HF965 A bill for an act relating to the adoption tax credit available against the individual income tax, and including effective date and retroactive applicability provisions.(See HF 1026.) This bill relates to the adoption tax credit available against the individual income tax. Currently, the tax credit equals up to $5,000 of qualified adoption expenses per adoption. The bill increases the tax credit to equal up to $20,000 of qualified adoption expenses per adoption. Any credit in excess of the tax liability is refundable. “Qualified adoption expenses” means unreimbursed expenses paid or incurred in connection with the adoption of a child, including medical and hospital expenses of the biological mother which are incident to the child’s birth, welfare agency fees, legal fees, and all other fees and costs which relate to the adoption of a child. “Child” means an individual under 18 years of age. Current law in Code section 422.12A(4) determines the tax year when qualified adoption expenses are allowed. The bill takes effect upon enactment and applies retroactively to tax years beginning on or after January 1, 2024, for adoptions finalized on or after that date. In Committee
HF962 A bill for an act modifying the child and dependent care credit available against the individual income tax, and including retroactive applicability provisions.(See HF 1020.) This bill relates to the Iowa child and dependent care credit available against the individual income tax. The Iowa child and dependent care credit is a refundable credit calculated as a percentage of the federal child and dependent care credit, depending on the Iowa net income of the taxpayer. Currently, there are seven graduated Iowa net income thresholds used to calculate the credit. The bill reduces the number of Iowa net income thresholds from seven thresholds to four thresholds, and removes the maximum Iowa net income threshold amount used by the taxpayer to calculate the Iowa child and dependent care tax credit. By removing the maximum Iowa net income threshold amount for eligibility purposes ($90,000), any taxpayer with Iowa net income equal to or exceeding $25,000 is eligible to use 50 percent of the federal child and dependent care credit as a refundable credit against the Iowa individual income tax, regardless of whether the taxpayer’s federal credit is limited by the taxpayer’s federal tax liability. The bill applies retroactively to tax years beginning on or after January 1, 2025. In Committee

This bill authorizes school districts, charter schools, and innovation zone schools to employ chaplains, or engage volunteer chaplains, to provide support, services, and programs for students. The bill provides that such chaplains are not required to have a license, endorsement, certification, authorization, or statement of recognition issued by the board of educational examiners. The bill requires school districts, charter schools, and innovation zone schools to follow the background investigation and termination procedures established under Code section 279.69 when employing chaplains or engaging volunteer chaplains. HF171 A bill for an act removing the maximum annual amount of real estate transfer tax receipts that may be transferred into the housing trust fund. The housing trust fund (HTF) was established for the development and preservation of affordable housing for low-income people in the state and for the Iowa mortgage help initiative. Each month county recorders remit 82.75 percent of the real estate transfer tax (RETT) receipts to the department of revenue (DOR), and deposit the remaining 17.25 percent of the RETT receipts in the county general fund. Of the RETT receipts transferred to DOR, DOR transfers 65 percent to the state general fund, 30 percent to the HTF, and 5 percent to the shelter assistance fund. Currently, DOR may deposit a maximum of $7 million of RETT receipts into the HTF per year. Any amounts in excess of $7 million are deposited into the state general fund. This bill removes the $7 million annual maximum that may be deposited into the HTF. The bill also strikes outdated phase-in language in Code section 428A.8(2). In Committee
HF726 A bill for an act providing for the implementation of battery stewardship plans, making appropriations, and providing penalties. This bill provides for the implementation of battery stewardship plans and strikes current Code sections relating to household battery recycling requirements and batteries used in rechargeable consumer products. The bill defines a “battery stewardship organization” (organization) as a producer that directly implements a battery stewardship plan (plan) approved by the department of natural resources (DNR) under the bill or a nonprofit organization designated by a producer or group of producers to implement such a plan. The bill defines “covered battery” as a portable or medium format battery, with certain exceptions. The bill prohibits any producer or retailer from selling, offering for sale, or distributing any covered batteries or battery-containing product in the state or into the state on and after January 1, 2028, unless the producer is operating under a plan approved by DNR pursuant to the bill and is marked with identification of the producer, with certain exceptions. On and after January 1, 2029, the batteries or battery-containing products must also be marked to ensure proper collection and recycling. The bill prohibits producers, retailers, and battery stewardship organizations from charging a point-of-sale fee to consumers to cover the cost of implementing a plan approved pursuant to the bill. The bill requires producers to submit a battery stewardship plan to DNR. The plan shall have a term of no more than five years and must include contact information; brands of covered batteries the producer sells; performance goals; processes and goals for retailer and consumer awareness; collection site safety training; funding methods; provisions for collecting covered batteries at no cost; addresses of collection sites that will accept covered batteries and the criteria used to determine the sites; names of proposed service providers to be used for the final disposition of batteries; provisions for