoor environments. Dead

HB1169 Housing Developments on Faith and Educational Land The bill requires a subject jurisdiction, on or after December 31, 2026, to allow a residential development to be constructed on a qualifying property that does not contain an exempt parcel, subject to an administrative approval process. The bill specifies that a subject jurisdiction shall not: ! Disallow construction of a residential development on the basis of height if the tallest structure in the residential development is no more than 3 stories or 45 feet tall; ! Disallow construction of a residential development on the basis of height if the tallest structure in the residential development complies with the height-related standards for the zoning district in which the residential development will be built or any zoning district that is contiguous to the qualifying property on which the residential development will be built; ! Disallow construction of a residential development based on the number of dwelling units that the residential development will contain, except in accordance with standards listed in the bill; or ! Apply standards to a residential development on a qualifying property that are more restrictive than the standards the subject jurisdiction applies to similar housing constructed within the subject jurisdiction, including standards related to structure setbacks from property lines; lot coverage or open space; on-site parking requirements; numbers of bedrooms in a multifamily residential development; or on-site landscaping, screening, and buffering requirements. A subject jurisdiction shall allow the following uses in a residential development on a qualifying property: ! Childcare; and ! The provision of recreational, social, or educational services provided by community organizations for use by the residents of the residential development and the surrounding community. A subject jurisdiction may condition additional uses in a residential development on the uses being allowed only on the ground floor of the residential development and the uses occupying no more than 15% of the ground floor area of the residential development. HB1235 Jury Trials for Tenant Proceedings The bill affords a plaintiff and defendant the right to trial by jury in any action brought for unlawful detention of real property. The bill requires at least one attempt on 3 separate days of personal service on the defendant in an action for unlawful detention of real property. The bill requires an affidavit of service to be filed with the court. The bill requires a defendant who demands a trial by jury to make the demand in accordance with the Colorado rules of civil procedure or file a separate jury demand with the defendant's answer. The bill requires the court to set the date for trial no sooner than 10 days after the answer is filed. The bill authorizes the court to continue the trial if a party demands a trial by jury. The bill authorizes the court to allow either party, counsel for either party, and any witness to appear remotely by phone or video at a jury trial as an accommodation for a person with a disability or upon adequate assurances that the remote participation will not cause unreasonable delay. If either party requests a delay in a trial longer than 14 days, the bill authorizes the court, in the court's discretion upon a showing of a party's substantial likelihood of suffering serious economic harm, to require either party to give bond or other security to the opposite party for the sum that the party may be harmed due to the delay. The party required to make payment to the court must be given at least 7 days after the court's order to make the payment. If the party fails to make payment within the time required, the bill authorizes the court to extend the time for compliance or reset the hearing or trial for the next available date, but the court is prohibited from entering a default against the party. Upon a showing of indigency by the party required to make payment, the bill requires the court to waive or reduce the bond or other security, provide additional time to make payment, and permit the party to make multiple partial payments. Current law prohibits a written rental agreement from including a waiver of the right to a jury trial, except when the parties agree to a waiver of a jury in a hearing to determine possession of a dwelling unit. The bill prohibits surveillance-based discrimination against a consumer or worker based on surveillance data through the use of automated decision systems to inform: ! Individualized prices based on surveillance data regarding a consumer; or ! Individualized wages based on surveillance data regarding a worker. An automated decision system is defined by the bill and includes, in part, information derived from machine learning or other data processing or artificial intelligence. The bill specifies activities that are not surveillance-based price or wage discrimination. The attorney general or a district attorney may bring a civil action on behalf of the state against a person that violates the prohibition against surveillance-based discrimination to seek the imposition of civil penalties. In addition, a person aggrieved by a violation of the prohibition against surveillance-based discrimination may bring a civil action on behalf of themself or a group of similarly situated persons to restrain further violations and to recover damages, costs, and reasonable attorney fees. SB073 Military-Connected Children with Disabilities The bill clarifies the process and timeline for an administrative unit or a state-operated program to provide special education services to a military-connected child with disabilities (child) who transfers from one administrative unit or state-operated program within Colorado to another, or transfers from an out-of-state school district or private school to an administrative unit or a state-operated program within Colorado, as a result of an inbound active duty military member's (member) order to permanently change military stations. For a child who transfers from an administrative unit or state-approved program to a private school within Colorado, or transfers from an out-of-state school district or private school to a private school within Colorado, the administrative unit with jurisdiction over the geographic boundary that the private school is located in shall review the child's evaluation information and existing individualized education program (IEP) or section 504 plan in consultation with the child's member, parent, legal guardian, or custodian. The administrative unit shall determine and provide equitable special education and related services, an IEP, or a section 504 plan to the child enrolled in the private school. For a child who transfers from an out-of-state school district or private school with an individualized family service plan, the administrative unit or the state-operated program shall follow the process to coordinate, in conjunction with the department of early childhood, the transition of the child from an early intervention program for infants and toddlers pursuant to part C of the federal "Individuals with Disabilities Education Act" (IDEA) to a program component to serve children with disabilities from 3 to 21 years of age pursuant to part B of the IDEA. The bill requires an administrative unit, a state-operated program, or an administrative unit with jurisdiction over the geographic boundary that a private school is located in to receive informed consent from the member, parent, legal guardian, or custodian of a child before: ! There are revisions to the child's category of disability; ! There are revisions to the child's IEP or section 504 plan; ! There are changes to the child's eligibility for special education and related services; or ! There is a partial or complete termination of special education and related services, except if the child graduates with a standard or advanced studies diploma. HB1262 Regulate Private Security Officers & Agencies The bill creates the state board of private security services (board) in the department of regulatory agencies (department) to regulate individuals and businesses that provide private security services. Starting August 1, 2026, to provide private security services in the state: ! An individual must obtain an event security officer or a commercial security officer license from the board; and ! A private security employer must obtain a registration from the board. Additionally, only a licensed commercial security officer may be authorized to carry a firearm or nonlethal weapon and must first obtain a board-issued weapon endorsement to do so. Law enforcement officers who are certified by the peace officers standards and training board are exempt from the licensure and weapon endorsement requirements. The bill establishes requirements and qualifications for obtaining a license, weapon endorsement, or registration, as applicable, including: ! Obtaining a fingerprint-based criminal history record check to verify that the applicant has not committed a disqualifying criminal offense; ! Completing specified training and successfully passing an assessment; ! Satisfying minimum age requirements; and ! For an employer registration, having the requisite level of experience and professional liability insurance and a policy for training newly licensed employees. Pending the results of the required criminal history record check, the board may issue an applicant a provisional license under specified circumstances that allows an otherwise qualified applicant to perform private security services under direct supervision and in limited spaces. The bill allows a private security officer who is licensed in a municipality in the state to obtain a state-issued license, without additional training, if the board determines that the municipal licensing requirements are substantially equivalent to the requirements in the bill. The board is authorized to: ! Adopt rules; ! Approve training; ! Issue and renew licenses, weapon endorsements, and registrations and impose fees; and ! Conduct investigations and hearings and impose discipline for violations of the bill. The regulation of private security officers and private security employers is scheduled to repeal on September 1, 2030, and is subject to sunset review by the department before its repeal. Dead

