HB1007 Energy generation resources. Energy generation resources. Provides a credit against state tax liability for expenses incurred in the manufacture of a small modular nuclear reactor (SMR) in Indiana. Establishes procedures under which certain energy utilities may request approval for one or more of the following from the Indiana utility regulatory commission (IURC): (1) An expedited generation resource plan (EGR plan) to meet customer load growth that exceeds a specified threshold. (2) A generation resource submittal for the acquisition of a specific generation resource in accordance with an approved EGR plan. (3) A project to serve one or more large load customers. Sets forth: (1) the requirements for approval of each of these types of requests; (2) standards for financial assurances by large load customers; and (3) cost recovery mechanisms for certain acquisition costs or project costs incurred by energy utilities. Amends the statute concerning public utilities' annual electric resource planning reports to the IURC to provide that for an annual report submitted after December 31, 2025, a public utility must include information as to the amount of generating resource capacity or energy that the public utility plans to retire or refuel with respect to any electric generation resource of at least 125 megawatts. Provides that for any planned retirement or refueling, the public utility must include, along with other specified information, information as to the public utility's plans with respect to the following: (1) For a retirement, the amount of replacement capacity identified to provide approximately the same accredited capacity within the appropriate regional transmission organization (RTO) as the capacity of the facility to be retired. (2) For a refueling, the extent to which the refueling will maintain or increase the current generating resource accredited capacity or energy that the electric generating facility provides, so as to provide approximately the same accredited capacity within the appropriate RTO. Requires IURC staff to prepare a staff report for each public utility report that includes a planned electric generation resource retirement. Provides that if, after reviewing a public utility's report and any related staff report, the IURC is not satisfied that the public utility can satisfy both its planning reserve margin requirement and the statute's prescribed reliability adequacy metrics, the IURC shall conduct an investigation into the reasons for the public utility's inability to meet these requirements. Provides that if the public utility's report indicates that the public utility plans to retire an electric generating facility within one year of the date of the report, the IURC must conduct such an investigation. Provides that: (1) a public utility may request, not earlier than three years before the planned retirement date of an electric generation facility, that the IURC conduct an investigation into the planned retirement; and (2) if the IURC conducts an investigation at the request of the public utility within that three year period, the IURC may not conduct a subsequent investigation that would otherwise be required under the bill's provisions unless the IURC is not satisfied that the public utility can satisfy both its planning reserve margin requirement and the statutory reliability adequacy metrics as of the time the investigation would otherwise be required. Provides that if a CPCN is granted by the IURC for a facility intended to repower or replace a generation unit that is planned for retirement, and the CPCN includes findings that the project will result in at least equivalent accredited capacity and will provide economic benefit to ratepayers as compared to the continued operation of the generating unit to be retired, the CPCN constitutes approval by the IURC for purposes of an investigation that would otherwise be required. Provides that if, after an investigation, the IURC determines that the capacity resources available to the public utility will not be adequate to allow the public utility to satisfy both its planning reserve margin requirements and the statute's prescribed reliability adequacy metrics, the IURC shall issue an order: (1) directing the public utility to acquire or construct; or (2) prohibiting the retirement or refueling of; such capacity resources that are reasonable and necessary to enable the public utility to meet these requirements. Provides that if the IURC does not issue an order in an investigation within 120 days after the initiation of the investigation, the public utility is considered to be able to satisfy both its planning reserve margin requirement and the statutory reliability adequacy metrics with respect to the retirement of the facility under investigation. Provides that if the IURC issues an order to prohibit the retirement or refueling of an electric generation resource, the IURC shall create a sub-docket to authorize the public utility to recover in rates the costs of the continued operation of the electric generation resource proposed to be retired or refueled, subject to a finding by the IURC that the continued costs of operation are just and reasonable. (2) Adopting a policy or otherwise preventing a parent of a student from recording a meeting concerning the student's individualized education program. Requires each school corporation to ensure at least one employee in each school building that is used for classroom instruction: (1) has obtained nonviolent crisis