The bill requires the Department of Labor to refund contributions made by employers of individuals in agriculture pursuant to the paid family and medical leave benefits program. It requires an employer that deducted a portion of the premium required for an employee from that employee's wages to remit that portion of the premium to the employee as part of the employee's wage. LD1201 An Act to Protect Maine Agriculture and Farms by Exempting Certain Pesticides from Regulation This bill amends the law providing for exemption of certain veterinary products from the law governing products containing perfluoroalkyl and polyfluoroalkyl substances, or PFAS, to allow products approved for use for aerial or land application that are regulated by the United States Environmental Protection Agency pursuant to the Federal Insecticide, Fungicide, and Rodenticide Act. It creates an exemption for a pesticide registered by the United States Environmental Protection Agency pursuant to the Federal Insecticide, Fungicide, and Rodenticide Act applied by a person licensed by the Department of Agriculture, Conservation, and Forestry, Board of Pesticides Control as an agricultural basic applicator, a private applicator or a commercial applicator. LD1213 An Act Regarding Apportionment of Stipends to Agricultural Fairs This bill modifies the provisions of law governing distribution of stipends to persons or entities licensed to hold an agricultural fair. Under current law, after certain distributions are made from the Stipend Fund pursuant to the Maine Revised Statutes, Title 7, section 86, the amount remaining is distributed among fair licensees meeting certain requirements. Distributions are based on premiums and gratuities actually paid by the licensees. The current law limits the use of premiums and gratuities for determination of apportionment to premiums and gratuities paid for certain specified activities and events. The bill broadens the activities and events that may be considered in the calculation of apportionment for stipends by specifying that, in addition to the activities and events considered under current law, any other agricultural event approved by the Commissioner of Agriculture, Conservation and Forestry may be used to determine the apportionment. LD1252 An Act to Amend the Laws Governing the Maine Agriculture, Food System and Forest Products Infrastructure Investment Advisory Board This bill modifies provisions of the law governing the Maine Agriculture, Food System and Forest Products Infrastructure Investment Advisory Board and disbursements from the Maine Agriculture, Food and Forest Products Investment Fund, which the advisory board oversees. The bill requires that disbursements may be made only to a producer of agricultural, food or forest products that has or is seeking to establish a processing or manufacturing facility located in the State. A producer receiving a disbursement must use the disbursement to support the operations of a processing or manufacturing facility located in this State for the following purposes, including, but not limited to, obtaining equipment and investing in supply chain infrastructure to grow, harvest, process or manufacture agricultural, food or forest products used in commercial products. In carrying out these purposes, the producer must obtain, to the extent practicable, agricultural, food or forest products from a farm or a forest or waters in the State or from offshore waters to be collected in the State. The bill also prohibits a member of the advisory board from participating in any vote when that member has a conflict of interest. A conflict of interest exists when the board member or a member of the board member's immediate family has or would acquire a direct and substantial personal financial interest, distinct from that of the general public, in an enterprise that would be financially benefited by a proposed fund allocation. LD1198 Resolve, Directing the Department of Agriculture, Conservation and Forestry to Assess Its Current Meat and Poultry Inspection Programs This resolve directs the Department of Agriculture, Conservation and Forestry to conduct a review of programs and processes related to meat and poultry inspections, including processes related to exemptions from inspections, to determine areas for possible improvements, efficiencies and enhanced flexibility to benefit agricultural producers, processors and retail and public customers. The department is required to submit a report based on its evaluation by January 15, 2026 to the Joint Standing Committee on Agriculture, Conservation and Forestry, which may submit legislation related to the report to the Second Regular Session of the 132nd Legislature. LD1699 An Act to Create a Refundable Tax Credit for Agricultural Enterprises This bill allows an agricultural enterprise to qualify for the Maine Seed Capital Tax Credit Program, which provides an eligible business a tax credit for investments in plant, equipment, research and development, or working capital for the business or such other business activity as may be approved by the Finance Authority of Maine. The bill allows an agricultural enterprise determined eligible by the authority to qualify for a tax credit for investments made in infrastructure, not including real estate, but including any improvement that expands the marketing, production or processing of agricultural products, in addition to the qualifying investments that may be made by a business. LD1207 An Act to Amend the Site Location of Development Laws to Require a 100-foot Buffer Between Solar Energy Developments and Rivers, Streams and Brooks This bill directs the Department of Environmental Protection, in consultation with the Department of Inland Fisheries and Wildlife, to establish, adopt rules for and administer a program to monitor air and water temperatures surrounding solar energy developments. Under the bill, "solar energy development" is defined as a development occupying 3 or more acres that uses a solar energy system consisting of ground-mounted solar panels to convert solar energy to electrical energy for sale or use by a person other than the generator. The bill also requires the department to monitor out-of-state electronic benefits transfer, or EBT, system transactions and terminate the benefits of any recipient who makes solely out-of-state EBT card transactions over a 90-day period and is determined to no longer reside in the State or does not respond to department contact. LD1739 An Act to Authorize a General Fund Bond Issue to Support Maine's Agricultural Sector, to Create an Agricultural Buildings Property Tax Exemption and to Direct the Department of Agriculture, Conservation and Forestry to Study Barriers to Its Financial Assistance Programs and Study the Potential for a Common Application for Those Programs This bill does the following. 1. The funds provided by the bond issue in Part A, in the amount of $55,600,000, will be used to support the agricultural sector in the State. 2. Part B establishes a property tax exemption for certain agricultural and horticultural structures and buildings. 3. Part C requires the Commissioner of Agriculture, Conservation and Forestry to direct staff of the Department of Agriculture, Conservation and Forestry, Bureau of Agriculture, Food and Rural Resources to study the bureau's financial assistance programs for farmers and food producers to identify barriers to accessing these programs and methods to eliminate those barriers and increase the effectiveness of the programs in addressing farmer and food producer needs. The study must also include an examination of how to create a simple common application for all of the department's financial assistance programs. The commissioner is required to submit a report by January 15, 2027 to the joint standing committee of the Legislature having jurisdiction over agriculture, conservation and forestry matters, which may report out legislation to the 133rd Legislature in 2027. LD1702 An Act to Amend Election Polling Place Candidate Restrictions This bill adds new restrictions regarding signatures and campaign contributions and clarifies existing restrictions in current law applying to the political activities of a candidate for public office at a voting place on election day. The bill prohibits a candidate or the candidate's representative, on public property within 250 feet of the entrance to the voting place as well as within the voting place itself, from collecting or soliciting voter signatures on a petition in support of the candidate's candidacy or campaign contributions under the Maine Clean Election Act for an office the candidate is seeking in that election year. The bill also clarifies that at or within 250 feet of a voting place a person may not influence or attempt to influence a voter's decision regarding a candidate for an office that is on the ballot for the election, whether or not the candidate's name is on the ballot, and clarifies that the provision also applies to write-in candidates running for an office that is on the ballot.
