LD490 An Act to Provide for a 5-year Automatic Repeal of Agency Rules This bill amends the Maine Administrative Procedure Act to provide that any agency rule that is finally adopted or an amendment to which is finally adopted in accordance with the requirements of that Act after January 1, 2026 is automatically repealed 5 years from the date of final adoption. An agency that has adopted or has jurisdiction over a rule subject to automatic repeal may submit to the Legislature a request that the rule be renewed and not be subject to repeal for an additional period of up to 5 years. For any rule subject to automatic repeal, the bill requires the Secretary of State to provide to the agency that adopted or has jurisdiction over the rule a notice regarding the date of the automatic repeal no later than 18 months prior to the date on which the rule will be repealed. LD1973 Resolve, to Establish the Commission to Study Oversight and Funding Structures for Recovery Residences and Resident Protections This resolve establishes the Commission to Study Oversight and Funding Structures for Recovery Residences and Resident Protections. The commission is required to evaluate various policies and industry standards and make policy recommendations with respect to the following: the use of general assistance and the possible expansion or development of new state-funded subsidy programs for use at a recovery residence; alternative models of oversight structure for recovery residences, including voluntary certification, mandatory certification or licensure; and policies related to the use of prescribed medications in recovery residences. The commission is composed of 15 members, including Legislators, the Commissioner of Health and Human Services or the commissioner's designee, the Director of the Office of Policy Innovation and the Future or the director's designee and various other members who have experience with recovery residences, advocating for individuals with substance use disorder or expertise in tenant rights or housing protections for persons with disabilities or substance use disorder. No later than December 3, 2025, the commission is required to submit to the Joint Standing Committee on Health and Human Services a report that includes the commission's findings and recommendations, including any suggested legislation. LD482 An Act to Expand Educational Opportunities and Broaden Educational Services for Students Enrolled in Equivalent Instruction Programs This bill modifies the provisions of law governing standards for participation in public school by students who are enrolled in equivalent instruction programs. Equivalent instruction programs include home instruction programs, private schools or other alternative arrangements approved by the Commissioner of Education. Current law provides different standards for participation in public school for students enrolled in home instruction programs as opposed to students enrolled in certain recognized private schools. The bill amends the law to provide one set of standards to apply to all types of equivalent instruction programs. The bill makes changes related to the approval process that a student enrolled in an equivalent instruction program must follow to participate in regular classes in a public school. These changes include eliminating the requirement that a student receive written approval from the superintendent or the superintendent's designee to enroll in or audit a course and modifying the terms used to describe the academic achievement a student must demonstrate in order to participate. The bill allows an equivalent instruction program to use facilities on property owned or leased by a library, community service organization, museum, performing arts venue, theater, cinema or church facility if the property is being used solely for the purpose of operating a type of facility described in the bill, the facility is or was actively used for one of those purposes within 5 years of any executed agreement for the equivalent instruction program to use that facility and the facility follows the state and local health, safety and welfare laws, codes and rules applicable to that facility, including fire safety and building safety. LD300 Resolve, to Direct the Governor's Energy Office to Study Expanding the Use of Hydroelectric Power and the Development of a Geothermal Power Plant in the State This resolve directs the Public Utilities Commission to conduct 2 studies related to developing the State's portfolio of energy sources. Under the resolve, the commission must study the current operation of the hydroelectric power industry in this State and evaluate opportunities to expand or relocate existing hydroelectric power facilities. The commission must evaluate how any new technologies being used in other states could be used in this State to improve or expand the hydroelectric power industry and whether any former hydroelectric power facilities could be restored. The commission must also conduct a study for the purpose of developing a geothermal power plant in this State. The commission must submit a report based on each study under this resolve to the joint standing committee of the Legislature having jurisdiction over energy matters no later than November 4, 2026. The joint standing committee may report out legislation pertaining to the reports to the 133rd Legislature in 2027. Passed