recordkeeping, tracking, and the management and disposition of covered batteries; and explanations for any anticipated delays in managing medium format batteries. The bill requires a battery stewardship organization to pay a fee of $100,000 to DNR upon approval of a plan or on January 1, 2027, whichever is later. The fees will be deposited into a battery stewardship account in the groundwater protection fund and will be used to fulfill DNR’s duties under the bill. The bill requires a fee adjustment by the general assembly every five years. The bill requires each organization to submit a new plan every five years. If the performance goals under the previous plan were not met, the bill requires the new plan to include corrective measures to meet the goals. Additionally, an organization must provide plan amendments to DNR when proposing material changes to an already approved plan. The bill requires an organization to notify DNR within 30 days of a producer beginning or ceasing participation in the organization or adding or removing a processer or transporter. The bill allows DNR to approve plans from multiple organizations and plans that equitably share costs among other organizations. The bill requires an organization to be responsible for all costs associated with implementing the plan, reimburse local governments for costs incurred from serving as a collection site, collect charges from producers sufficient to cover the costs of implementation of the plan, provide for the collection of all covered batteries for any person, provide collection sites, ensure medium format batteries are collected correctly, provide for the collection of damaged and defective batteries, ensure statewide collection opportunities for all covered batteries, and coordinate with others to provide efficient delivery of service. The bill requires an organization to provide permanent collection for portable and medium format batteries at all collection centers that meet the requirements of the plan by December 1, 2028, with certain exceptions. For portable batteries, the bill requires at least one permanent collection site within a 15-mile radius for at least 95 percent of residents. For medium format batteries, the bill requires at least 10 reasonably dispersed permanent collection sites in the state and a collection event at least once every three years in each county that does not have a permanent collection site. The bill authorizes an organization to issue a warning, suspend, or terminate a collection site that does not comply with the criteria under an approved plan or that poses an immediate concern to health and safety. The bill provides that organizations are not required to provide for the collection of battery-containing products or covered batteries that remain contained in battery-containing products. The bill requires an organization to collect recalled batteries, but the organization may seek reimbursement from the producer of the recalled batteries for costs incurred. The bill requires an organization to promote the implementation of the organization’s plan through specific methods provided in the bill, including marketing and education of the plan. The bill requires each organization to submit a report to DNR by June 1, 2029, and each June 1 thereafter, that contains detailed information about the organization’s approved plan. The bill requires an organization to hire a third party to conduct an audit of a plan and associated operations five years after implementation of the plan to examine the effectiveness and cost-effectiveness of the plan. The result of the audit will be submitted to DNR. The bill provides procedures DNR must follow after receiving approved plans, including timelines for approval or denial, public notice requirements, and public comment requirements. The bill requires DNR to review the annual reports submitted within 90 days of submission. The bill requires DNR to provide technical assistance to producers and retailers related to the requirements of the bill. The bill requires DNR to maintain on its internet site a copy of all approved plans and amendments, names of the producers with approved plans, a list of brands of covered batteries covered under a plan, a list of approved collection sites, and annual reports submitted to DNR. The bill provides that proprietary information submitted to DNR shall not be available to the public. The bill authorizes DNR to adopt rules to implement and administer the bill. The bill provides that a producer, retailer, or organization is not liable for any claim of a violation of antitrust laws or laws relating to fraudulent, deceptive, or unfair methods of competition or trade practices arising from conduct that complies with an approved plan under the bill. The bill expounds that nothing in the bill prevents or prohibits a person from offering or performing a fee-based household collection program or a mail-back program for covered batteries independently of a plan under the bill if the program complies with all applicable federal, state, and local laws and requirements, the batteries collected are provided to an organization implementing an approved plan, and that after providing collected batteries to an organization, any transport and processing of such batteries is done at the organization’s expense. The bill provides that, beginning on January 1, 2028, a person may dispose of a covered battery only by delivery to a collection site or collection event operated under an approved plan, unless the battery is separately managed as hazardous waste. The bill prohibits a person from knowingly causing or allowing the mixing of a covered battery with recyclable materials that are intended for processing and sorting at a material recovery facility, the mixing of a covered battery with municipal waste that is intended for disposal at a solid waste disposal site, the disposal of a covered battery in a landfill, the mixing of a covered battery with waste that is intended for burning or incineration, or the burning or incineration of a covered battery. The bill provides that an owner or operator of a solid waste facility shall not be found in violation of the bill if the facility has posted in a conspicuous