HB1261 Consumers Construction Defect Action In an action against a construction professional, section 2 of the bill requires the construction professional to provide the claimant or the claimant's legal representative with: ! Copies of all plans, specifications, soils reports, and available engineering calculations; ! Any maintenance and preventive maintenance recommendations; ! The name, last-known address, and scope of work of each construction professional that performed work or services; and ! Copies of all insurance policies held by the construction professional during the appropriate time. The construction professional may charge reasonable copying costs for the documents. Failure to provide the identifying information of the other construction professionals bars the construction professional from designating the unidentified construction professionals as nonparties at fault in any subsequent action. Section 3 requires a court to award prejudgement interest of 8% to a prevailing claimant who alleges defects in a residential property construction. Section 5 voids a provision in a real estate contract that: ! Prohibits group lawsuits against a construction professional; or ! Imposes different or additional requirements than the statutory requirements to bring or join a legal action. Section 6 changes the time when a claim of relief arises, for the purposes of the statute of limitation and repose, to include both the discovery of the physical manifestation and the cause of the defect. Current law authorizes, subject to the requirements of the common interest community's (community) declarations, a community to engage in certain actions, such as instituting, defending, or intervening in litigation or administrative proceedings on matters affecting the community. Section 7 exempts an association's authority to institute, defend, or intervene in litigation proceedings concerning construction defects from the requirement that the action be subject to the declaration. Section 8 requires the department of regulatory agencies to include in its "SMART Act" report information concerning construction liability insurance and the basis for rates. Dead

Stops selling malt, vinous, or spiritous liquors and closes out all open charges no later than 2:30 a.m.; and ! Removes all purchased malt, vinous, or spirituous liquors from the consumption area of the licensed premises no later than 3 a.m. The bill only applies to a licensee if the county, city and county, or municipality that the licensee is operating within adopts a law opting into the application of the bill to their jurisdiction.