LD637 Resolve, Directing the Department of Health and Human Services to Evaluate the Municipal General Assistance Program Database This resolve directs the Department of Health and Human Services to issue a report to the Joint Standing Committee on Health and Human Services on an evaluation of the feasibility of upgrading the database for the municipal general assistance program to allow the determination of whether a disqualified applicant is seeking assistance in another municipality. If the department determines that the current database cannot be upgraded, the department is to research a suitable replacement database that fulfills the criterion. LD220 An Act to Establish the Hope and Inclusion Scholarship Program in Order to Provide Funding for Students Attending Certain Private Schools and Students Receiving Home Instruction This bill establishes the Hope and Inclusion Scholarship Program administered by the Hope and Inclusion Scholarship Board. The board is directed to establish hope accounts that may be used by the parents or legal guardians of qualified students to pay for the education of those students enrolled in certain private schools and students receiving home instruction. The funding for these hope accounts comes from shifting 90% of the essential programs and services funding that would otherwise be provided by the State and by the school administrative unit for each qualified student into a hope account. LD266 An Act to Require the Updating of Voter Registration Signatures This bill stipulates that, beginning January 1, 2026, a voter signature is valid for 5 years from the time it was last updated. It also requires the registrar from each municipality to review the central voter registration system annually and notify those voters whose signatures expire in that calendar year and provide those voters with a voter signature registration update form. LD1873 An Act to Require Age Verification for Online Obscene Matter This bill requires that a business entity that knowingly and intentionally publishes or distributes obscene matter on a website or software application verify that an individual attempting to access the obscene matter is 18 years of age or older through reasonable age verification methods. The bill prohibits a business entity that performs an age verification of an individual from retaining any identifying information of the individual after the individual's age has been verified. The bill does not apply to a bona fide news broadcast or public interest broadcast, video, report or event. A business entity that is found to have violated the provisions of the bill is liable to an individual for damages including court costs and reasonable attorney's fees, and the Attorney General may bring an action against the business entity for an unfair or deceptive act or practice. LD1877 An Act to Increase Penalties for Human Trafficking Offenses This bill increases the penalties for sex trafficking and aggravated sex trafficking and provides mandatory minimum jail sentences and mandatory fines for these offenses. It provides additional jail time for these offenses when committed on the premises or within 1,000 feet of certain places, including schools, child care facilities, community centers for youth, correctional facilities, shelters and residential treatment centers. It increases the amount a person convicted of sex trafficking or aggravated sex trafficking must pay to the Victims' Compensation Fund. It provides that, in a case of sex trafficking or aggravated sex trafficking, the court must require the person sentenced to participate in an electronic monitoring program, if available. It requires the court to order restitution in a case of sex trafficking or aggravated sex trafficking. It provides that a doctor, nurse, teacher, school board member, principal, educational technician, superintendent or person who works in the hospitality industry as a front desk worker, a member of housekeeping staff or in food service must complete a human trafficking awareness program of at least 2 hours once every 2 years. The program must be presented by a nonprofit organization specializing in human trafficking investigations and victim assistance. In Committee
LD1704 An Act to Prohibit a School Administrative Unit from Adopting a Policy That Allows a Student to Use a Restroom Designated for Use by the Opposite Sex This bill prohibits a school administrative unit from adopting a policy that permits a student to use a school restroom according to the student's gender identity if that restroom is designated for use by a sex that does not correspond to the student's sex assigned at birth. The bill also directs the Department of Education to update its rules consistent with this legislation. In Committee