intervention training; and (2) is present in the school building during the school year while school is in session. Establishes requirements regarding the employee. Requires the department of education to review nonviolent crisis intervention training programs and make recommendations to school corporations regarding the training of employees. (2) Prohibits a financial services provider from: (A) refusing to provide to a firearms retailer; (B) terminating an existing business relationship to provide to a firearms retailer; or (C) offering or providing on less favorable terms and conditions to a firearms retailer; any service to facilitate or process payment card transactions, solely on the basis of the firearms retailer's status as a firearms retailer. (3) Provides an exemption from these prohibitions if a prohibited action is taken: (A) to comply with federal or state law or a court order; or (B) at the request of a law enforcement agency in connection with an active criminal investigation. Provides that: (1) no property tax increment financing district or allocation area may be established, amended, or renewed; and (2) no bonds, leases, or other obligations may be issued, entered into, or extended for a property tax increment financing district or allocation area. Provides that a school corporation may impose an annual fee to replace the loss of revenue previously collected by the school corporation from the imposition of an operating referendum tax levy or school safety referendum tax levy. Prescribes procedures for the fixing and reviewing of a political subdivision's budget. Prohibits the imposition of new levies for controlled projects, operating referenda, and school safety referenda. Abolishes the offices of county assessor and township assessor. Extends the sales and use tax application to transactions involving services, except for health or mental health services (including insurance premiums for policies covering these services) and services provided for charitable tax exempt purposes. Establishes the local revenue sharing fund (fund) into which revenue from the portion of revenue from the extended sales and use tax is to be deposited. Requires the state comptroller to distribute to taxing units the portion of all the state sales and use tax revenue attributable to services from the fund. (3) Include in the food or lodging establishment's biennial report to the secretary of state an attestation that the food or lodging establishment has complied with the training requirement in each of the two years covered by the report. (4) Post in a location in the food or lodging establishment that is readily accessible by all employees of the food or lodging establishment a conspicuous written notice: (A) asking employees to report suspected human trafficking; and (B) providing contact information for state and federal agencies to which suspected human trafficking can be reported. Provides that the office of the secretary of state may audit the training records of a food or lodging establishment to verify the food or lodging establishment's attestation regarding the training requirement in the food or lodging establishment's biennial report. Provides that, as a prerequisite for the department of natural resources (department) to issue an integration order in regard to the underground storage of carbon dioxide, a storage operator must obtain the consent of: (1) the owners of the pore space underlying at least 85% of the surface area above the proposed storage facility or amended proposed storage facility; and (2) the county executive of each county in which the storage facility is proposed to be located. Limits the length of a pipeline for purposes of a carbon sequestration project to 30 total miles. Increases the annual injection fee a storage operator must pay to the department from $0.08 to $0.15 per ton of carbon dioxide estimated to be injected into a storage facility. Dead
HB1269 Indiana economic development corporation. Indiana economic development corporation. Provides for appointment to the board of the Indiana economic development corporation (IEDC) of two nonvoting, advisory members who are members of the general assembly. Requires the IEDC, before purchasing land that exceeds 100 acres in a county, to first give notice to the county or municipality, or both, in which the land is located not later than 30 days before the closing date for the purchase. Specifies additional procedures that the IEDC must take when acquiring land. Requires the IEDC to establish a mechanism to track the impacts of economic development projects based on: (1) wages paid to employees; and (2) financial impacts to local governments. Sets forth the information required to be reported on the tracking mechanism, which must be updated quarterly and posted quarterly on the IEDC's transparency portal. Requires the IEDC to provide an annual report of the information reported on the tracking mechanism and other information related to economic development to the general assembly. Requires the IEDC to dedicate at least 5% of the funds appropriated to the IEDC for economic development purposes in state fiscal years 2026 and 2027 for economic development projects located in communities that meet specified criteria. Provides that a civilian cyber corps volunteer or advisor is immune from tort liability for an injury to a person or damage to property that occurs while the volunteer or advisor is deployed and acting on behalf of the adjutant general if certain conditions are met.
