SB073 | Military-Connected Children with Disabilities | The bill clarifies the process and timeline for an administrative unit or a state-operated program to provide special education services to a military-connected child with disabilities (child) who transfers from one administrative unit or state-operated program within Colorado to another, or transfers from an out-of-state school district or private school to an administrative unit or a state-operated program within Colorado, as a result of an inbound active duty military member's (member) order to permanently change military stations. For a child who transfers from an administrative unit or state-approved program to a private school within Colorado, or transfers from an out-of-state school district or private school to a private school within Colorado, the administrative unit with jurisdiction over the geographic boundary that the private school is located in shall review the child's evaluation information and existing individualized education program (IEP) or section 504 plan in consultation with the child's member, parent, legal guardian, or custodian. The administrative unit shall determine and provide equitable special education and related services, an IEP, or a section 504 plan to the child enrolled in the private school. For a child who transfers from an out-of-state school district or private school with an individualized family service plan, the administrative unit or the state-operated program shall follow the process to coordinate, in conjunction with the department of early childhood, the transition of the child from an early intervention program for infants and toddlers pursuant to part C of the federal "Individuals with Disabilities Education Act" (IDEA) to a program component to serve children with disabilities from 3 to 21 years of age pursuant to part B of the IDEA. The bill requires an administrative unit, a state-operated program, or an administrative unit with jurisdiction over the geographic boundary that a private school is located in to receive informed consent from the member, parent, legal guardian, or custodian of a child before: ! There are revisions to the child's category of disability; ! There are revisions to the child's IEP or section 504 plan; ! There are changes to the child's eligibility for special education and related services; or ! There is a partial or complete termination of special education and related services, except if the child graduates with a standard or advanced studies diploma. HB1158 | Digital Education Materials | A public school contracting entity (entity) that executes a contract on or after July 1, 2026, with a vendor or provider of a curated digital research collection (collection) shall include in the terms of the contract a termination clause stating that the contract is materially breached and that grounds for termination exist if the collection contains advertisements, promotions, or embedded links or uniform resource locators (URLs) and when notified of the advertisement, promotion, or URLs the vendor does not remove the items within 3 days after receiving the notice. All vendors must certify that collections are free of advertisements, promotions, or embedded links or URLs. If a vendor violates the terms of the contract, the entity is entitled to reimbursement and may pursue remedies for breach of contract. A public school employee, contractor, or volunteer shall report, and students, parents, guardians, legal custodians, or community members (interested parties) may report if a collection is found to contain advertisements, promotions, or embedded links or URLs. The report must include the name of the digital collection and the title of the document, the reference number, or keywords used to access the collection. The entity shall notify the vendor or provider and the department of education (department) of each reported incident. The vendor or provider shall remove the advertisements, promotions, or embedded links or URLs within 3 business days after receiving notice. The bill requires public schools to annually notify interested parties of the reporting procedures. Public schools shall include the annual notification on their websites. Public schools may include information on their websites regarding how to make a report. If a public school contracts or enters into an agreement with a public library that promotes a collection, the public school shall annually disclose the details of the contract or agreement by email to the local school district board of education and parents, guardians, or legal custodians of students enrolled in the public school. If any material changes to the contract or agreement occur, the public school shall send an email notification to the local school district board of education, parents, guardians, or legal custodians of students enrolled in the school. HB1073 | Protections Against Child Rape | Under current law, sexual assault on a child is a class 4 felony if the victim is under 15 years of age, the actor is at least 4 years older than the victim, and specified aggravating circumstances do not apply. Sexual assault on a child by one in a position of trust is a class 4 felony if the actor is in a position of trust with respect to the victim, the victim is 15 years of age or older but under 18 years of age, and the offense is not committed as part of a pattern of sexual abuse. If the offense is committed as part of a pattern of sexual abuse or the victim is less than 15 years of age, sexual assault on a child by one in a position of trust is a class 3 felony. The presumptive range of penalties for a class 4 felony under current law is 2 to 6 years of imprisonment. The presumptive range of penalties for a class 3 felony under current law is 4 to 12 years of imprisonment. Under current law, a court shall sentence a sex offender to an indeterminate term in