LD1675 An Act to Provide Just Compensation in Cases of Taking by Eminent Domain by Transmission and Distribution Utilities This bill updates the laws regarding damages paid to owners of property taken by eminent domain by a transmission and distribution utility for the construction, rebuilding or relocation of a transmission line. The bill requires a transmission and distribution utility to set aside 1% of the total revenue generated from the construction, rebuilding or relocation of a transmission line annually to be paid as damages to the owner of a property taken by eminent domain for the construction, rebuilding or relocation of that transmission line. The 1% of the revenue set aside for damages must be distributed to property owners based on the acres of property taken from that owner for the construction, rebuilding or relocation of the transmission line in the form of an annual installment over the course of 20 years from the operation date of the transmission line. LD233 An Act to Prohibit Biological Males from Participating in School Athletic Programs and Activities Designated for Females When State Funding Is Provided to the School This bill prohibits a school administrative unit or an elementary school, secondary school or postsecondary educational institution in the State that receives any state funding from allowing a person whose biological sex assigned at birth is male to participate in an athletic program or activity that is designated for females. LD612 An Act to Require the Department of Health and Human Services to Review Medicaid, Supplemental Nutrition Assistance Program and Electronic Benefits Transfer Card Transactions and Lottery Operations This bill requires the Department of Health and Human Services to cross-check data of lottery winners with recipients of Medicaid benefits or the Supplemental Nutrition Assistance Program and to deduct from the winnings the past 5 years of benefits received by the prize winner and administrative costs. The bill also requires the department to monitor out-of-state electronic benefits transfer, or EBT, system transactions and terminate the benefits of any recipient who makes solely out-of-state EBT card transactions over a 90-day period and is determined to no longer reside in the State or does not respond to department contact. LD644 An Act to Expand Employment Opportunities for Minor Students by Eliminating Certain Work Limitations This bill repeals the provisions of law specifying that a minor 16 or 17 years of age may not work: 1. More than 50 hours in any week when the minor's school is not in session; 2. More than 24 hours in any week when the minor's school is in session; 3. More than 6 hours in any day when the minor's school is in session; 4. More than 10 hours in any day when the minor's school is not in session; 5. More than 6 consecutive days; 6. After 10:15 p.m. on a day preceding a day on which the minor's school is in session or after 12 midnight on a day that does not precede such a school day; or 7. Before 7 a.m. on a day on which the minor's school is in session or before 5 a.m. on any other day. The bill also repeals the provision of law specifying that a minor under 17 years of age may not be employed during the hours that the public schools of the town or city in which the minor resides are in session. The bill also repeals record-keeping requirements regarding work hours for minors. Dead

LD1638 An Act Regarding Disability Retirement Benefits Under the Maine Public Employees Retirement System Under current law, the disability retirement benefits paid by the Maine Public Employees Retirement System to a person who is disabled are reduced if that person receives benefits from the United States Social Security Act. This bill removes that reduction for persons who are disabled and were receiving disability retirement benefits from the Maine Public Employees Retirement System as of December 31, 2024. The provisions of the bill retroactively apply to the date that person began receiving reduced disability retirement benefits and requires that the person be paid the withheld benefits, including any cost-of-living adjustments and interest. The bill also removes the requirement that such a person include in the application for disability retirement benefits proof that the person has made application for benefits under the United States Social Security Act. LD1588 An Act to Ensure Transparency in Student Transfer Requests This bill modifies the education laws governing student transfers to require greater transparency by school administrative units and the Commissioner of Education. The bill requires school administrative units to report information pertaining to requests by students to transfer either to or from that school administrative unit within the past year. The bill also requires the commissioner to make a de-identified version of that information available on the Department of Education's publicly accessible website, including information related to any transfer request reviewed by the commissioner. LD1273 An Act to Make Paid Family and Medical Leave Voluntary Part A of this bill repeals the provisions in law that established the paid family and medical leave benefits program. Part A requires the Department of Labor to refund contributions made by employers and self-employed individuals to the Department of Labor under the paid family and medical leave benefits program and requires an employer that deducted a portion of the premium required for an employee from that employee's wages to remit that portion of the premium to the employee as part of the employee's wages. Part A also requires the State Controller to transfer unappropriated funds from the Department of Labor, Paid Family and Medical Leave Insurance Fund, Other Special Revenue Funds account to the unappropriated surplus of the General Fund. Part