location a sign stating that covered batteries must be managed through collection sites established by an organization and are not accepted for disposal. A solid waste collector shall not be found in violation of the bill for a covered battery placed in a disposal container by a third party. The bill allows an organization implementing an approved plan to bring civil actions against producers or other organizations to recover costs, damages and fees incurred due to violations of the bill, battery recalls, or failures to meet obligations under an approved plan. The bill provides that a violation of the bill, other than the provisions concerning individual battery disposal, is punishable by a fine of not more $10,000 for each violation. If a fee is not paid, the person shall be liable for a civil penalty that is twice the amount of the applicable fee. The bill provides that a person who knowingly makes a false material statement to DNR related to or required under the bill is guilty of a class “D” felony. A class “D” felony is punishable by confinement for no more than five years and a fine of at least $1,025 but not more than $10,245. In addition to any other penalty, the bill authorizes the attorney general or the county attorney of any county in which a violation of the bill occurs to bring an action to enjoin any person from violating the bill, other than the provisions concerning individual battery disposal. The bill creates a battery stewardship account in the groundwater protection fund that will consist of moneys appropriated to, transferred to, or deposited in the account, including fees collected pursuant to the bill. Moneys in the account shall be expended to fulfill DNR’s duties under the bill. The bill requires DNR to submit to the general assembly, annually on or before January 1, a report that demonstrates how funds are being utilized to comply with DNR’s duties described in the bill and an itemization of any other expenditures made within the previous fiscal year. The bill directs DNR to review and evaluate studies and assessments conducted by executive branch agencies in the states of Illinois, Vermont, and Washington regarding whether products or batteries that are not covered by the bill should be covered at a later date. DNR may also review similar studies or assessments conducted by executive branch agencies in any other state or by any other person. The bill requires DNR to submit a report to the general assembly no later than May 30, 2028, that includes the findings and recommendations of any study or assessment reviewed by DNR. The report may include recommendations for legislation based on DNR’s evaluation of the studies and review of assessments. In Committee

HF664 A bill for an act relating to the requirements for authorized electronic monitoring in nursing facilities, and providing penalties. This bill provides for authorized electronic monitoring in nursing facilities. The bill provides that a nursing facility resident or a resident representative may conduct electronic monitoring of the resident’s room through the use of electronic monitoring devices placed in the resident’s room pursuant to the bill. The bill specifies the consents that must be obtained for a resident to conduct electronic monitoring in the resident’s room, including from any roommate; the process to be followed if a roommate refuses to consent; the provision of notice to the nursing facility; the notification and consent form requirements; the responsibility for the cost and installation relating to the electronic monitoring; penalties for obstruction of electronic monitoring devices; the dissemination of recordings created through electronic monitoring; the admissibility of evidence created through electronic monitoring; liability and penalties for violations of the bill; resident protections; and reporting requirements. The bill also directs the department of inspections, appeals, and licensing to prescribe the notification and consent form described in the bill and to make the form available on the department’s internet site. HF326 A bill for an act establishing a veterans recovery pilot program and fund for the reimbursement of expenses related to providing hyperbaric oxygen treatment to eligible veterans and making appropriations.(See HF 518.) This bill establishes a veterans recovery pilot program, administered by the department of veterans affairs for the reimbursement of expenses related to providing hyperbaric oxygen treatment to eligible veterans. New Code section 35E.1 establishes definitions applicable to the new Code chapter, including definitions for “commission”, “department”, “health care practitioner”, “hyperbaric oxygen treatment”, “traumatic brain injury”, “treatment facility”, and “veteran”. Specifically, the bill defines “hyperbaric oxygen treatment” as treatment, including diagnostic testing and other related medical treatments, for diabetic foot ulcers, traumatic brain injury, or post-traumatic stress disorder prescribed by a health care practitioner that utilizes a United States food and drug administration-approved hyperbaric chamber or hyperbaric oxygen device. New Code section 35E.2 establishes the veterans recovery pilot program, subject to sufficient moneys to operate the program, requires the department of veterans affairs to adopt rules to implement and administer the program, and includes a reporting requirement for the department of veterans affairs concerning the operation of the pilot program. New Code section 35E.3 creates a veterans recovery fund in the state treasury under the control of the department of veterans affairs. The new Code section provides that moneys in the fund are appropriated to the department of veterans affairs to be expended for expenses incurred in operating the program and for expenses authorized to be reimbursed for hyperbaric oxygen treatment and any related travel and living expenses incurred by the veteran. The new Code section provides that moneys in the fund shall not revert but shall remain available for use until June 30, 2031. Any moneys remaining in the fund as of June 30, 2031, shall be transferred for deposit in the veterans trust fund. New Code section 35E.4 provides for the