HB1008 Complementary Behavioral Health Services in Jails Legislative Oversight Committee Concerning the Treatment of Persons with Behavioral Health Disorders in the Criminal and Juvenile Justice Systems. Under existing law, the behavioral health administration (BHA) in the department of human services administers the jail-based behavioral health services program (program). The bill requires the BHA to, as part of the program, provide funding to jails to administer services that complement a person's primary course of treatment for a behavioral health disorder (complementary behavioral health services) to persons in custody in the jail. A jail shall use the funding to train jail staff to administer complementary behavioral health services and to provide complementary behavioral health services to persons in custody in the jail at no cost to the person. SB043 Deflection Supports Justice-Involved Youth Legislative Oversight Committee Concerning the Treatment of Persons with Behavioral Health Disorders in the Criminal and Juvenile Justice Systems. Current law establishes the youthful offender system in the department of corrections as a sentencing option that provides a continuum of services. Section 1 of the bill: ! Revises certain legislative declaration provisions to emphasize lasting behavioral changes in preparation for reentry, accountability, healthy relationship building, and offender and staff safety; ! Adds language related to housing arrangements and equitable treatment for youthful offenders, including youthful offenders with disabilities; ! Adds a requirement for rehabilitative treatment and life skills programming and, in certain cases, for individual and family therapy and substance use disorder treatment; ! Elaborates on clinician evaluations, tailored treatment plans, and client manager requirements for youthful offenders; and ! Imposes an annual reporting requirement beginning in January 2026. Section 2 of the bill applies the standards for determining competency in juvenile delinquency cases to juveniles who have charges directly filed against them in adult court, juveniles whose cases are transferred to adult court, or juveniles subject to concurrent court jurisdiction. Section 3 of the bill permits bridges court liaisons to access juvenile competency evaluations and related information. Current law sets forth procedures for court determinations of a juvenile's competency in juvenile justice proceedings. Section 4 of the bill requires a court to dismiss the case against a juvenile if the court makes a final determination that the juvenile is incompetent to proceed and the juvenile's highest charged act is a class 2 misdemeanor, a petty offense, a drug misdemeanor, or a traffic offense. Under current law, one year after a court finds a juvenile charged with a level 4 drug felony is incompetent to proceed the court shall enter a finding the juvenile is unrestorable to competency and shall determine whether a management plan is necessary for the juvenile. The bill reduces the time from one year to 6 months. The bill imposes certain limitations on a case management plan's contents in cases that involve sexual conduct and addresses court responses when a juvenile or a juvenile's parent or guardian fails to engage with a management plan's ordered services. Section 5 of the bill requires that a person sentenced for a delinquent act committed as a juvenile receive credit for any period of confinement prior to sentencing. Section 6 of the bill creates the deflection and community investment grant program (grant program) in the office of adult and juvenile justice assistance in the division of criminal justice to provide grants to eligible nonprofit and tribal applicants to implement a mixed-delivery system of trauma-informed health and development deflection programs for youth, including Native American youth. The bill requires at least one attempt on 3 separate days of personal service on the defendant in an action for unlawful detention of real property. The bill requires a defendant who demands a trial by jury to make the demand in accordance with the Colorado rules of civil procedure or file a separate jury demand with the defendant's answer. The bill requires the court to set the date for trial no sooner than 10 days after the answer is filed. The bill authorizes the court to continue the trial if a party demands a trial by jury. The bill authorizes the court to allow either party, counsel for either party, and any witness to appear remotely by phone or video at a jury trial as an accommodation for a person with a disability or upon adequate assurances that the remote participation will not cause unreasonable delay. If either party requests a delay in a trial longer than 14 days, the bill authorizes the court, in the court's discretion upon a showing of a party's substantial likelihood of suffering serious economic harm, to require either party to give bond or other security to the opposite party for the sum that the party may be harmed due to the delay. The party required to make payment to the court must be given at least 7 days after the court's order to make the payment. If the party fails to make payment within the time required, the bill authorizes the court to extend the time for compliance or reset the hearing or trial for the next available date, but the court is prohibited from entering a default against the party. Upon a showing of indigency by the party required to make payment, the bill requires the court to waive or reduce the bond or other security, provide additional time to make payment, and permit the party to make multiple partial payments. Current law prohibits a written rental agreement from including a waiver of the right to a jury trial, except when the parties agree to a waiver of a jury in a hearing to determine possession of a dwelling unit. HB1158 Digital Education Materials A public school contracting entity (entity) that executes a contract on or after July 1, 2026, with a vendor or provider of a curated digital research collection (collection) shall include in the terms of the contract a termination clause stating that the contract is materially breached and that grounds for termination exist if the collection contains advertisements, promotions, or embedded links or uniform resource locators (URLs) and when notified of the advertisement, promotion, or URLs the vendor does not remove the items within 3 days after receiving the notice. All vendors must certify that collections are free of advertisements, promotions, or embedded links or URLs. If a vendor violates the terms of the contract, the entity is entitled to reimbursement and may pursue remedies for breach of contract. A public school employee, contractor, or volunteer shall report, and students, parents, guardians, legal custodians, or community members (interested parties) may report if a collection is found to contain advertisements, promotions, or embedded links or URLs. The report must include the name of the digital collection and the title of the document, the reference number, or keywords used to access the collection. The entity shall notify the vendor or provider and the department of education (department) of each reported incident. The vendor or provider shall remove the advertisements, promotions, or embedded links or URLs within 3 business days after receiving notice. The bill requires public schools to annually notify interested parties of the reporting procedures. Public schools shall include the annual notification on their websites. Public schools may include information on their websites regarding how to make a report. If a public school contracts or enters into an agreement with a public library that promotes a collection, the public school shall annually disclose the details of the contract or agreement by email to the local school district board of education and parents, guardians, or legal custodians of students enrolled in the public school. If any material changes to the contract or agreement occur, the public school shall send an email notification to the local school district board of education, parents, guardians, or legal custodians of students enrolled in the school. HB1073 Protections Against Child Rape Under current law, sexual assault on a child is a class 4 felony if the victim is under 15 years of age, the actor is at least 4 years older than the victim, and specified aggravating circumstances do not apply. Sexual assault on a child by one in a position of trust is a class 4 felony if the actor is in a position of trust with respect to the victim, the victim is 15 years of age or older but under 18 years of age, and the offense is not committed as part of a pattern of sexual abuse. If the offense is committed as part of a pattern of sexual abuse or the victim is less than 15 years of age, sexual assault on a child by one in a position of trust is a class 3 felony. The presumptive range of penalties for a class 4 felony under current law is 2 to 6 years of imprisonment. The presumptive range of penalties for a class 3 felony under current law is 4 to 12 years of imprisonment. Under current law, a court shall sentence a sex offender to an indeterminate term in the custody of the department of corrections that can range from the applicable presumptive range minimum to a maximum of the sex offender's natural life. However, current law permits the court to sentence a sex offender to probation for an indeterminate period that can range from 10 years for a class 4 felony and 20 years for a class 3 felony to a maximum of the sex offender's natural life. The bill requires a court to sentence an offender convicted of a class 4 felony sexual assault on a child or sexual assault on a child by one in a position of trust to an indeterminate term of incarceration that can range from the presumptive range minimum of 2 years to a maximum of the offender's natural life. The bill requires a court to sentence an offender convicted of a class 3 felony sexual assault on a child by one in a position of trust when the child is less than 15 years of age to an indeterminate term of incarceration that can range from the presumptive range minimum of 4 years to a maximum of the offender's natural life.