B of the bill establishes a voluntary paid family and medical leave program for employers of 50 or more employees and also allows individual employees whose employers do not participate in the program to voluntarily participate. Part B requires the Commissioner of Labor to contract with an insurance company authorized to do business in this State to provide this coverage after a competitive bidding process. The commissioner is required to issue the request for proposals no later than January 1, 2026, and voluntary paid family and medical leave coverage must be available for purchase no later than January 1, 2027. The program provides employees who are eligible for paid family and medical leave with 60% of their average weekly wage, up to a maximum amount based on the cap on wages eligible for social security benefits, for up to 6 weeks per year. LD1466 An Act Related to Excusing a School from Making Up Missed Days When It Cannot Operate During a Declared State of Emergency This bill requires the Commissioner of Education to exempt a school from making up missed instructional days in cases when the school is located in a section of the State for which a state of emergency has been declared by the Governor and the school was in fact unable to operate due to circumstances or conditions related to the reason for the emergency proclamation. The bill requires the Department of Education to update its rules and requires that the rules clarify that a school requesting the exemption may not be required to submit a waiver application. The commission is tasked with reviewing national data on the scope of the use of blockchain technology and cryptocurrency, assessing the current status of blockchain technology and cryptocurrency within the State, studying nonfungible tokens, consulting industry experts and compiling legislative recommendations to position the State as a leader in the emerging fields of blockchain technology and cryptocurrency. The commission is directed to report on its study no later than December 3, 2025 to the Joint Standing Committee on Health Coverage, Insurance and Financial Services, which is authorized to report out legislation based on the report. LD1254 An Act to Expand the Licensing of Outpatient Surgical Facilities This bill modifies the definition of "ambulatory surgical facility" by removing language that excludes the private office of a physician or dentist and a facility existing for the primary purpose of performing terminations of pregnancies. Under the bill, such a facility is considered an ambulatory surgical facility and would be required to be licensed as such if that facility's primary purpose is providing outpatient elective surgical care. LD938 An Act to Implement Certain Local Spending and Sourcing Requirements Regarding the Statewide Supplemental Nutrition Assistance Program This bill requires a household receiving Supplemental Nutrition Assistance Program benefits to spend at least 10% of each monthly benefit within a 50-mile radius of the household's declared residence. It also provides that, in addition to the requirements established by the United States Department of Agriculture, a retailer participating in the Supplemental Nutrition Assistance Program must ensure that at least 10% of all perishable foods in the retailer's inventory are sourced from within the State. The bill also requires the Secretary of State to maintain a roster of persons designated as dedimus justices and make the roster available on the Secretary of State's publicly accessible website. LD1067 An Act to Improve the Process for Mobile Home Owners to Purchase Their Mobile Home Park This bill increases from 51% to 60% the percentage of mobile home owners needed to indicate in writing that they support a group of mobile home owners or a mobile home owners' association making an offer to purchase the mobile home park where their mobile homes are located. The bill also prohibits a mobile home owners' association from contacting mobile home owners more than 3 times about the purchase of the mobile home park. In Committee
LD1222 An Act to Limit Sovereign Immunity for Schools and School Superintendents This bill removes immunity under the Maine Tort Claims Act for school superintendents, school administrative units or schools within the school administrative unit's jurisdiction for certain conduct, including negligence, violations of state or federal education law, failure to ensure student safety, failure to report abuse of, neglect of or threats to a student, willful misconduct or criminal activity. The bill also requires school administrative units to indemnify their staff and employees, establish mandatory reporting policies regarding student safety and carry liability insurance. The bill directs the Department of Education to submit an annual report to the Legislature on the impact and effectiveness of these provisions and establishes an effective date of October 1, 2026. LD660 An Act to Provide Transparency and Public Access to Public School Curricula This bill requires school administrative units to adopt policies and procedures to ensure that the approved curriculum presented is implemented in the classroom without change, to post at least 3 years of data regarding certain student enrollment and performance, to maintain lists regarding participation in and