the custody of the department of corrections that can range from the applicable presumptive range minimum to a maximum of the sex offender's natural life. However, current law permits the court to sentence a sex offender to probation for an indeterminate period that can range from 10 years for a class 4 felony and 20 years for a class 3 felony to a maximum of the sex offender's natural life. The bill requires a court to sentence an offender convicted of a class 4 felony sexual assault on a child or sexual assault on a child by one in a position of trust to an indeterminate term of incarceration that can range from the presumptive range minimum of 2 years to a maximum of the offender's natural life. The bill requires a court to sentence an offender convicted of a class 3 felony sexual assault on a child by one in a position of trust when the child is less than 15 years of age to an indeterminate term of incarceration that can range from the presumptive range minimum of 4 years to a maximum of the offender's natural life. The bill allows the parent, guardian, or legal custodian of a minor to withhold consent for treatment, activity, or mental health-care service that is designed and intended to form the parent's child's conceptions of sex and gender or to treat gender dysphoria or gender nonconformity. The bill prohibits a law enforcement officer acting pursuant to an investigation, an employee, an agent of this state, or a political subdivision from encouraging a minor to withhold information from the minor's parent or from withholding information regarding a minor's physical or mental health from the minor's parent. The bill prohibits a person from being discriminated or retaliated against by a person who provides information regarding an act or omission that violates the requirements described in the bill. The bill prohibits the state from using state funds for the performance of, or in furtherance of, any medical procedure or medical treatment that furthers a minor's desire to present or appear in a manner that is inconsistent with the minor's sex. HB1256 | Life-Sustaining Treatment Minors Parent Rights | The bill mandates that a health-care provider (provider) shall not implement a do-not-resuscitate order (DNR) for a minor without written consent from the minor's parent or legal guardian. However, if a provider makes a reasonably diligent and documented effort to contact a parent or legal guardian for 72 hours without success, the provider may enter a DNR for the minor. A parent or legal guardian may revoke their consent in writing, and such a revocation must take precedence over the prior consent and be recorded in the minor's medical records. The bill states that a provider shall not hinder or delay the life-sustaining or resuscitative treatment, determined by the right of the parent or legal guardian of the minor, to be given to the minor unless there is destruction of the minor's circulatory system, respiratory system, and entire brain. A court does not have authority to require withdrawal of life-sustaining or resuscitative treatment for a minor unless there is destruction of the minor's circulatory system, respiratory system, and entire brain. The bill creates a presumption that the continuation of the life of a minor is in the minor's best interest. Under the bill, a provider shall not interfere with a parent or legal guardian of a minor seeking to obtain another medical opinion or the transfer of the minor to another health facility (facility). If the parent or legal guardian requests that the minor be transferred, the provider shall: ! Provide the new facility immediate access to the minor and the minor's medical records; and ! Not hinder or delay the necessary measures or procedures needed to facilitate the transfer. The facility receiving the minor on transfer must: ! Continue providing the life-sustaining measures and procedures being administered; and ! Make every reasonable effort to help facilitate the transfer. The bill requires a state court to sentence a person convicted of burglary, robbery, theft, or a related property crime from or of a store, who was convicted of any 2 of the specified property crimes or comparable municipal offenses from or of a store within the preceding 4 years, to at least the midpoint term for the current offense. The bill adds language to the existing theft statute clarifying how a gift card's value is determined for purposes of determining the offense level and associated penalty. If the stolen item of value is a gift card, then the value is the full monetary face value or, in the case of a variable load gift card, the maximum potential value, regardless of whether funds have been transferred to the gift card at the time of the theft. A person may obtain a permit for the purpose of using the permit to carry a concealed handgun in another state that recognizes a Colorado permit. The bill makes the minimum age to obtain a permit 18 years of age. Under existing law, Colorado recognizes permits issued in other states that meet certain criteria, including that the holder of the out-of-state permit is at least 21 years of age. The bill changes the minimum age for recognition of an out-of-state permit to 18 years of age. Under existing law, a permit is valid for 5 years. The bill makes a permit valid for the life of the permit holder. Existing permits, other than temporary emergency permits, are converted to lifetime permits. Because the bill makes permits valid for the life of the holder, the bill repeals provisions relating to the renewal of permits. The bill repeals the temporary emergency permit to carry a concealed handgun. The bill repeals local government authority to regulate open or concealed carry of a handgun, including repealing the authority of special districts and the governing boards of institutions of higher education, as applicable. | Dead |