process for a treating facility to seek reimbursement from the veterans recovery fund for providing hyperbaric oxygen treatment. The bill provides that a treating facility may submit a proposed treatment plan to the department of veterans affairs and the commission of veterans affairs for their approval. The treatment plan shall include the prescription order for the treatment, information verifying the eligibility of the veteran to receive and the treatment facility to provide the treatment, the estimated costs for providing the treatment and for reimbursing the veteran for any associated travel and living expenses, and any other information required by the department of veterans affairs. The new Code section provides that the treatment plan shall not be approved if sufficient moneys to reimburse the estimated costs are not available in the veterans recovery fund. The new Code section also establishes a process for submitting a modified treatment plan if the estimated costs for providing the treatment are anticipated to exceed the cost estimate in the initial treatment plan. New Code section 35E.5 provides for requirements relative to providing hyperbaric oxygen treatment and provides for the manner in which treatment-related expenses are to be reimbursed. The Code section provides that a treatment facility shall not be reimbursed for providing treatment unless a treatment plan has been approved. If a treatment facility elects to provide hyperbaric oxygen treatment under the pilot program, the facility shall provide the treatment without charge to a veteran and shall submit regular reports to the department of veterans affairs concerning the efficacy of the treatment and whether the treatments have been concluded. The new Code section also provides for a process for a treatment facility and a veteran to receive reimbursement for expenses incurred. The new Code sections require the department of veterans affairs to provide written notification to the treatment facility and veteran after treatment has concluded, which notice shall indicate when any additional requests for reimbursement may be made. Code section 35E.6 provides that the new Code chapter is repealed July 1, 2031. The bill further directs the department of veterans affairs to submit a notice of intended action to the administrative rules coordinator and the administrative code editor not later than January 1, 2026, for the adoption of rules necessary to implement and administer the new Code chapter. HF465 A bill for an act relating to disclosure to the general assembly of information concerning nongovernmental employers and providing remedies. This bill relates to disclosure to the general assembly of information concerning nongovernmental employers. The bill provides that an employer, as defined in the bill, cannot prohibit an employee from disclosing any information to a member or employee of the general assembly if the employee, in good faith, reasonably believes the information evidences a violation of law or rule, or a substantial and specific danger to public health or safety. The employer additionally cannot require an employee to inform the employer that the employee made such a disclosure. The bill further prohibits the employer from discharging from employment, demoting or failing to promote, or taking other adverse employment action against an employee as a reprisal for such actions. The bill specifies that these provisions do not apply when disclosure of information by an employee is required by statute or when the employee engages in certain deceptive actions. An employee may enforce the prohibition on adverse employment action through a civil action. An aggrieved employee may seek injunctive relief. An employer who violates the prohibition is liable to an aggrieved employee for affirmative relief as provided in the bill. If an employee makes a permitted disclosure of information to a member or employee of the general assembly, such disclosure, any information disclosed, and any communication between the employee and the member or employee of the general assembly relating to the disclosure are confidential. Such matters are not subject to compelled disclosure under any provision of law. The employee or the member or employee of the general assembly may choose to provide information disclosed as permitted by the bill to a law enforcement agency or other government agency for use in the agency’s official duties. The bill shall not be construed to permit an employee to retaliate against an employer. The bill requires the legislative services agency to post a notice of the provisions of the bill on the general assembly’s internet site. In Committee

HF70 A bill for an act relating to Medicare supplement policies and an annual open enrollment period.(See HF 308.) This bill relates to Medicare supplement policies and an annual open enrollment period. Beginning January 1, 2025, applicants shall have an annual 31-day open enrollment period that begins on March 1. “Applicant” is defined in the bill as an individual who is a covered person under an individual or group Medicare supplement policy. “Applicant” includes an individual under the age of 65 who qualifies for Medicare due to disability, end-stage renal disease, or exposure to an environmental hazard. “Medicare supplement policy” is also defined in the bill. During the open enrollment period, for at least one Medicare supplement policy or certificate that the issuer offers and that is available for issuance in the state, an issuer is prohibited from denying or conditioning the issuance or effectiveness of the Medicare supplement policy or certificate; from subjecting an applicant to medical underwriting or discriminating in the pricing of the Medicare supplement policy or certificate because of the health status, claims experience, receipt of health care, or medical condition of an applicant; and from imposing an exclusion of benefits based on an applicant’s preexisting condition. An issuer shall provide notice, in a form prescribed by the commissioner of insurance, of the annual open enrollment period at the time an applicant applies for a Medicare supplement policy or certificate. “Issuer” is defined in the bill.