development of professional development programs and to create an online portal that will act as the single source for all student information and data that can be accessed by 3rd-party contractors, including curriculum materials and information regarding speakers and guests. The bill requires the Department of Education to list and make available to the public all administrator, teacher and staff professional development and instructional programs offered to schools that are paid for with state funds and maintain a list of school boards that have approved a statewide program. The bill places restrictions on the choice of academic class offerings and curriculum materials and on-site professional development programs. Certain provisions of this bill are designed to satisfy federal law related to parental access to information and protection of pupil's rights. In Committee
LD1110 An Act to Require Remittance Fees for Money Transmissions This bill requires a sender of a money transmission to pay a remittance fee to be deposited into the General Fund. The sender is entitled to a state income tax credit in the amount of the fee if the sender files a state individual income tax return with either a valid social security number or a valid tax identification number. LD735 An Act to Protect Sand Dunes on Sears Island and to Establish Criteria for Legislation Regarding Land Development This bill repeals the provisions in law that authorize the Department of Environmental Protection to consider and potentially grant a permit under the Maine Revised Statutes, Title 38, section 480-D for construction of an offshore wind terminal on Sears Island in the Town of Searsport to be located on or that will otherwise impact a coastal sand dune system on the island. The bill also repeals the provisions in law that direct the Department of Transportation, in collaboration with the Maine Coast Heritage Trust, to take all reasonable steps to ensure the conservation and protection of a parcel of land in the northwest portion of Sears Island that is approximately 10 acres in size and that includes a coastal sand dune system that is approximately 1 1/2 acres in size. The bill also requires that any legislation proposing to enact a measure regarding the development of land that is in conflict with United States Environmental Protection Agency regulations may be sponsored only by a member of the House of Representatives or Senate who represents the affected district and may be enacted only with a 2/3 vote of the Legislature. The bill also prohibits the State from authorizing any land development on Sears Island without first establishing an indigenous lands protection committee and obtaining from that committee a certification that any area to be developed does not contain a site sacred to indigenous people in Maine. LD1032 An Act Regarding Court Security This bill requires the State Court Administrator to contract for the services of qualified individuals to perform court security-related functions and services at a court if court operations at that court have been adversely affected by a lack of available court security for more than 2% of scheduled court time in a month at that court. It provides that, when the State Court Administrator contracts for the services of qualified individuals to perform court security-related functions and services, the State Court Administrator must first offer the contract to the appropriate sheriff's office before the contract is offered to another party. The current law states that an employer is not permitted to prohibit an employee from storing a firearm in the employee's vehicle if the employee has a valid permit to carry a concealed firearm under the Maine Revised Statutes, Title 25, chapter 252, as long as the vehicle is locked and the firearm is stored out of sight. LD505 An Act to Update Processes and Fees in the Probate Court System This bill makes the following changes to the Maine Uniform Probate Code. 1. It increases certain filing fees throughout the Code and provides that, after 2025, these fees must automatically be adjusted for inflation. 2. It requires any party that files a petition, motion or other document with a probate court that is created with the assistance of artificial intelligence technology to verify the accuracy of the petition, motion or other document by affidavit and authorizes the court to impose appropriate sanctions on parties that violate this requirement. 3. It requires a personal representative who has mailed an inventory of the property of the decedent to all interested parties who requested the inventory to also file the inventory with the court. Under current law, the personal representative has discretion to file the inventory with the court in these circumstances. 4. It provides that, like a guardian ad litem appointed by a probate court, a visitor appointed by a probate court is entitled to quasi-judicial immunity for acts performed within the scope of the visitor's duties. 5. It changes from 14 years of age or older to 12 years of age or older the age at which an adoptee must consent either to a parent's consent to have the child adopted by a specific petitioner or to a parent's surrender and release of the parent's parental rights in favor of a licensed child-placing agency or the Department of Health and Human Services.
